COUPOIL DRAIMRS August 14, 1930 8 :00 o'clock P.M. i Council met in adjourned session pursuant to adjournment on August 4th, 1930, with Mayor MoOonnel presiding, and Councilmen Bollman, Dickens, Gordon, Johns, ,eighty and Sandmeyer, Present. Absent, None. owing to the absence of the City Clerk the Nayor appointed Mr. w. 0. Dyer, acting Clerk, and aimounoed that the Council was in session for the ooneidera- tion of any business which might lawfully come before it. J. H. Forbes presented estimate for Bridge across Indian Creek at Avon Avenue for V . Thereupon Coaxia Bollman presented the following resolution, and r f I F moved its adoptiam; RESOLUTION NO. 42 Hy, B611man A RESOLUTION AUTHORIZING TE MAYOR AND FINANCE COMMITTEE TO BORROW A SUFFICIENT SUN OF no= TO PROVIDE FOR THE NEOESSARY EXPENSE FOR THE REPLACEMENT OF THE BRIDGE A013DSS INDIAN CREEM ON AVEN AVENUE, NOT EXCEEDING THE SIM OF @3000.00,AND AUTHORIZING THE IMYOR AND COUNCIL TO ENTER INTO A CONTRAOT FOR THE REPLACMWT RESTORATION AND REPAIR OF SAID BRIDGE AT A COST NOT TO EXCEED THE SAID OUR OF THREE THOUSAND DOLLARS* v=JMAS, It is provided by section 4056, Idaho Compiled Statutes. that the city Council may order, by two- thirds vote the repair or restoration of any improvement, the necessary for which is caused by any casualty or sociddnt happening after the annual appropriation is made, and wEIREAS, That certain bridge across Indian 0aeek an Avon Avenue, in the City of Caldwell, Idaho, has since the passage of the annual appropriation for 1930, become so deteriorated and unsafe as to require immediate replaoement in order to properly safeguard the lives and safety of the citizens of the City of Caldwell, and the traveling public, and the city council of tha City of Oaldwell`j Idaho, by a two thirds vote thereof, has deemed it necessary that said bridge be repUred, reoonstructed and restored; therefore BE IT RE801VED By the Mayor and Council of the City of Caldwell, Idehc, Section 1. That an emergency has arisen, since the passage Of the last annual appropriation for the year 1930, and now exists, whereby it becomes necessary that the City of Caldwell, Idaho. immediately repair, rsoonatraot and restore that certain '@ridge across Indian Creek on Avon Avenue, in order to protect and safe- guard the lives and safety of the citizens of Caldwell and the traveling public, at a cost of not to exceed Three Thousand Dollars. Section 2. That the Mayor and Finance Committee of the City Council of the City of Caldwell Idaho, are hereby authorized and directed and empowered to borrow a sufficient sum of money to provide for the expense necessary to be incurred in making said repairs, reconetraction and restoration of said bridge, not exceeding the total sum of Three Thonsand Dollars. Section 3. That the Mayor and City Counoil of the City or Caldwell, Idaho, immediately enter into an agreement with. sma individual or company properly equipped to and capable of making such repairs, reoonstraotion and restoration, at a cost not to exoeed the sum of Three Thousand.Dollars. pASSED By the Council this 14th day of August, 1930. gppROMM By the Mayor this 14th day of August, 1930. W. 0 The Motion for the adoption of the resolution was duly seconded by Sandmeyer. The question being '%bull the resolution pass?" The Mayor directed the ®lark to call the roll which resulted as follows: Those voting in the affirmative: Bollman, Dickens, Gordon, Jobne, beighty and Sandmayer, Those voting in the negative, None. Absent and not voting, gone. Whereupon the Mayor declared the motion carried and Resolution No. 4£ adopted and directed the Clerk to record the dame Upon the journal Of the proceedings of the Council a.a a part of the minutes of this meeting, and thereupon the Mayor in open session of the Council Only signed and' Approved said resolution, and the Clerk thereupon sigee`d and attested the same.
