L.. Vassar, presiding. On Roll Call the following Councilmen answered present: Edged L. Oakes, F.D. I Mumford, G. V. Fenrich and lw.R. Hollingsworth. Absent: 11.S.Boyntcn and G.W. Montgomery This being the date set for hearing protests against the proposed estimate of expenditures of the City of Caldwell for the fiscal year beginning the First day of May 1935 and ending the First day of May 1936. The said estimate and tax levy being in ex- cess of 10 mills for general purposes. The Clerk presented the affidavit of publication of said notice which is in wore and figures as follows: AFFIDAVIT OF PUBLICATION. ST:_TE OF IDAHO ) Ss• County 0f Canyon ) Emile A. Shorb being duly sworn, deposes and says: That he is hhe Fore- man of CALD NM - TRIBUNE, a daily newspaper published at ald -ell, Idaho, within the meainirig of Chapter 154 of the 1933 Session Laws of Idaho; published six consecutive days e week except legal holidays. And thr.t the publisher of said THE CALDWELL NEWS- TRIBUNE, a daily.:newspaper, has all the time since the 5th day of July 1933 and in each issue thereof, at the lead of the editorial column of said newspaper, announced the day of the week to- wit: Saturday, on which lecual notice required by law or by order of any Court of competent ,jurisdiction to be published weekly, will be published; that the said paper is in general circulation in Canyon County, Idaho and has been for a period of seventy -eight weeks pre - ceding.the first publication of this advertisement, a copy of which is attached hereto, and by reference thereto made a part of this affidavit, end was published in the regular 3aturday issue of THP CALDIMLL W US- TRIBUNE for five consecutive weeks beginning izith the Essue of June 29, 1935 and ending with the issue of July 27 1935. The Mayor asked if there mas anyone present that desired to be heard on the matter of the pronosed estimate and tax levy. There was no one to speak either for or against the proposed estimate. There being raverel in mitinr the Mayor called upon them to st,.te their )usines's before nroceeding with the Appropriation Bill. A report was made by Mr. W.S. M2yey, Sanitary Inspector. The Mayor asked the City Clerk if there were any bids on file for the )urchase of pipe, thereupon the City Clerk produced three sealAd bids, and was directed by :he Mayor to open an read the bids. Moved by Oakes, seconded by Fenrich that a Cormaittea, consisting of the City Attorney, City Engineer and the ;7eter Committee be appointed with power to act on these bids. Thereupon a roll call on said motion was Irdered by the Mc»rr mil re- sulted;as follows, to -wit: Ayes: Rdgar L. Oakes, F.D.Mumford, G. M; Fenrich and i'U.R. Hollingsworth. Nays: None. Absent and not voting: 17.S.Boynton and G.17. Ir10ntgomery. Thereupon, the I4ri -or declared said motion adopted. The Committee recommended that the�bid of the Caldwell Plg. & Hiip. Co., be accepted. Moved by Hollinvs,vorth, seconded by Fenrioh that t,e bid of the Caldwell checks Plg. & Hte. Co., be accepted and that the City_Clerk be authorized to return the certified, to the other bidders. Councilman Oakes moved the adoption of the resolution, which motion was seconded y Councilman Hollingsworth. A yea and nay vote was had thereon with the following results. Yea: Oakes, Mollingsworth, Mumford, and Fenrich. Nays: None. Ab;ent and not oting; Boynton and Montgomery. Thereupon the Mayor declared the motion duly carried and the resolution adopted. Thereupon Councilman Oakes introduced Bill No 4, b7'Oakedi entitled: AN ORDINANCE FIXING THE SALARY OF THE CITY ATTORNEY OF THE CITY OF CALDtfELL, IDAHO, AND REPEALING ALL ORDINANCES IN CONFLICT WITH THIS ORDINANCE. which was read for the first time and the Council proceeded to a consideration of Bill No. 4. The Mayor and Council took the matter of the proposed estimate and tax levy under consideration. Thereupon, Councilman Fenrich, introduoed Bill No. 5, by Fenrich, entitled: AN ORDINAITCE TETAED THE ANNUAL APPROPRIiTION BILL, APPROPRIATINR MONEY IN SUCH SUM AND SUMS AS ARE DEE60D NECESSARY TO DEFRAY ALL PROPER EXPLNSES AND LIABILITIES OF THE CITY OF CALD'TELL, IDAHO, NOT OTHER74ISE PROVIDED FOR, FOR THE FISCAL YEAR BEGINNING i MAY 1, 1935, PURSUANT TO THE PR6UISIUNS OF THE SECTION 49 -1102 AND SECTION 49 -1716, IDAHO CODE ANNOTATED FOR 1932. which was read for the first time and the Council proceeded ta a consideration of Bill No.: a. i i 5. Motion carried. i I Mayor C ' p Clerk. COUNCIL CHAMBERS, JULY 31, 1935. 9:00 o'clock A. M. Pursuant to the adjournment of the adjourned meeting of July 30, 1935, the Mayor and City Council met with the Mayor Emery L. Vassar, presiding. On Roll Call the following Co.- ncilman answered present: Eda L. Oakes, F.D. Mumford, 71.S. Boynton, W.R. Hollingsworth, and G. M. Fenrich. Absent: G. W. Montgomery. Thias being the time set for the second reariing of Proposed Ordinance No. 520, Bill No. 3, it was moved by Hollingsworth, seconded by Fenrioh that the rules requiri', the reading of an Ordinance on three separate days be suspended and that Proposed Ordinanc No. 520 be read the second time by title and the third time in full, section by section, and placed on its final passage. The Mayor directed the Clark to call the Roll on the Motion with the following results: Those voting in favor of the motion were: Oakes, Boynton, Hpllingsworth, Mumford and Fenrich. Those opposed : 'None. Absent and not vot- Montgdmer,q' ing. G. W./ The Mayor then declared the motion had carried by the necessary three- £ourthe majority and directed the Clerk to read the Proposed Ordinance the second time by title eni the third time in full, section by section. The Clerk read the Proposed Ordinance as directed. The question then being, " Shall the Proposed Ordinance No. 520 pass ". The Edyot directed the Clerk to call the Roll with the following result. .Those voting in f,,voi were: Oakes, Boynton, Fenrich, Hollingsworth and Mumford. Those opposed: None. Absent and not voting: Montgomery. Thereupon, the Mayor declared that the proposed Ordinance No. 520 had passed, and the Mayor, in open session of the Council duly signed and approved the Ordinance, and the Clerk duly si;:ned and attested the same, which became Ordinance No. 520. The Mayor then directed the Clerk to make proper entry of the same and to eaus Ordinance No. 520 to be printed in the Caldwell News - Tribune, the official newspaper of t h City of Caldwell, .Idaho. This being the time met for the second reading-of Proposed Ordinance No. 522, Bill No.- 4, it was moved by Mumford, seconded by Boynton that the Rules requiring the read ing of an Ordinance on three separate days be suspended and that Proposed Ordinance No. 52 be read the second time by title and the third time in full, section by section, and place on its final passage. The Mayor directed the Clerk to call the Roll on the motion with th following results: Those voting in favor of the motion were; Oakes, Boynton, Fenrich, Hollingsworth and Mumford. Those opposed: None. Absent and not voting: Montgomery. The Mayor then declared the motion had carried by the necessary three - fourths majority and directed the Clerk to read the Proposed Ordinance the second time by title and the third time in full, section by sectign. The Clerk read the Proposed Ordinance as directed. The question then being, "Shall the Proposed Ordinance No. 521 pass ". The Mayor directed the (Clerk to call the Roll with the following result, Those voting in favor were: Oakes, I Boyhton, Mumford, Fenrich and Hollingsworth.' Those opposed: None.
