Council met in regular session persuant to adjournment of August 21, 1929, wi Mayor McConnel presiding, and Councilmen BOLLUAN, DICKENS, GORDON, JOHNS, LEIGHTY AND SANDEREYER, PRESENT. ABSENT: NONE. Owing to the absence of the City Clerk, the Mayor a noointed Mr. 71. 0. Dyer, as Acting Clerk. RESOLUTION NO. 14, BY LEIGHTY ryas presented as follows: "RESOLUTION REPEALING RESOLUTION N0. 11 AND REPEALING ALL NOTICES, RESOLUTIONS OR PROCEEDINGS SUBSEQUENT TO THE PASSAGE OF SAID RFSOLUTION NO. 11, RELATING TO LOCAL STREET IMPROVEMENT DISTRICT NO. 9, OF THE CITY OF CALDWELL, IDAHO. "WHEREAS, The Mayor and City Council of the City of Caldwell, Idaho, on the 16t day of August, 1929, passed and approved Resolution No. 11, declaring the intention Of m the City of Caldwell, Idaho, to create and establish Local Street Improvement District No. 9, of the City of Caldwell, Idaho, for the purpose of constructing suitable curbs and gutters thereon, as more fully appears by said Resolution No. 11, and "WHEREAS, An error was made in said Resolution No. 11 in the description of the streets on which the said improvement is to be made, and "VIEFREAS, It will be necessary for the Mayor and Council to pass ,end approve a new Resolution correcting the error made in Paid Resolution No. 11, and revising the estimated cost thereof; "NOW, THEREFORE, BE IT RESOLVED By the Mayor and Council of the City of Cnldwel Idaho: "Section 1. That Resolution No. 11, by Bollman heretofore passed end approved by the Mayor and Council of the City of Caldwell, Idaho, on the 16th day of August, 1929, being a resolution declaring the intention of the City of Caldwell, Idaho, to create and establish Local Street Improvement District No. 9, of the City of Caldwell, Idaho, for the purpose of constructing suitable c•irbs and gutters thereon, be and the same is hereby repealed and that said resolution and all proceedings had thereunder, relating to said Local Street Improvement District No. 9, of the City of Caldwell, Idaho, be revealed and held for naught." Uotion was made by Lei.ghty, seconded by Dickens, that Resolution No. 14 be adopted. The Mayor directed the Clerk 'to call the roll with the following result: AYES: BOLLYAN, DICKENS, GORDON, JOHNS, LEIGHTY AND SANDMEYER. NAYES AND ABSENT: NONE. The Mayor declared the motion carried and Resolution No. 14 adopted. The Mayor and Clerk signed same in open session of the Council. RESOLUTION NO. 15, BY BOLLMAN, was presented as follows: "A RESOLUTION DECLARING THE INTE31TICE OF THE HAYOR AND COUNCIL OF THE CITY OF CALMVELL, IDAHO, TO PASS A PROPER ORDINANCE WHEN THE SAME SHALL BE PRESENTED, GRANTING FRANCHISE TO THE 0. S. L. RAILROAD COMPANY FOR THE CONSTRUCTION OF SIDE TRACK THROUGH THE ALLEY IN BLOCK SS OF THE CRIGI17AL TOITM, NOT CITY OF CALDWELL, AND ACROSS TENTH AVENUE NORTH AND UPON THE NORT11 13.7 FRET OF THE ALLEY THROUGH BLOCK 1 &. 11 111TEREAS, It is the desire of the C. S. L. Railroad Comna.ny to construct a side track through the alley in Block 88 of the original toirn, now City of Caldwell, and across Tenth Avenue North and through the Northwesterly 13.7 feet of the alley in Block 07, original town, now City of Caldwell; "NOW, THEP,EFCRE, BE IT RF_.SOLVFD By the Mayor and City Council of the City of Caldwell, Idaho, as follows. "Section 1. That the lip -yor and Council of the City of Calft el.l, Idaho, hereby declare it to be their intention to grant a proper franchise foi the construction by the 0. S. L. Railroad Company of a side track through the alley in Block 88 of the original town, now City of Caldwell, from Ninth Avenue North to Tenth Avenue North and the ex- J J tension of said side track across Tenth Avenue North to the Northwesterly end of the alley in Block 87 of the original town, now City of Caldwell, and the further extension of said side track along 13.7 feet of the Northwesterly end of said alley in said Block 87 of the r original town, now City of Caldwell, Idaho, according to the preliminary plans and specifL cations heretofore presented to the Mayor and Council." The Mayor directed the Clerk to tail the roll on the question as stated with the following result: AYES: BOLLMAN, DICKENS, GORDON, JOHNS, LEIGHTY AND SANTWEYER, NAYES AND ABSENT: NONE. The Pdayor declared the motion carried and Resolution No. 15 adopted.
