The Council met pursuant to call and acknowledgement of notice in the following form:
We, the undersigned Mayor and Members of the City Council of the City of Caldwell, Idaho, do each
hereby acknowledge notice of a Special Meeting of the said City Council, to be held in the Council Chambers
in the City Hall in the City of Caldwell, Idaho, at the hour of 5-00 P. M. on the 26th day of July, 1962, for
the transaction of all business in connection with the following object- Tree spraying for aphis.

Upon roll call, the following Councilmen answered present- E. L. Vassar, Emile Shorb, Max Luby,
V. Jay Martin, and N. E. "Coley" Smith. Absent: Charles E. Krause.
Mayor Simmerman had asked Park Superintendent, Mr. George Hammar, to be present for this meeting
for the purpose of answering questions pertaining to the matter of spraying trees within the City for aphis.
The matter was discussed at length when it was moved by Councilman Luby, seconded by Councilman
horb that, "on the basis of an emer¢ency ", the City spray the trees in the varkings and in alleys for aphis.
A vote was taken and the motion unanimously carried.
It was moved by Councilman Smith, seconded by Councilman Vassar that the meeting adjourn. A vote
as taken and the motion unanimously carried.

The regular monthly meeting of the City Council met in the Council Chambers of the City Hall, with
Mayor Simmerman presiding.
Upon roll call, the follcud ng Councilmen answered present- E. L. Vassar, Emile Shorb, Max Luby,
Charles E. Krause, and V. Jay Martin. Absent: N. E. "Coley" Smith.
Hous= Trailers - Code discussed
Mayor Simmerman referred to the present City Code on "house trailers" parked outside of licensed
trailer courts and more specifically to Section h -5 -6- (E) which reads, "Trailers from which the wheels have
been removed and which are placed on a foundation shall be subject to the building regulations of the City."

He said that at the time the Ordinance was drawn, there were few, if any trailers, being construct
ad that would meet the requirements of the Building Code but apparently the manufacturers are now building
some trailers that will qualify under the general building regulations and that there bad been several
renvests for parking such trailers in Caldwell. He pointed out that there was then no existing control for
placement of such trailers and said that it had been suggested that this Section of the Code be Tmli.fied so
that more control could be had in such cases.
The City Attorney, Dean Miller, stated that the basis of the Trailer 7oning. Ordinance, or any
Zoning Ordinance for that matter, is generally based upon heal.th, safety and morals, and that the basis for
the present Ordinarce was for controlling those that were not connected to the sewar, or didn't have adequate
ronstrictirn for fire and for other safety and health problems. He said that he would look into It but it
was his off hand opinion that such a change In the Code wrnQd be dangerous in that the City would actually be
prohibiting the construction or erecting of trailer honses in a residential zone.
The possibilities of special permits or a petition of residents in the area were discussed se as to
have some control.. Also discussed was the matter of property value and whether or not this could he a
proper function of the City. No further action was taken.
Speeding on Oak Street discussed
Mayor Simmerman informed the Caincil of a number of calls which he had received from residents on
Oak Street immediately back of the Quick Curb, complaining of speeding. He said that the people were not
critical of the Police Dnnartment in any way - the street is patrolled and very often, but that the mimite
the Police leave the area, the kids drive up and down the street ronsidprahly in excess of the speed limit.
Tt had been suggested that the City place humps in the street at designated places with signs aprroaching
them to the effect that there is a bung in the street. Mayor Simmerman stated farther that he had discussed
the matter with the Citv Rneinser who had said that it could be done, however, the City Engineer would want
the Council's approval before doing so.
The problem was discussed at length with it being decided that the matter should be given more
study before making a decision on it.
Report of action in matter of residences on street right -of -way
Mayor Simmerman then referred to a few meetings past when the City Attorney was instructed to
write to a Mrs. Jones advising her that she had constructed two homes on street right -of -way and that she had
thirty days to remove one and ninety days to remove the other. He reported that Mrs. Jones had contracted
with a neighbor to tear one of them doom and that with the assistance of the City Sanitation Officer, the
occupant of this home had been found another place in which to reside - he had been moved to his new
residence. He said, however, that she was quite upset about having received the letter and that he had ex-
plained to her that it was merely sent in an effort: to advise her of what the City felt the situation was and
that if she felt that she had any right in the property, it would give her an opportunity to appeal to the
Courts, etc. He said that she was reconciled to it now but that she was quite disturbed about the fact that
the letter had said that she had to move cut in ninety days; he had told her that this was not the intent of
the letter and that the Council had no idea of dispossessing her of her home in which she had lived for some
thirty -one years, that as far as this adninistration was concerned, he felt that she could live there dust as
long as she lived, in that there was no plan to open this particular street for quite some time.
After some further discussion, the City Attorney was instructed to write to Mrs. Jones informing
her that there was no present need forseen and no intent of the Council to move the house in which she lives
at the present time.
Use of property upon removal of Rodeo Facilities discussed.
Next discussed were the futilre plans for the balance of the City property after construction of the
new Armory and removal of the Rodeo facilities. It was moved by Councilman Shorb, seconded by Councilman
Vassar that the Park Commissioner be instructed to submit a plan for the development of Memorial Park area
into additional park facilities following the removal of the Cavalry Barn. A vote was taken and the motion
was unanimously carried.
Report of action on request of Chamber of Commerce
Mayor Simmerman reported that he had given permission to the Caldwell Night Rodeo Board to keep
contestants saddle horses and producers saddle horses and horses necessary for clowns and speciality acts at

the Caldwell. Night, Rodeo grounds during the week of 1962 show. This was in no way to include working stock
to be used such as bucking horses, calves, steers, and bulls.
Letter from Chamber of Commerce read
The following letter from the Chamber of Commerce was read:

Dear Mr. Simmerman:
On behalf of the Agriculture Committee for the Caldwell Chamber of Commerce, I would like
to request permission to use the Calvary Barn and to erect a tent in the Caldwell Memorial
Park. This to be done in conjunction with the Caldwell Night Rodeo and Junior h -H & FFA
Fair.

It was moved by Councilman Shcrb, seconded by Councilman Luby that permission be granted for the
use of the Calvary Barn and for the erection of a tent in the Caldwell Memorial Park as requested. A vote
was taken and the motion unanimously carried.
Petition for Local Improvement District presented
city Engineer, Mel Lewis, presented a petition for severing the Lester property located at Tenth
and Linden with signatures of 10% of the owners of property for a Local Improvement District to sewer the
entire area. He said that there would be a plat submitted and he could see no reason for not going ahead
with the forming of the District, however, he had informed them that the right -of -ways must be forthcoming
and that the plat must be approved before the work could be done. He stated also, that they had negotiated
a right- of-way across Mrs. Conley's property.
It was moved by Councilman Vassar, seconded by Councilman Shorb that the City Attorney be instruct -
ed to draw up a Resolution of intention to form the Local Improvement District. A vote was taken and the
motion unanimously carried.
Disposal of sludge at the Treatment Ylant discussed
The City Engineer then referred to the matter of getting rid of the sludge at the Treatment Plant
and reported that the Park Superintendent had used it the first year of operation when there wasn't as much
as there is now and subsequently the City had just been giving it away. He said that investigation had

revealed that Nampa gives it away and that Boise gives it to one of their employees who grinds it and sells
it. At the Pendleton plant, they grind it aril then give it away. He explained further that this type of
fertalizer apparently is not a lucrative business and is pretty hard to sell - that the City has been clean-
ing the beds at a considerable expense and piling the sludge out to one side to be given away with the
reservation that it should not be used on a root crop which is to be consumed such as vegetables, etc.
Be then stated that he had had a request from Mr. Tom Carr who would like to have the sludge from
the Treatment Plant but that he wants an exclusive right to it for approximately four to five years in that
he wants to equip himself to get it and he would like to spray around the outside to keep the weeds from
growing so that the weed seeds don't go into the sludge and onto his land, and that if such a request was
granted, he would consider getting equipped to take it in liquid form which would eliminate the drying all-
together. He stated further that the City is equipped to punp it to Mr. Carr or to anyone who has the tank.
Whether the sludge was pumped or taken out of the pits, it would save the City this present expense and work.
The matter was discussed by the Council with consideration for asking for bids given when it was
decided that it be advertised that the City had discussed letting a Contract for the removal of the sludge
from the Treatment Plant and then see whether or not any requests were received.
Agreement with The Mountain States Telephone and Telegraph Company authorized.
The City Engineer then presented an agreement with the Mountain States Telephone and Telegraph
Company for the installing of an outdoor public telephone at the baseball field and at the Idaho Department
Store and he stated that the agreement had been examined by the City Attorney and found to be in order.
It was moved by Councilman Vassar, seconded by Councilman Luby that the Mayor and Clerk be author -
zed to execute the agreement. A vote was taken and the motior_ was unanimously carried.

Northside Park mentioned as a possible Road Side Park
It was mentioned by Councilman Shorb - that a large number of travelers use the Park along the
Highway and he wondered about the possibility of having the State Highway Department designating it as a

Road Side Park. Also discussed was the possibility of having more tables at this Park and at Luby Park.
Idaho Municipal League offices to move to Boise
Mayor Simmerman informed the Council that the Idaho Municipal League had voted to move their offic
from Weiser to Boise and that they had contracted for space in the building owned by the Associated General.
Contractors; that the office would be established there and ready for operation on the first day of October.
He stated also that he thought the Idaho Municipal League was going to take over the operation of the Idaho
Ainicipal Group Insurance.
Councilman Luby excused himself from the meeting at this time.
It was moved by Councilman Vassar, seconded by Councilman Shorb that the bills presented for the
end of July be approved and that warrants be issued in the various amounts for payment of them.
A vote was taken and the motion unanimously carried.

The Council met pursuant to recess and acknowledgement of notice in the following form:
We, the undersigned Mayor and Members of the City Council of the City of Caldwell, Idaho, do each
hereby acknowledge notice of a Recessed Meeting of the said City Council, to be held in the Council Chambers
in the Citv Hall in the City of Caldwell, Idaho, at the hoar of 8:00 P. M. on the 20th day of August, 1962,

Upon roll call, the following Councilmen answered present: E. L. Vassar, Emile Shorb, Max Luby,
Charles E. Krause, V. Jay Martin, and N. E. "Coley" Smith.
Mayor Simmerman called upon Mr. William Ball and Mr. Phillip English who were present for the
meeting.
Dances at I.O.O.F. Hall discussed
Mr. Pall addressed the Council and stated that he didn't know if all of them were familiar with
the conditions which had arrisen with regards to the dances at the Odd Fellows Nall and said that he would
like to give them their side of the picture. He referred to the time when a license of $5.00 Der dance was
imposed by the City and said that some College boys were hired by them, given instructions by Chief Judd and
and at that time were definately informed that their authority did not go beyond the Lodge Hall. He said
that this had worked cut quite well until this summer when there were some complaints that there was to much
drinking going on and under the suggestion of the Chief of Police they had stopped anyone from leaving the
