The City Council met in session to hear any protests to the building of a Service Station on the corner of Dearborn and Kimball Streets by W. M. Brooks, with the Mayor Fred L. Lilly presiding. 1 On Ro11 Call, the following Councilmen answered presents M. S. Samdmeyer, 0. E. Bales, C. M. Johnson, Joe Dickens, E. L. Vassar and A. G. Koister. The Mayor asked if any one present wished to protest to the building of said Service Station. No protests appearing, Sandmeyer presented the following Resolution: RESOWTTOH Igo. 3 By dandmeyer. AREAS, II, M. Brooks, heretofore made application for permission to erect and con - straot a service statios�writhin the city limits of the City of Caldwell, outside the limits prescribed by ordinance No. 468, and WHEREAS, said W. M. Brooks has folly complied with all the requirements of said Ordinance No. 468, and wMEFAS, Notice and hearing having been given and had on said matter, pursuant to said Ordinance and the Mayor and Council having duly considered all matters arising on said hearing and being fully advised in the premises, NOW. THEREF ORE, BE IT RESOLVED by the Mayor and Council of the City of Caldwell, Idaho, as follows: Section 1. That'W.'M. Brooks be and he hereby is granted a permit to erect and con - struot an automobile servioe station on the Southeaaterly Seventy ('70 ) Peet of Lots I rI E Twenty - two (22), Twenty -three (23) and Twenty -four (24) of Block Twenty - four (24) of the original Townsite of the City of Caldwell Idaho in the y . , property of said applicant; said struoture to be located with canopy pillar fourteen feet Northeasterly from the property line of said lots on Dearborn Street and fourteen feet Southeasterly from the property line of said lots on Kimball Avenue; said service station to be of the desmrilpbdon and atruoture specified in the application for this permit and for the business of an auto - obile service station including the retrail of gasoline and all and the general business conducted by an automobile servioe station. j After.the reading bf the Resolution, Sandmeyer made a motion that thij Resolution be adopted, aeoonded by Dickens, on Roll Call, those voting in fa3or of the adoption were, Sandmayer, Bales, Keister Johnson, Dickens and Vassar. k'hose voting against, None. Absent and not voting, none. The foregoing Reeolution having been passed by a three - fourths vote of the . Daugherty of Wilder, representing the apanish war Veteran., appeared asked that they be allowed to hold a hree days Carnival on the Streeta of Caldwell, on uat 27, 28.and 29, 1931. The matter was taken under advisement. M. H. IMstace appeared and took up the matter of the eatition presented by Mr. ter H. Hodges, asking for a re- assessment of the property in Local Improvement District Z. And Mr. ISustace further asked that this Council take some definite action•on.the tition. it was decided by the Council that they would take no further action in the tter but will await the final decision of the Attorneys. $ a August 17th. 1931 R. J. Swan and T. J. Allison appeared and discussed at length the opening or 16ta. Street. Moved by Sandmeyer and seconded by Johnston that the matter be referred to the Road Committee, with power to act. Motion Carried. A letter was read from the Secretary of the Pioneer Irrigation District asking that the appropriation from the District be reduced from the 0 10,000.00, the amount made in the Apportionment made by the Council. Moved by Vassar and seconded by Diokeni that we leave the apportionment from the pioneer Irrigation District the same to last year, 10,000.00, and that the Clerk be instructed to so notify the Ssay. of the District. Motion carried. Moved by Johnston and seconded by Vassar that the City Attorney pr`ap©re an Ordinana providing for the depth and contents of graves in the Cemetery. Motion Carried. The City Council met on this date on call of the Mayor, as the regular date, Sept. 7th. came on Labor Day. Mayor Fred L. Lilly presiding. on Roll Call, the following Councilmen answered present: M. S. Sandmeyer, A. G. Keister, 0. E. Bales, E. L. Vassar, Joe Diokena and C. M. Johnston. The Clerk read the Minutes of August 3rd. and 17th, which were approved as read. Prod L.
