The Regular Monthly Meeting of the City Council met in the Council Room of the 7ity Hall, with the Mayor, Edger L. Oakes, presiding. On Roll Call the following Councilmen answered present; 1 9. E.Babcock, C. 0, McDannel, Oscar Stengel, W.B. Handford, G. M, Fenrich and M. S, Sandmeyer. The Minutes of previous meetings were read andapproved as read. Mr.Cook appeared before the Mayor and Council and requested permission to use cast iron traps in the plumbing of his property. This matter was referred to the City Engineer. Mr. Lyle Riley appeared and-stated that he was unable to get irrigation water on his property. The Mayor assured Mr. Riley that this matter would be tiikenr "ogre cf. Tire following named persons appeared before the Mayor and Council and requested that their property be detached from the City of Caldwell, Idaho; A. H. Rally, to acres, A. J.-Thompson, 5 acres, A. M. H 5 acres, J. H. McLaughlin, 23 acres, G. N2 Marshall, 3 acres and S. 0. Wilson, 5 acres. The City Attorney informed these gentlemen that they would have to f ile a petition with the District Court. Mr. May appeared and requested permission to install a popcorn stand at the Soft Bg11 Field. This matter was referred to the Park Committee and Mr.T. D.Finn. The Mayor appointed the City Engineer, F. H. McConnel, Building I C.D. Rush, Paul Tracy, Journeyman plumber and Harry Coon, Master Plumber as a PLUMBER'S EXAMINING BOARD. Moved by Sandmeyer,seconded by Handford that these appointments be confirmed. Motion carried. The Mayor appointed H.E.rELTON, CHIEF OF PILTCE. Moved by Handford, seconded by McDannel that this appointment be confirmed. f L' Motion c arried. Moved by Babcock, seconded by McDAnnel that the waterworks extension on Elgin and Freeport gprests be approved. Motion carried. A letter was read by the City Clerk, from Chas Laurenson, Secretary of the Chamber of Commerce requesting the City to cancel the Lteense for the Monty young Shows from August 15th., to Aug 17th., this Moved by Handford, seconded by Babcock that /license be cancellddfr'am August 15 to August 17th. Motioncarried. - The Bills for July were read and on motion by Babcock. seconded by Roc innel that these Hills be allowed and Warrants be ordered drawn for the various amounts all of which had been approved by the Chairman of the Finance Committee. " 892 Caldwell Auto Supply " TOTAL TREE SPRAYING FUND �v STREET LIGHTING FUND 893 Idaho Power Co., Street Lights TOTAL STREET LIGHTING CEMETERY SINKING FUND 894 Caldwell goncrete Pipe Co., Supplies TOTAL CEMETERY SINKING FUND GRAND TOTAL OF FOR AUGUST, 1939, 12,252.80 444.02 92.40 78.00 - 78.00- 78.00- 78.00 273,12- 641.00 15.49 1.00- .37- .23 718.61 715.12- 715.12 34.20 34.20 There was presented to the meeting a dorm of contract with Idaho Power Company, providing for a system of incandescent street lighting, for a term of ten years beginning August 1, 1939, This proposed contract was read at length, and other consideration of the same, M.S.Sandmeyer moved the adoption of the following resolution, which was presented' inwriting and read to the meeting; RESOLUTION, By Sandmeyer, BE IT RESOLVED BY THE Mayor and City Council of the City of Caldwell as follows; WHEREAS, There is now before this body for action a form of street lighting con- tract with the Idaho Power Company, which provides for an incondescent street lighting system in this municipality for a term of ten years beginning August 1st„ 1939; and WHEREAS, said proposed contract has received the careful consideration of this body, and it istelieved that it is for the best interests of this muhicipality that such ,contract be executed and entered into; i NOW THEREFORE, the Mayor of this City is hereby authorized and directed, in his official capacity, to execute said contract in duplicate, and the Clerk is authorized and directed to affix the corporate seal of this municipality to each of said duplicates Of said contract and to attest and c ertify the same, and upon full execution thereof, to deliver one of said duplicates to the Idaho Power Company, and to retain the other as a part of the rgcords of his office. This action was seconded by w. B. Handford, and a yea and nay vote on the adoption of such resolution was thereupon taken, with the following result; Yeas; W„E.Babcock, G, M, Fenrich, W.B. Thereupon the following Resolution was presented to the Mayor and Council by Councilman Babcock who moved the adoption thereof, which motion was duly seconded by Counci man Handford, RESOLUTION, By Babcock. A RESOLUTION AUTHORIZING AND DIRECTING THE CLERK OF THE CITY OF CALDWELL, IDAHO, TO ADVERTISE FOR BIDS FOR THE GRAVELING GRADING, SURFACING AND OILING OF THE STREETS IN LOCAL STREET IMPROVEMENT DISTRICT N0. 19, FOR THE CITY OF CALDPELL, IrA-0, IN THE MANNER PROVIDED BY ORDINANCE NO. 560, Be it resolved, by the Mpyor and Council of the City of Caldwell, Idaho Section 1, The Clerk of the City of C Idaho, is hereby ordered and directed to advertise for bids to be received by the Council of the City of Caldwell, Idaho, at the office of the City Clerk in the City =Tall, until the 5th day of September, 1939, .at B o'clock p.m„ for the graveling, grading, surfacing and oiling of the treat in Local Street Improvement District No. 16, in the manner provided for by Ordinance No. 560. -No proposal to be considered unless accompanied by a certified check in favor of the City of Caldwell, for five per cent of the total amvAut bid as evidence of good faith,, to be forfeited if the successful bidder, falls, neglects, or refuses to enter into a contract and provide suitable bond for the faithful performance of the work and protection of the labor and material men in c the contract is a warded to him. The amount of the bond to be a sum equal to the total amount of the successful bid; the right to be reserved to the city to reject any and all blds,or reject a bid in part and accept it in part, or to let the work as a whole or in parts as may appear to the best interest of the City. ?ASSED by the Council this 0th day of August, 1939. On Roll Call the following Councilmen answered present; W.E.Babcock, C. o. Me- Dannel, Oscar Stenger, W.B. Handford, G. M. Fenrich and M.S.Sandmeyer. The vinutes of previous meetings were read and approved as read. Mr. S. L. Dildine appeared before the ,mayor and Council and stated that Floyd Griffith wished to lease the City Camp Ground. The Mayor informed Mr. Dildine that the p ity did hot wish to lease the Camp Grounds. Thereupon the following Resolution was presented to the Mayor and Counci& by Councilman Sandmeyer, who moved the adoption thereof which motion was duly seconded by Councilman Handford. RESOLUTION By Sandmeyer. WHEREAS, The City of Caldwell has purchasd road equipment consistingoof a sprin ler and flusher from the Evans Motor Company of Caldwell, Idaho for the sum of Four Thou- sand Xlne Hundred and Seventyfive Dollars (e4975.00), and one oil distributer from the O1 Manufacturing Company of Boise, Idaho, for the sum of Two Thousand Two Hundred and Twenty Dollars (12220.00), and one Huber roller from the Intermo¢ntain equipment Company of Pots Idaho, for the sum of Thirty -six Hundred Dollars (3600.00), and, '"IIEREAS, It appears to the mayor and Council that it is for the best interest of the City to purchase said equipment partly for cash and partly on deferred payment plat NOW, THEREFOTE, HE IT RESOLVED That the City of Caldwell complete the purchase of said road equipment and that the payment be made as follows; one -half of the purchase price thereof, to be paid in cash upon the delivery of said equipment, the remaining por- tion of the said purchase price thereof, to be paid in c„sh upon the delivery of said equipment, the remaining portion of the said purchase price thereof, to be paid on deferr payment on or about the 5th day of September, 1940, a nd that the " 8ayor and the City Clerk of the City of Caldwell, are and they are hereby authorized and directed to execute a con. ditional sales contract on behalf of said City in the usual form, and BE IT RURTFER RESOLVED, it appearinG to the T!ayor and City Council that there Is sufficient unds in the Cemetery Endowment Fund, which may be used as an investment on such securities as said conditional sales contracts so executed by the City, that the
