A Yes and Nay vote was had thereon with the following result: Yea: Oakes, Boynton, Babcock and Hinds. Nay: None. Absent and not voting; Mumford and Fenrich. Whereupon the Mayor declared the motion direly carried and the preamble and re- solution - duly adopted. A Special Meeting of the Cit7r Council met in the C ^unci.l Room with the Mayor, Holli-gsworth presiding. On Roll C,ll the following Conncilmen answered present; Edgsr.,L F. D. Mir ,ford, W. E, Babcocic, G. Al. Fenrich and Norvil T. Hinds. Absent: W. S. Boynton. Thereupon, Cotncilman»Oakes, introduced Bill No. 7, proposed Ordinance No. 549, as follows: AN ORDTFFAITCE PRCVTDIMr- FOR TAE ASSE"Sr"1 7T AND LEVY OF A TAX FOR GETTFRAL REVEN?TE PTTRPOSES rQR PAYTF!- TAT CURRENT R- PENSES OF THE CITY OF CALDWELL, CANYON COTTDFTY, IDAr FOR THr FISCAL YEAR REGTT7T1NG TAE FIRST DAY OF MAY, 1937. which was read for the first time, and the Coimeil proceeded to a consideration of the proposed Ordinance. It was moved by Babcock, and seconded by Hinds that the rules requiring a pro- posed Ordinance to be read on three separate days be suspended and that the proposed Ordinance be read the second tame by title and tre third t3me in full. The Mayor di- rected the Clerk to call the Roll on the i9otion ss stated, which resulted as follows: Those voting in favor of the motion were: O Aqumforz4,Rabconk, Fenrich and Hinds. Those opposed: None. Absent and not voting: Boynton. The Ma ?or declared the motion carried by the necessary three - fourths majority, and directed the Clerk to read the pro- posed Ordinanca the second time by title and the third ti- in full section b^ section. The Clerk than read the V!roposf dOrdinance as directed. On the question as put by the Mayor, "Shall the proposed Ordinance pass ? the Yaycr directed the Clerk to call the Roll, which resulted as follows;- Those voting in favor of the proposed Ordinance were: Oakes, Mumford, Babcock, Fenrich and Hinds. Those opposed: None, Absent and not vot- ing Boynton. Thereupon, the Mayor declared the proposed Ordinance passed, and in open session of the Counc'l, the Mayor si7ned and approved the said Ordinance, a the Clerk J i S7? i r l r I i I r duly signed and attested the same, which became Ordinance No. 549, The Clerk read a petition from Robert Landauer asking the City to pass a Resoluti cancelling taxes on Lots One, Two, Three and Four of Block One Hundred Twenty -nine, Stra- orn Addition to the City of Caldwell, County of Canyon, State of Idaho, Whereupon Councilman Fenrich presented the following Preamble and Resolution and oved its adoption, which motion visa duly seconded by Councilman Hinds, RESOLUTION. By Fenrich, PUTREAS, Robert Landauer, has presented a petition to the Mayor and Council for the cancellation of the following taxes on Lots One (1), Two (2), Three (3) and Four (4) of Block One Hundred Twenty -nine (129), Strahorn Addition to the City of Caldwell, County of Canyon, State of Idaho, Years Amount 1927 Sprinkling Tax 7,72 1928 '! " 8.30 1929 " 8.30 1930 " " 8.30 1931 " It 8.30 1932 if 6.30 1933 " " 7.45 1934 " " 7;45 1935 " if 7.45 1936 " 'r 7.45 Tote2 - - - 79.02 making a total of 079.02, without penalty or interest. WHEREAS, It Is made to =appear to the R797or and Council that the said petitioner, Robert Landauer, had purchased the property at tax sale from Canyon County, Idaho, for Stat and County Taxes, and that by reason thereof the Local or Special taxes against the said property are no longer a lien thereon under the rule of law that now obtained in the State of Idaho that property purchased of a County for general State and County taxes at tax sale frees the property of all Local or Special taxes and sales, and all special assessments against the property, NOW, THPREFORE, BE IT RESOLVED, That the said sprinkling tax against the said property for the above mentioned years, plus interest and penalties, be, and the same are, hereby cancelled, and the Treasurer of the City of Caldwell, as the collector Of all special improvement and special taxes of the City of Caldwell be, and he is hereby author- ized and directed to cancel upon the books the assessments, plus interest and penalties for each of the above years on the above described property, and to issue in suitable form any certificates or instrument in writing necessary to show that the said assessments and taxes have been cancelled in conformity herewith: and moved the adoption of said preamble and resolution, which motion was seconded by Councilman Rinds. A Yea and Nay vote was had thereon, with the following result; Yea; Oakes, Mumford, Babcock, Fenrich and Hinds. Nay: None. Absent and not voting; Boynton. Whereupon the Mayor declared the motion duly carried and the preamble and re- solution duly adopted. PASSED By the Council this 16th., day of August, 1937. Moved by Hinds, seconded. by Babcock that this application be allowed, Motion tarried, Thereupon Messers Walter Griffith, John Smeed, Earl Brockman and L. W. Botkin, iirectors and officers of the Idaho Meat Producers Association, appeabed before the Mayor and Council relative to the contract for the construction of a City Water Pipe Line to the sight of the building to be constructed for the proposed plant and a contract for the con- struction of said pipe line was presented to the Mayor and Council and after due considerat'. it appearing to the best interest of the Cite of Caldwell that the contract be executed a presented. Now, therefore Co Oakes presented "the following Resolution and moved its adoption thereof which motion was duly seconded by Councilman IMumford RESOLUTTON. By Oakes. BE IT RESOLVED, that the Contract presented for the extension of City Water Pipe Line to the sight of the building to be constructed by the Idaho Meat Producers Asso- ciation as presented to the Mayor and Council be executed and the Mayor and City Clerk of the City of Caldwell be and the7 are hereby authorized to execute said Contract under the seal of the Citr of Caldwell. A Yea end Nay vote was had thereon with the following result: Yea: Oakes, Muuaford, Fenrich, Babcock and Hinds. Nay; None. Absent and not voting: Boynton. Thereupon the Mayor declared the motionoarried and the Resolution duly adopted. There being; no further business to come before the Council it was moved by Fenric seconded Mumford that Council adjourn. Motion carried. Mayor. City Clerk. CoTMOIT, CHAn?BF.RS, sEPTT74BRR 7, 1937. 8:00 P. M. The Reguler Plorn thly Meeting of the City Council met in the Council Room of the City Hall, with the Mayor Pd. R. Hollingsworth, presiding. 111 On the Roll Call the followi.ng Councilmen answered present: Edgar L. Oakes, W. S. Boynton, W. E. Babcock, G. M. Fenrich and Norvil T. Rinds. Absent: F. D. Miunford, Moved by Hinds, seconded by Fenrich that a notice be served on A. F. Nagele to remove the fence on Georgia Avenue between Cherry and Beec h Streets. Motion carried. Mr. Hugh Caldwell, representing Mr. Booth ppe ed before the Council and re- auested that construction be discontinued on the Meat Packers Sewer until the Right of Way has been dettled. Mr' Geo. Crookham, Jr., requested the City to open a road to his new warehouse. This matter was referred to the City Engineer and the Road Committee. The Minutes of August 2nd., and 16th., were read and approved as read. An Affidavit of $,nblication of Ordinance # 649 was read by the Clerk.
