The neeting was called to order by Mayor McCluskey.

The Mayor requested that everyone stand and give the Pledge of
Allegiance to the Flag.
The Roll of the City Council was called with the following
members present: Carter, Marcus, Coviles, Raymond, and Norman.
Absent: Mallea.
(AUDIENCE PARTICIPATION)
The Mayor asked if there was anyone in the audience who cared to
bring anything before the City Council. As there was no one, the
Mayor declared that the Meeting would continue as outlined.
OLD BUSINESS
(HEARING ON THE CORNER BAR)
The Mayor stated that this hearing would be delayed until Noon on
the 21st of August. It will be necessary to have two City
Council Meetings that Tuesday as the City Attorney requested that
the hearing be held at noon that day. There was a public hearing
scheduled for that night so a meeting will have to be held at
that time as well.
NEW BUSINESS
(AMENDMENT TO 1983 -84 STREET DEPARTMENT BUDGET)
The Mayor read the following memorandum received from Donna
Talley of the Finance Department:
Idaho Code 50 -1003 allows a City Council to amend an
appropriation ordinance to a greater amount than adopted.
liowever, this procedure can only be used under the following
circumstances;
1. If the City receives additional revenues as a result of
an increase in State or Federal Grants or allocations.
2. If the City receives an increase in an Enterprise fund
or funds to finance the operation and maintenance of
governmental facilities ana services which are entirely or
predominantly self - supporting by user charges.
Under the lst condition, I would like to submit the attached
amendment to the 1983 -84 budget, This is to be considered
at the Council meeting on 8/14/84 and to be adopted and the
ordinance passed at the Council Meeting on 9/4/84.
Proposed Amendments:
Fund: Street
Amount: $ 320,000
Purpose: Street Construction
Source of Rev: Idaho Block Grant
Total Proposed Increase: $ 320,000.00
MOVED by Carter, SECONDED by Cowles to approve the proposed
amendment as presented and consideration to be given for passage
of the Ordinance following a public hearing.

It was then MOVED by Carter, SECONDED by Cowles to set the Public
Hearing for this proposed amendment for the Regular Citv Council
Meeting on September 4, 1984, at 7 :30 p.m.

(REQUEST FOR TRAILER AT 600 I'THACA - TORNA PONCE)
The mayor called on Mrs. Robison to explain this request.
IKrs. Robison informed the City Council that there was an existing
residence on the property. Mrs. Ponce was caring for a paralyzed
gentleman and her residence was not constructed to accommodate a
wheel chair particularly with the door openings. They were
hoping to place a mobile home on the property adjacent to the
house so a ramp could be built down to it. Changes would be made
to the inside of the mobile home to suit his needs. From the
Building De standpoint Code, to alter the interior of
the structure could weaken the foundation. Mr. Davis wrote a
memo to the Mayor and Council. with regard to his recommendation.
Mrs. Robison further said there was no provisions in the City
Code as far as medical allowances for carrying for people
although the County does have. Pairs. Ponce was asking for a
permit at this time to allow the mobile home and it was Mfrs.
Robison's recommendation that if granted that it be reviewed
every year for renewal of the permit. with Council permission,
they could hook onto the water and sewer already situated on the
property.
The Mayor then read the memo from the Building Official as
follows:
I have a concern with regards to the placement and }proposed
modifications of the mobile home at 600 Ithaca. Mrs. Ponce
has stated that there will. be a need to modify the interior
structure of the mobile home to allow for wheel chair
access. This constitutes a violation of H.U.D., Title 24
CFR 3580 and 3282 which specifically prohibits the
modification of any structural elements within a mobile --
home. This can be very serious because many interior walls
within a mobile home provide resistance to the wracking
forces experienced during transportation. If it is the
Mayor's and Council's desire to grant this special permit,
the following stipulations should be placed upon the
permit;
1. The mobile home be specifically designed for handicapped
use, thus eliminating the need for any modifications.
2. That the mobile home comply with the same critera as is
specified for manufactured housing minus the area
requirement.
There was considerable discussion between the City Council. and
Mrs. Ponce who was present at the meeting to request the permit
Mrs. Ponce informed the Council that they did want the electric
meter on the mobile home for just his power. She explained hoc
the County was going to help them ,Financially.
MOVED by Raymond, SECONDED by Norman that the permit be granted
as requested.
Councilman Raymond further said that he did agree with the
recommendation that the permit be reviewed. Councilman Cowles
also commented that he would hope that Mrs. Ponce would
understand the Building Official's comments as this was his
responsibility. He did state some concern with regard to the
City's liability when the Code has been altered and suggested
that a document be signed by those requesting the permit stating
that the City not be held responsible. Mrs. Ponce agreed to this
request.

Councilman Raymond then amended his :notion with permission of the
second to read as follows: That the permit be granted subject to
a hold harmless agreement and inspection by the Building
Department and the permit be reviewed annually.

(RECOMMENDATION ON FEE FOR FILING APPEALS ON PLA14NING AND ZONING
COMMISSION DECISIONS)
The
Mayor called on Mrs. Robison to discuss this item on the
Agenda.
Mrs. Robison stated that she requested that the Planning and
Zoning Commission recommend that the City Council establish a
permanent fee that would be required on any appeals that were
filed on Planning and zoning Commission decisions. In the past,
she has given the bill. for publications to those filing the
appeal and if there was a large number of letters to go out, she
might also charge the mailing fee. It was Mrs. Robison`s feeling
that a flat fee would be better as many times a lot of extra work
was done besides the publication and :mailings. It was suggested
that the Planning and Zoning Chairman announce this fee at their
regular meetings. it was also suggested that the amount of the
fee be established at $50.00.
This request was discussed at some length by the City Council
members. It was then MOVED by Carter, SECONDED by Cowles that a
$50.00 fee be charged for filing appeals on Planning and Zoning
Commission decisions as presented by firs. Robison.
The Mayor asked for a roll call vote. Those voting yes: Carter,
Cowles, and Norman. Those voting no: Raymond and Marcus.
Absent and not voting: Mallea.

(COMMITTEE REPORTS)
Councilman Cowles reminded the City Council members of the grand
opening of the new Les Schwab Tire Center and mentioned that it
,would be nice if some of them would drop by during the opening.
(MAYOR'S COMMENTS)
The Mayer stated that he had no comments to make at this tine.
(EXECUTIVE SESSION CALLED)
It was MOVED by Carter, SECONDED by Cowles that the City Council
convene into,an Executive Session pursuant to the Idaho State
Code, Section 67 -2343 for the purpose of discussing personnel.
Roll call vote. Those voting yes: Carter, Marcus, Cowles,
Raymond, and Norman. Those voting no: none, Absent and not
votin ,- : Mallea.
MOTION CARRIED
There being no further business, the Regular City Council Meeting
was adjourned at 12:20 p.m. and the Council convened into an
Executive Session for the purpose of discussing personnel which
was adjourned at 1:15 p.m.
