which was read for the first time and the Council proceeaed to a consideration of Bill No. 12. It was moved
by Counciman Vassar, seconded by Councilman Finley that the rules requiring that the reading of a Bill on
three senarate days be suspended and that Bill No. 12, be read the second time by title and the third time
in full section by section and placed on the final nassage. The Mayor directed the Clerk to call the Roll i

on the above motion with the following result: Those voting in the affirmative were: Vassar, Luby, Shorb,
Eldredge and Finley. Negative: None. Absent and not voting: Smith. The Mayor declared the motion had
passed by the necessary three - fourths majority and directed the Clerk to read Bill No. 12, the second time

by title and the third time in full section by section. The Clerk read the Bill as directed. The question
being "Shall Bill No. I2 pass ?" The Mavor directed the Clerk to call the roll on the above question which
resulted as follows: Those voting in the affirmative were: Vassar, Luba. Shorb, Eldredge and Finley.
Negative: None. Absent and not. voting: Smith.
Thereupon the the Mayor declared Bili No. 12, had passed and the Mayor in ooen session of the
Council duly signed and approved the Bill, and the Clerk duly signed and attested the same which became
Ordinance 945 The Mayor directed the Clerk to make proper entry of the same and to cause Ordinance No. 945,1
to be, published in the News - Tribune the official news,aper of the City of C Idaho.
The R"gular Monthly Meeting of the City Council was set for September 8, at 8;00 o'clock P. M.

Upon Roll Call it appeared the motion was unanimously carried.
The following Notice for damages was read and ordered spread on the Minutes:
NOTICE OF CLAIM
PL?.ASE TAKE NOTICE THAT BOBBY M. ELLISON, of 204 Venice, Namoa, Idaho, claims damages auainst the
City of Caldwell in the sum ONE HUNDRED AND FORTY THREE AND NO /L)) DOLLARS ($143.00) for damages received
by claimant when the city sewer line clogged on or about the 26th day of April, 1959, causing the basement ,I
of the home of Ferby Jorgensen at 615 South 9th Avenue, Caldwell, Idaho, in which he was occupying as a
tenant, to fill with sewage to adepth of ei�,ht inches. The items of damage upon which this clam is based
are as follows:
Rug and Pad $ 75.00
Luggage 20.00 I �
Books and Clothing 20.00
Pair of Drapes 8.00
Cleaning 20.00

TOTAL $ 143.
WHEREBY, the undersigned hereby presents this claim and demand for the damages he has sustained
through the negligence of the City of Caldwell in its failing to keen the sewer line which services the

property occupied by the claimant in good maintenance and xeoair.

We, the undersigned, recuest the City of Caldwell, Idaho, to consider vacating the 120 foot
alley which runs through our property. The alley has never been in use and could not continue
to another alley or street if it tiger were nut into use.
Description:
The alley runs north and south between Lot Thirty -five (35) on the west side and lots 1, 2. 3,
h, and 5, on the east side, in Block One (1) of West Side Arlington to Caldwell, Idaho. 11
WE, FRANK W. PSYNE and CAROLYN PAYNE, own Lots 1, 2, 3, L, and 5, on the east side, in Block
One (1) of West Side Addition to Caldwell., Idaho.
We wish the alley vacated so that we might build a house on the NORTH HALF of Lot 35 and the alley.

The Regular Monthly Meeting of the City Council met in the Council Rooms of the City Hall, with
the Mayor Ed Simmerman presiding.

Upon Roll Call the follood ng Councilmen answered present: E. L. Vassar, N. E. "Coley" Smith, II
:toile Shorb and Leland Finley. Absent: Flax Luby and L. P. Eldredge.
The Mayor announced this was the time set for receiving bids on a counter machine for the � +eneral

One bid was received as follows:

Stanley Jensen presented a uetition to the Mayor and Council petitioning the re- zoning or the
following described property:
Commencing at the corner of Hazel Street and Kimball Avenue of the
City of Caldwell, Idaho; thence proceeding North on Kimball Avenue
to the intersection of Kimball Avenue to the intersectio- of Kimball
Avenue and Pine Street, thence on Pine Street to the intersection
of Pine Street and Ellis Avenue; thence South on Ellis Avenue and
Ellis Avenue extended to the intersection o" Ellis Avenue extended
to the intersection with Hazel Street as extended East from Kimball
Avenue; thence West on what would be Hazel S extended to the
real point of beeinni.ng.
This netition was discussed by the Mavor and Council.
It i• =ss the opinion of Councilman Sharb the City would be taping a broad step if a decision was
made by the Council before hearing from the Board of Adjustment on this netition.
Councilman Smith stated the time — coming when Caldwell willfi.nd it necessary to r. -zone to
provide locati - .ns for new industries.
Moved by Shorb, saccnded by Finley a meeting of the Mayor and Council Planning Commission and the
Zoning Board be arranged in the near future to discuss this petition.
Upon Roil Call it anoeared the motion was unanimously carried.
