It was moved by Johns seconded by Bollman that all rules requiring a Bill to be read on three separate days be suspended and that Bill No, 16 be read the second time by title and the third time in fall and placed upon its final paesagee The Mayor directed the Clerk to call the roll on the °!question as stated, Which resulted as follows= Those voting in the Affirmative; Bollman, piokeme, Johns, Leighty and Sandmeyer, Those voting in the Negative, None, Absent and not votiig, The Mayor declared the motion had carried by the neossaaay three- fourthe majority directed the Clerk to read Bill No. 16; the seoond,time by title and the third time in full section by section. The Clerk read the bili as directed, On the question as put by the Mayor, "Shall Bill No. 16 pas®?" the Mayor directed the Clerk to call the roll with the following results. Those voting in tE}e Affirmative; Bollman, Diokene. Johns, Deighty and Sandmeyer, Those voting in the. negatives None. Absent and not voting, Gordon. Thereupon the Mayor deolared Bill No. 16 passed, and in open session of the Council the Mayor duly signed and approved said bill and the Olerk duly attested the same, which thereupon became Ordinance Noe 485._ The Mayor directed the Clerk to make the proper entry of the passage of the Ordinanoe upon the journal of the proceedings of the Council as part of the minutes of this meeting and farther directed the Clerk to cause Ordinance Noe US to ba published in the Caldwell Newm- Tribune, the official newspaper - the City of Caldwell• Beading of the Minutes of July 7th, and July 14th, 1980, Motion by Johns aeeonded by sandmeyer the minutes be approved as read, Motion carried. Notion by Bollman seconded by Dickens, following bills be allowed, except that of 0. D. COUNCIL DLUU3ERS August 14, 1930 8 :00 o'clock P.M. 1 - z Council met in adjourned session pursuant to adjournment on August 4th, 1930, with Mayor DoCOnnel presiding, and Councilmen Bollman, Dickens, Gordon, Johns, Leighty and Sandmayer, Present. Absent, None. Owing to the absence of the City Clerk the Mayor appointed Mr. W. C. Dyer, acting Clerk, and announced that the Uounoil was in session for the considera- tion of any business which might lawfully come before it. J. H. Forbes presented estimate for Bridge &croon Indian Creek at Avers Avenue for Thereupon Councilman Bollman presented the following resolution= and moved its adoption: RESOLUTION NO. 42 By, $&llman A RESOLUTION AUTHORIZ=G THE MAYOR AND FINANCE COMMITTEE TO BORROW A . SUFFIOIENT SUM OF MONEY TO PROVIDE FOR THE NECESSARY BX29NSE FOR THE REPLAOMMT OF THE BRIDGE ACROSS INDIAN CHEEK ON AM AVENUE, 110 SZOEEDING M a= OF 03000e00,AND AUTHORIZING THE MAYOR AND COUNCIL TO ENTER INTO A CONTRACT FOR THE REPLACEMENT P38TOPATION AND REPAIR OF SAID BRIDGE AT A COST NOT TO XXOESD THE SAID SUM OF THREE THOUSAND DOLLARS. WMAIr, It is provided by section 4066, Idaho Compiled Statutes, that the City Council may order, by two - thirds vote the repair or restoration of sny improvement, the necessary for which is caused by any casualty or accid$nt happening after the almel appropriation is made, and WHEREAS, That certain bridge aoross Indian OVeek an Aven Ave=s,.in the City of Caldwell; Idaho, has since the passage of the annual appropriation for 1930, become so deteriorated and unsafe as to require invediate replacement in order to properly safeguard the lives and safety of the citizens of the City of Caldwell', and the traveling public, and the City Council of ther City of Caldwell', Idaho, by a two thirds vote thereof, has deemed it necessary that said bridge be repUred, reconstructed and restored, therefore HE IT RESOLVED By the Mayor and Council of the City of Caldwell Idaho; Section 1. That an emergency has arisen, since the passage of the last annual appropriation for the year 1930, and now exists, whereby it becomes necessary that the City of Caldwell, Idaho, immediately repair, reconstruct and restore that certain bridge across Indian Creek on Avon Avenue, in order to protect and safe- guard the lives and safety of the oitizene of Caldwell and the traveling public, at a coat of not to exoeed Three Thousand Dollars.
