Boyer, presiding, Council- men Ackley, Dement, Forbes, Rayman and Lilly present, S. Ben Dunlap, Clerk, when the following business was transacted: The minutes of the sessions held during the month of July, 1915 were read. It was voted, upon motion of Ackley, that the same be approved. Councilman Harrington arrived during the reading of the minutes. R Ell A bill was presented from the Liberty Bell Committee in the sum of •j,100.00 donation to Liberty Bell entertainment. It was voted upon motion of Forbes that the bill be allowed and that the Clerk be instructed to draw a warrant on the General Fund in payment of the same. The following bills were read and it was voted upon motion of Hayman that the same be allowed and warrants be ordered draevn on the various funds in payment of the same as follows GENERAL FTRTD S. The July, 1915, reports of the following officers were read: City Engineer, City Librarian, Street Commissioner, Sexton, Police Judge, City Clerk, Superintendent of Water !storks and City Treasurer. It was voted upon motion of Ackley that the reports be approved and ordered placed on file. Bill 170. 4, by the Finance Committee, entitled, "An Ordinance known as appropriation bill, appropriating such sums of money as deemed necessary to defray all necessary expenses and liabilities of the City of Caldwell, Idaho, not otherwise provided for, for the fiscal year beginning on the first Tuesday in May, 19151 was read for the first time. A motion was made by Lilly, seconded Forbes, that the rules be suspended and the reading on three separate days be dispensed with and bill ITo. 4 be read the second time by title and the third time in full and placed on its final passage. The roll being called on the motion the vote raeulteda Ayes - Ackley, Dement, Forbes, Harrington, Hayman, Lilly -6 Nayes and Absent -done. , So the motion prevailed. Bill No. 4 read the second time by title. I Bill No. 4 read the third time in full and placed on its final passage. The question being shall Bill No. 4 pass? So bill No. 4 passed becoming Ordinance No. 259. -4- The petition of 2enjamin Dix et -al, praying that all. of Section 33, be exempt from further taxation by the City of Caldwell other than bond taxes already contracted for, for the reason that the said Section '83 is agriculture land and receives h0 police and fire protection nor any other benefits from the City of Caldwell, was read. It was voted upon motion of Payman, seconded Dement, that the petition-be referred to the City Attorney, with instructions to draft an ordinance granting the reguest, if upon investigation he found that the same could be done legally. 1 In the matter of the Dearborn Street grade, Mr. W. H. Guerin appeared, com- plaining that the grade was unsatisfactory, in that it was too narrow, the street not being graded to the curb line and that proper drainage was not provided. The matter was referred to the street Committee for investigation and report. At this time Councilman ITayman asked to be excused for the evening. The request was granted. Vessrs. !d. C. Iesley, C. Y. Allen and Tames Pore appeared and asked -the Council for an expression as to whether dray Ordinance Fo. 241 operated so as to shut out teamsters from hauling gravel under a contract within the City limits, without first i procuring a license. The matter was referred to the City Attorney. In the matter of the sidewalk adjoining the property of H. M. Steetle, located on Dearborn and 11th Streets, Vr. H. If. Steetle appeared and stated that four years aTo the City Council had compelled him to remove a good board walk from around said property and had constructed at hie exp ^nse a concrete walk, which was nocr entirely worn out. Us thereupon asked the Council to replace the walk without expense to him, stating that the walk had given way because of its faulty construction. Bill No. 5, by Hayman, entitled, "An Ordinance regulating and controling the erection and maintenance of bill-boards in the City of Caldwell, Idaho, and provi$ing a penalty for the violation thereof ", was read for the first time. A motion was made by Ackley, seconded Bement, that the rules be suspended and the reading on three separate days be dispensed with and bill ro. 5 be read the second time by title and the third time in full and placed on its final passage. The roll being called on the motion the vote resulted: Ayes - Ackley, Dement, Forbes, Farrington, Lilly -5. Nayes -Bone. Absent- F?ayman -l. So the motion prevailed. Fill No. 5 read the second time by title. Bill No. 5 read the third time in full and placed on its final passage. On the question shall Bill Yo. 5 pass? The roll being called the vote resulted: Ayes- Ackley, Dement, Forbes, Harrington, hilly -5 7:ayes -None. Absent - Hayman -1. So bill Vo. 5 passed becominh Ordinance No. 260. -5- 0 Q I U1 The Street Committee reported the Nuisance Assessment Roll for the year 1915. It was voted upon motion of Harrington that the said Fuisance Assessment Roll is hereby confirmed, ratified and approved, and the Clerk be instructed to advertise the same and that the Council hereby fixes Tuesday evening, September 7th., 1915, at 6 o'clock to hear and consider objections by any person or persons aggreived by said assessment roll. Harrington stated that an extention of the water works system was needed on Aven Street between Cleveland Boulevard and P.Tain. He stated that ouch an extention would eliminate two dead ends in this portion of the City, thus giving the patrons better water and that it would aid the department in securing more customers. Forbes stated that the Committee appointed to place fire hydrants, recommended that four addition hydrants be put in, one on Blain near Aven, one at Fifth and Denver, one at 18th ar_d Filnore and at the College,.and that it would be necessary to purchase about 1600 feet additional pipe in order to place the hydrants where needed. It was voted upon motion of Ackley that the water committee be authorized to purchase four hydrants and the necessary 1600 feet of pipe to install same. Forbes stated that the 18th Street crossing over the 0. S. L. R. R. track, which was seldom used, was in a dangerous condition and he recommended that the same be closed.• It was stated that the railroad Company would no doubt make application to have the crossing closed. In the matter of a well for Curtis Park, Dement stated that he and Chairman Acklq of the Park Committee were of the opinion that an a.rtesien well should be sunk and he asked the Council to take some action with reference to the same. It was voted motion of Forbes that the park Committee be authorized and empowered to advertise and in their discretion to accept or reject bids for the purpose of sinking an artesian well at Curtis park and also for bids for the necessary casing. Sidewalk resolution TTo. 2, by Forbes, entitled, " A resolution providing for the construction of a sidewalk according to'plan 3 of Ordinance No. 148 as amended by Ordinance No. 189 of the City of Caldwell, Idaho, along in front of certain lots and klocks in said City and providing for the payment of such construction by an assessment levied and assessed against the property fronting and abutting on said sidewalk", eras read. A motion was made by Ackley, seconded Dement, the' the resolution be adopted. The roll being called on the motion the vote resulted. Ayes - Ackley, Dement, Forbes, Harrington, Lilly -5 !!ayes -None. Absent- Hayman -1. So the motion prevailed. In the matter of Local Lateral Sewer District No. 4, fair. J. A. Dement Sr., appeared, complaining of the sewer because of its uselessness and ttnsanatory condition. He stated that something should be done to grant the people in this district relief and that the people of sAid district were of the opinion that the City should put the sewer in condition to be used at no expense to the district. T.?r. Dement also stated that at the time the sewer was being constructed he had entered into a contract with the City to furnish a right of way for the said sewer through his property in consideration of a promise of payment of 90.00 for the said -6- right of way. He stated further that he had presented a bill for this amount but the same had never been paid. He was advised by the City Attorney that the beet way, to re -open the matter was to present another bill to the council for its consideration. The condition of Local Lateral Sewer 7a. 4 was discussed by the Council but no action taken. The bond of Terry and Vc Gee in the sum of P2,000.0a insuring the construction and maintenance of all concrete work to be ordered by the City for a period of one year from June 28th., 1915, was read. A motion was made by Harrington that the bond be accepted: The roll being called on the motion the vote resulted- Ayes-Parent, Harrington -2. 'Hayes- Ackley, Forbes, Lilly -3. Absent- Hayman -1. So the motion failed to pass. The bond of the Caldwell Commercial P.ank in the sum of °.,'25,000.00, as City Depository, dated August 20th., 1915, was read. A motion was made by Ackley, seconded Dement, that the bond be accepted. The roll being called on the motion the vote resulted- Ayes-Ackley, Dement, Forbes, Harrington, Lilly -5. Nayes -hone.
