F. aigray, Jr. reviewed the happenings relative to the present situation in that a request was made on the basis of a petition to the Building Inspector whieh was presented to the Zoning Commission for its consideration and recommendation to either leave the area as "AB" Residential or rezone it as "CD" Commercial and the Zoning Board had made its recom- mendation to rezone. This recommendation had been brought by the Building Inspector to the Council at which time the Council voted as to whether they wanted to proceed legally to follow out their recommendation. He said, however, that the legal proceedings to change the zone were not completed when the Board of Adjustment while considering this, directed the Building Inspector to issue the Permit to Mr. Bushnell, which he did, but as far as the authority to issue the permit was concerned, the Board of Adjustment did not have any authority to make such an order nor was the Building Inspector given any authority to issue the Permit. The progress of the construction was reviewed with it appearing that the placing of the sign was almost completed at the present time. After some further discussion, it was moved by Councilman Martin, seconded by Councilman Carpenter that the City proceed with the statutory steps for rezoning the area and that the question of the Permit and any responsibility thereto be resolved at that time. A vote was taken and the motion appeared to have unanimously passed. It was moved by Councilman Davenport, seconded by Councilman Carpenter that the mooting adjourn. A vote was taken and the motion unanimously carried. The meeting adjourned at 5110 P. M. COUNCIL CHAMBERS AUGUST 3, 1964 8100 P. M. The regular monthly meeting of the City Council met in the Council Chambers of the City Hall, with Mayor N. E. "Coley" Smith presiding. Upon Roll Call, the following Councilmen answered presentr E. L. Vassar, Max Why, James W. "Bill' Kays, P. Jay Martin, Charles W. Carpenter, and C. A. Davenport. Absents none. Certificate presented - Glen D. Hollis The first order of business was a presentation by Mayor Smith to Olen D. Hollis on behalf of the Idaho Municipal League and the University of Idaho for the successful completion of a Course of study. NATO Smith presented to Mr. Hollis a Class IV Certificate as a Sewage Works operator and conveyed to Mr. Hollis his congratulations and those of the City Council. Resolution Ho. 16 The matter of rezoning all of Lots 13 thra 24 of Block 621 all of Lots 1 thru 12 of Block 611; and all of Lots 13 thru 211 of Block 65 of Dever's Addition was referred to when Mayor Smith reported for the information of the Council that two of the original signore of the petition to the Building Inspector for re sonS.ng the area had been withdrawn and that they had signed a new petition protesting the change in zoning. Mayor Smith further stated that there were a total of 18J Lots out of the 36 Lots with signatures on a petition requesting that the area not be rezoned. Councilman Vassar then sponsored and moved the passage of the following Resolutions RESOLUTION N0. 16 BY COUNCILMAN YASSAR WHEREAS, a petition by a majority of the property owners residing in the hereinafter described portion of the City of Caldwell have petitioned the Board of Adjustment that the zoning of said area be changed from "AB" Residence Zone to "CD" Commercial Zone and said petition having been approve d by the Boars of Adjustment of the City of Caldwell, and 280 MUMUS, the City Council of the City of Caldwell intends to cause to be prepared and introduced for passage by the Council and approval by the Mayor of the City of Caldwell an ordinance altering and changing the boundaries of "AB" Residence Zone of the City of Caldwell, Idaho, by excluding therefrom the following described real property, to -wit: All of Lots 13 thra 24 of Block 62; all of Lots 1 thru 12 of Block 64; and all of Lots 13 thru 24 of Block 65 of Dever's Addition to the City of Caldwell, Idaho, according to the official plat thereof on file and of record in the office of the County Recorder of Canyon County, Idaho, and the inclusion of said real property within the boundaries of the "CD" Commercial Zone of the City of Caldwell. NON, THHWORE, BE IT RESOLVED; That in accordance with the provisions of Section 50-404 of the Idaho Code that a public hearing be held by the City Council of the City of Caldwell, Idaho, in the Council Chambers of the City of Caldwell on the 8th day of September, 1964, at the hour of 8tCO o'clock P, M., giving notice that the City Council is considering the passage of an ordinance changing the hereinbefore described real property from "AB" Residence Zone to "CD" Commercial Zone and the City Clark is hereby ordered and directed to give notice of said public hearing by publication of the notice thereof in the Clews Tribune, a newspaper printed and pub- lished in the City of Caldwell, Idaho, in two issues thereof published on August S. 1964, and August 15, 1964 The motion for passage was seconded by Councilman Keys. A Roll Call vote was called for when the following Councilman voted in the affirmatives Vassar, Luby, and Keys, Negative votes: Martin, Carpenter, and Davenport, Absent and not voting: none. The vote having resulted in a tie with three (3) Councilmen having voted in the affirmative and three (3) Councilmen having voted in the negative, Mayor Smith cast a negative vote and declared that Resolution No. 16 had not wood. Zoning Commission to be requested to consider certain zone changes Councilman Martin referred to a previous action of the Council not to rezone Block 58, Block 61, and Block 66 of Dever'a Addition and stated that, as a result of the circumstances that had developed, he would be in favor of rezoning that area from "AB" Residential Zone to "CD" Commercial Zone. Councilman Keys stated that there had been considerable thought given by the Zoning Board to the area on the North side of the Highway with respect to some changes in zoning and said that he thought there should be some very serious consideration given to this entire area. Councilman Luby expressed his thought that, in the past, the City had regarded it best to keep the area in "AB" Residential Zone and exercise the use of Special Permits for the purpose of keeping a better control over the development of the area. It was suggested and agreed that the Zoning Commission should consider the area and make a recommendation to the Council. Meeting with lenders announced Mayor Smith announced to the Council a meeting in the Council Chambers on August 4th at 2 :00 P.M. with all the lenders in the area for the purpose of determining what their attitude was towards the proximity of the City's Airport for lending money to builders on any type of basis. He said that he hoped they would be able to resolve some of the problems in regards to the Supreme Court Decision in connection with the Municipal Airport and also that the City Attorney would glee them a presentation of the legal statue at that time. Recommendation for increase in members - Zoning Commission and/or Board of Adjustment Mayor Smith then presented a recommendation for a change in the number of members on the Zoning Commission and/or Board of Adjustment. He stated that he thought this was necessary in that it was frequent ly not possible to get a gnorum which forced the Councilman representative to take an active part in masking decisions prior to subsequent consideration and action on certain recommendations which required the final action by the City Council; that he would recommend that the Councilman representative be a non- voting member. This was discussed with Councilman Keys voicing his support for such a change. 281 It was moved by Councilman Keye seconded by Councilman Martin that the City Attorney prepare an Ordinance to amend the City Code to increase the membership to eight on the Zoning Commission with the Councilman representative to be a non - voting member. A vote was taken and the motion appeared to have passed unanimously. Well site locations discussed An announcement was made by Mayor Smith of a conversation with the School Board. He reported that they were not interested in trading for the City property on the North aide in that they thought it was to Small for a regular school site and didn't think it was the proper location for a obildrens' retarded spaoi school; that they were interested in trying to work out something with the City but they would prefer to get a site on Canyon Hill. He also reported that he had discussed with them the possibility of the City doing some black- topping for them or at a discount in exchange for possible well sites at both the Jefferson and Washington Schools. He asked that the Council give some thought to any possible solution of the well site problem in view of some exchange or discount basis at these locations. Application for Bartender Permits Applications for Bartender Permits from Margene Marske and Jules R. King were presented for the consideration of the Council with each application having been approved by the Chief of Police and each being accompanied by a receipt from the City Clark for the required fee. It was moved by Councilman Martin, Seconded by Councilman Davenport that the applications be approved and that Permits be issued. A vote was taken and the motion unanimously carried. Application for Junk Shop License referred to The previous application for a Junk Shop License from K. Michaels was referred to when the City Attorney referred to sub- heading "N" of 6 -7 -2 in the City Code and Mr. Michaels, who was present, was ad- vised that he would need to secure a special permit for operating a business of "storage and the dismantle - ing of vehicles "; that first it would be necessary for him to secure a petition signed by the ow re of seventy -five percent (75 %), both in numbers and in area, of all the property owners within a radius of three hundred (300) feet of any part of the premises of which said wreaking yard was to be established and that the petition would then be presented to the Building Inspector so that a hearing scold be had before the Board_ of Adjustment for a Special Permit. Bill No. 12 - Ordinance No. 1032 Councilman Vassar introduced Bill No. 12 entitled: AN CRDINANCE GIVING NOTICE TO ALL CITIZENS OF AND OWNERS OF PROPERTY IN THE CITY OF CALDWELL, AN APPLICA'T'ION HAS BEEN PRESENTED FOR THE VACATION OF THE SOUTH 5 FEET OF THAT CERTAIN STREET KNOWN AS HILLCREST LANE AS THE s ME AMS AND IS ADJACENT TO TRACT 2 (ALSO DESCRIBED AS BLOCK 2 AND LOT 2) OF HILIGREST SUBDIVISION OF THE NORTH HALF OF THE SOUTHWEST QUARTER (NWI) AND TINS NORTHW$ST QUARTER OF THE SOUTHEAST MARTER (NW ) OF SECTION 23, TOWNSHIP I, NORTH, RANGE 3 WEST OF THE BOISE ffiiIDIAN, IN CANYON COUNTY, IDAHO, AS SHOWN BY THE OFFICIAL PLAT OF SAID SUBDIVISION ON FILE AND OF RECORD IN THE OFFICE OF THE RECORDER -OF CANYON COUNTY; PROVIDING FOR FILING OBJECTIONS THERMO AND FOR FILING CLAIMS FOR DAMAGES SUSTAINED THEREBr; PROVIDING FOR ASCERTAINING SUCH DANAGgS FOR THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL; AND PROVIDINO.FOR THE PUBLICATION OF THIS ORDINANCE. which was read for the first time and the Council proceeded to consideration of Bill No. 12. It was moved b Councilman Vassar, seconded by Councilman Carpenter that the rules requiring the reading of a Bill on three separate days be suspended and that Bill No. 12 be read the second time by title and the third time in full, section by section. The Mayor directed the Clerk to call the roll on the above motion with the following result+ Those voting in the affirmative wares Vassar, Luby, Keys, Martin, Carpenter, and Davenport. Negative votes. none. Absent and not votings none. The Nayor declared the motion had passed by the necessary three - fourths majority and directed the Clerk to read Bill No. 12 the second time by title and the third time in full, section by section. The Clerk read the Bill as directed. It was moved by Councilman Vassar, seconded by Councilman Carpenter that Bill No. 12 pass. The Mayor directed the Clerk to call the roll on the above motion which resulted as follower Those voting in the affirmative were, Vassar, Luby, Kaye, Martin, Carpenter, and Davenport. Negative votesr none. Absent and not votingr none. Thereupon, the Mayor declared Bill No. 12 had passed and the Mayor in open Session of the Council duly signed and approved the Bill and the Clerk duly signed and attested the same which became Ordinance No. 1032. The Mayor directed the Clerk to make proper entry of the same and to cause Ordinance No. 1032 to be published in the News- Tribune, the official newspaper of the City of Caldwell, Idaho. Request for rezoning presented Mr. Barney Ooul, City Building Inspector, presented requests received by the Zoning Commission to the Council for their consideration in regards to rezoning Lot 44 of the Golden Gate Addition and Lot 74 of 282 Devare Addition] also a small triangle of ground in Lot 20 and Lot 21 of the Bass Addition which he stated had been overlooked when some other property in the area had been rezoned. The rezoning of Lot 44 of the Golden Gate Addition and of Lot 74 of the Devers addition from "AB" Residential Zone to "CD+' Commercial Zone had been requested by Mr. Robert Naaarvin who was present for this meeting and the rezoning of the small triangle of property had been suggested by the Building Inspector. After some discussion, it was decided that these properties should be considered by the Zoning Cemmiseien in their recommendations for rezoning certain other properties previously discussed in this meeting. Bills presented for end -July It was moved by Councilman Martin, seconded by Councilmen Vassar that the bills presented for end - July be approved and that warrants be issued in the various amounts for payment of them.
