"WHEREAS, The contract for construction of said improvements was awarded to
said Morrisonftmdsea Company;
"NOW, THEREFORE, BE IT RESOLVED, By the Mayor and dity Counoll of the City of
Caldwell, as follows:
"Seotionl. That the MWor of the City of Oeldwell, be and he hereby is
authorized for and on behalf of the City of Caldwell, to enter into contract with
Morrison - Knudsen Company for the construction of said improvements, according to the
terms, specifications and conditions provided in that certain contract which is attach-
ed to the plane and specifications on file in the office of the City Clerk and dated
the 29th day of July, 1929."
Motion was made by Sandmeyer, seconded by Dickens, that Resolution No. 12 be
adopted. The Mayor directed the dlerls to call the roll on the question with the foll

ABSENT: LRIGHTY. The Mayor deolared the motion carried and Resolution No. 12 adopted.

Council met in regular session persuant to adjournment of August 19, 19a9, with
Mayor M000=e1 presiding, and Oounoilmen BOLLMAN, DICKENS, GORDON, JOHNS, LEIGHTY AND
SANZWER, PRESENT. ABSENT: HONE.
RESOLUTION N0. 18, BY BOLLMAN was presented as follows:
"A THE INTENTION OF ATE AND ESTABL STREET DBOLARING DISTRICT T 30. O 10. FOR THE, CITY 01 CAL DWELL -
FOR THE PURPOSE OF COBSTRUCTING A STREET LIGHTING SYSTEM ALONG Ir HE STREETS THEREIN,
STATING THE 9TRERTS AND ALLEYS UPON wHICH SAID IMPROVEMENT IS TO BE E. MADE THE GENERAL
CHARACTER OF SAID PROPOSED IMPROVEMENT, THE ESTIMATED COST OF THE SAME, AND THAT SUCH
COOT IS TO.BE ASSESSED AGAINST THE ABUTTING, ADJOINING AND ADJACENT LOTS AND LANDS ALOM
AND UPON WHICH SUCH IMPROVEMENTS ARE TO BE MADE, AND UPON LOTS AND LANDS BENEFITED BY
SUCH IMPROVEMENTS AND INCLUDED IN THE IMPROVEMENT DISTRICT FORMED, AND THE METHOD BY
WHICH THE COST AND EXPENSED OF THE IMPROIFDdENTS WITHIN THE INTERSECTIONS ARE TO BE PAID,
FIXING THE TINE WITHIN WHICH PROTESTS AGAINST SAID PROFOSED IMPROVEMENTS OR THE CREATION
OF SAID DISTRICT MAY BE FILED IN THE OFFICE OF THE CITY CLER$, AND WISING THE TIME WHEN
SUCH PROTESTS SHALL BE HEARD AND CONSIDERED BY THE COUNCIL; DECLARING THE INTENTION OF
THE MAYOR AND COUNCIL TO PROVIDE FOR THE COST AND EXPENSES OF SUCH IMPROVEMENTS AND
ISSUII7G BONDS OF SAID DISTRICT, AND DECLARING AN EMERGENCY.
"WHEREAS, it is deemed advisable and to the beat interest of the City of Cald-
well, Idaho, that a 10081 street improvement district shall be established in said city,
including the property abutting, adjoining and adjacent on the portions of the streets
and alleys hereinafter in this resolution specifically act forth, and that there be pqa-
struated in the said district a suitable ornamental street lighting system along the
streets therein and that the 00st of said improvement be levied and assessed against
the lands and lots inaluded within said improvement distriot as and in the manner pro-
vided by law; now, therefore
"Be it resolved by the Mayor and Council of the City of Caldwell, Idaho:
"Section 1. That it is hereby declared to be the intention of the Mayor and
Council of the City of Caldwell, in the County of canyon, State of Idaho, to create and
establish within said city a local street improvement district to be known as and called
Local street Improvement District Nol 10, for the City of Caldwell, Idaho.
"Sea. 2. That said proposed improvement is an original improvement, and the
general character of the improvement to be made in said proposed local street improvement
district, is an ornamental street lighting system, to be constructed of iron, concrete or
granite posts, fusee and lightning arresters, electric lamps, and other necessary equip-
ment to make a complete lighting system, all in accordance with'the plans and specifics -
tions to be hereafter adopted by the City Council and placed 'on file in the office of
the City Clerk of the City of Caldwell.
"Sea. 3. That said Local Street Improvement District No. 10, which consists of,
and includes all the iota and lands, abutting adjoining and adjacent to the following
named streets and parts of streets in said city, between the points hereinafter named,
to a distance back from such streets if platted in blocks to the center of the block, if
platted in lots to the center of the lot, and if not platted to the distance of 125 feet,
as shown by the accompanying map. said streets are designated and desaribed as follows.
MAIN STREET from the Northwesterly side of TdiKD AVENUE to the Southeasterly
side of Ninth avenue; ARTHUR STREET from the Northwesterly side of 3Iri!H AVENUE
to the southeasterly side of NINTH AVENUE; SIY'2H AVENUE from AAAIN STREW to
ARTHUR STREET; sHVIgN aVENUE from the Southwesterly side of the 0. S. L.
right bf way to the uITY HALL; ZIMHALL AVENUE from the Southwesterly side of
ALhANY c'1.41E�T to the Northeasterly side of uLEVL oUULEVA_4D; A7INTH AVENUE
from AGAIN ZJ'TREET TO ARTHUR STREET.
"Sea. 4. That the estimated coat of said improvement herein provided for is
the Sum of X31,500.00.
"Sao. A. That the cost and expenses of said Local Street Improvement District
No. 10, and the construction of acid improvement shall be assessed upon the abutting,
adjoining.: contiguous and adjacent lots and lends, and upon lots and lands benefited and

improved as hereinbefore described, and said coat and expenses shall be assessed upon
the abutting, adjoining, contiguous and adjacent late and lands, and upon lots and lands
benefited and included in the improvement district formed, each parcel of land being
separately assessed for the debt thereof in proportion to the number of square feet of
such lots and lands, abutting, adjoining, contiguous and adjacent thereto, or included
in the improvement district to the distance back from such street, if platted in blocks
to the center of the block, if platted in lots to the center of the lot, and if not
platted to the distance of one hundred twenty -five (125) feet,and in proportion to the
benefits derived to such property by said improvement sufficient to cover the total cost
and expenses of the work. The coat and expenses to be assessed as herein provided for
shall include the contract price of the improvement, engineering and clerical service,
advertising, interest upon warrants if issued, and all legal services for preparing pro-
ceedings and advising in regard thereto.
"Sea. 6. That the cost and expenses of all improlements within any interseoti
if any, in said Local Street improvement District No. 10, shall be paid by the cityl
"Sao. 7. The Mayor and Council of the City of Caldwell, shall assume to retain

together with the City Engineer, shall under the direction of the Mayor and Council, sup-
ervise said construction work, and 'see that the sane is done in strict accordance with
the plans and specifications provided by the City Engineer and approved by the City
Council, and such contracts as may hereafter be entered into by said city and those to
whom the contr =cts may be awarded after due notice for bide has been published as re-
quired by law:
"Sec. o. That all property corners who may desire to protest against the making
of said Improvement and aectnst the creation of said improvement district, may file such
protest in the office of the City Clerk at any time before 5:CO oOclock p.m., on the
3rd day of September, 1929, and that the City Council of said city of Caldwell, will meet
on the 3rd day of September, 1929, at the hour of 5:00 O'clock p.m., in the City Council
Chambers, the authorized and usual ireetin place, to hear and pass upon such protests
theretofore filed and determine wrhether or not to proceed with said - rcposed Improvements.
"Sec. 9. That the City Clerk is hereby authorized and directed to give due
and legal notice hereof, and of the time within which ,retests against said proposed im-
provement, or the creation of said district rnny be filed, and the date when such arotests
will be heard and considered ty the Council, which notice shall describe the general
character of the improvement Proposed to be made and the estimated total cost thereof; and
shall cause such notice c, be published in one issue of the Caldwell News- Tribune, pub-
lished at Caldwell, Idaho, the offici.t.l newspaper of said city, at least five days pre -
ceeding the 3rd day of Septembcr, 1929, being the date fixed in this resolution within
which protects may be filed; and said City Cler!� shill carsc the 6ublisher's Affidavit
of said publication to be filed in his office pn or before the time herein fixed for the
hearing of such rrotests; a copy of snch notice shall be !sailed at least five days pre-
ceding the 3rd day of September, 1929, to eech owner of property, if known, or his agent
if known, within the limits of said improvement district, addressed to such Berson at his
post office address if known, or if unknown, to the post office of the City of Caldwell,
where said improvement is to be nGde; and said City Clerk :oust sake and file in his office
an affidavit showing the mailing of such notice.
"Sec. 10. That bond: of said district shall be issued for the payment of the
cost and expenses included in and for the construction of said improvement; said tends to
be a lien upon said parcels of land Y� ithin said district aad :"ade subject to assessment
for the payment of said bonds and the interest coupone thereon.
"Sec. 11. That the construction of said improvement is necessary for the im-
modiste nreeervation of the public peace, health, and safety, and therefore an emergency
exists and this resolution shall be in full force anrt effect from and after its passage
and approval."
Notion was made by Bollnaan, seconded by Dickens, that Resolution be. 13 be
adopted. The Mayor directed the Clerk to call. the roll on the question as stated with
the following result:
AYES: BOLLMAX, DICY,ENS, GORDON, JOHNS, LEIGHTY AN13 BANDMIrYER,
NAYES AND ABSENT: NONE. The Mayor declared the motion carried and Resolution No. 13
adopted. The 'Mayor and Clerk approved and signed same in open session of the Council.
It was voted on motion of Sondmeyer, seconded by Bollman, that Council adjourn,
to August 2 1929.
