Applications for Renewal of Pool Hall Licensee was read from George Franklin, I. H.
Waters, W. L. Bradley and P. A. Martin. And on motion made by Dickens and seconded by
Keister the above applications were granted and Licenees reneted.
Moved iiy Vassar and seoonded by Keister that we return the Oertified Checks to
Morrison- 10.ludsen and The Idaho construction Co, furnished by the above companies as
sureties of good faith on bide on oiling Local Improvement Districts No. 12 and tic. 13.
Motion carried.
The City Attorney was asked to write to Walter H. Hodges, Seattle Attorney, telling
him that after due'oonsideration the city council had decided to take no further potion .
on the Petition of the Company representing the Bond Holders o$ Bonds in L. I. D. 00. 2..
Moved by Vassar and seconded by 8andmeyer that we send the Fire chief, Doyla Fender,
to Pocatello for the biliremen's Convention, July 9,10 and 11th. and that the City pay all
his neoesseiy expenses. Motion Carried.
Moved by Dickens and seconded by xeister that this council stand adjourned.

The City Council met in pursuant to a published notice for the purpose of consider-
ing protests to the proposed Financial Budget of the City for the year 1931 and 1932,
with Mayor Fled L. Lilly presiding.
On Roll Cell the following councilmen answered present: M. 8. 8andmeyer, A; G; Keis-
ter, C. E. Bales, Joe Dickens and 0. M. Johnson. Absent E. L. Vassar.
This being the date 'set for hearing protests against the proposed estimate of aspen.
ditares of the 91ty of Caldwell for the fiscal year beginning the First Tuesday in Zky 1931
and ending the First Tuesday in May 1932: The said estimate and tax levy being in.etoess
Of ten mills for general purposes.
The 01erk presented the affidavit of publication of said notice which is in words

County aforesaid, and has been for a period of 78 weeks proceeding fret publication
of Zhis advertisement, a copy of which is attached hereto, and was published in the
regular edition of said The Caldwell News - Tribune five consecutive weeks beginning
with the issue of June •22, 1931 and ending with the issue of July 20,

The Mayor asked if there was anyone present that desired to be heard on the matter
Of the proposed estimate and tax levy. There was no one to speak either for or against th
Proposed estimate. The Mayor end Council took the matter of the proposed estimate and tax
levy under consideration.
Thereupon, Councilman Sandmeyer introduced bill No. 1, by Sandmeyer, entitled:

BEGINNING ON THE FIRST TUESDAY IN MAY, 1931 PURSUANT TO THE PROVISIONS OF SECTION
3940 , IDAHO COMPILED STATUTES, AS AMENDED By CHAPTER 157, LAWS OF 1923 OF THE
STATE OF IDAHO, AND AS AMENDED BY CHAPTER 158, LAWS OF 1927 OF.THE STATE OF IDAHO;
AND SECTION 4053, IDAHO COMPILED STATUTES, AS AMENDED BY CHAPTER 129, LAWS OF 1921
OF TEE STATE OF IDAHO.
WHICH WAS READ FOR THE FIRST TIME AND THE Council proceeded to a consideration of said B13
it was moved by Sandmeyer and seconded by Diokena that all rules requiring a Bill
to be read on three separate days be suspended and that Bill No. 1 be read the second time
by title and the third time in fV11. The Mayor directed the Clerk to call the roll on the
question as stated, which resulted as follows: Those voting in the affirmative were :
§andmeyer, Water, Bales, Dickens amd Johnson. Those voting in the negative none. Absent
and not voting Vassar. The Mayor then declared the notion carried by the necessary three —
fourth majority, and directed the Clerk to read Bill No. 1 the second time.by title and
the third time bn full sootion by section. The Clerk read the bill as directed. On the
question as put by the Mayor, ,° Shall Bill No. 1 pass? °, the mayor directed the Clerk to
call the roll with the.following result. Those voting in the affirmative ware, Samdmeyer,
Meister, Bales, Dickens and Johnson. Those voting in the negative, None. Those absent and
not voting, 88sear. Thereupon, the Mayor declared Bill No. 1 Passed, and in open session
of the Council, the Mayor signed and approved said bill; and the Clerk duly attested the -
Same, which, thereupon, became Ordinance no. 494. The Mayor directed the Clerk to make the
proper •entry of the passage of the Ordinance upon the Journal of the proceedings of the.
Council as part of the minutes of this meeting and further directed the Clerk to cause
Ordinance No. 494 to be published in the Caldwell Newe- Tribune, the official newspaper of
the City o4 Caldwell.
Fred Kobus appeared before the Council and asked that his time be extended for moving
the cabins from the Tourist Park.
.Moved by Sandmeyer and seconded by Dickens that the matter be referred to the Park
Committee, with power to sot. Motion Carried.
N. 0. Lodge appeared bofore Council and asked that the light and light pole in
front - of the Lodge motor Co .building be removed to make room for the drive way for the
new 'service station.
Moved by Dickens and seoonded:.by Johnson that the Mayor appoint a committee to asoer—
tain if there would be any objection from the other property owners in the block. The
said committee was to confer with the City Attorney as to the legality of moving said pole.
Motion carried.
The Mayor appointed Kn ieter, Johnson and Dickens with instructions to investigate
the matter right away and then to•oonfer with the other two Councilmen, Sandmeyer and
Bales.
T. A. Walters appeared and asked that the City divert all excess irrigation water
to the Black Canyon Irrigation District canals and ditches.
The Mayor referred the matter to the Irrigation Committee with.direotions to divert
all water possible.

A RESOLUTION CREATING A ZONING OCURISSION OF SEVEN L RS; PROVIDING FOR THEIR
APPOINTMENT AND PRESCRIBING THEIR DUTIES.

After due and proper consideration, the Mayor and Counoil of the Oity
of Ueldwall, Idaho, have determined that for the purpose of promoting health, safety, more
and general welfare of the said city, the height, number of stories and size of buildings
and other structures, the percentage of lot that may be occupied, the size of yards, court
and other open spaces, the density of population, and the location and use of buildings,
structures and land for trade, industry,residenoe or other purposes, should be regulated
and rest-rioted; and
WHEREAS, The said city should be divided into districts of such number, shape
and area as may be deemed best suited to carry out the above -named purposes; and,
MMREAe, In compliance with the provisions of Chapter 174 of the Idaho Sessions
Laws of 1928 as amended by.Ohapter 14 of the Idaho Sessions Laws of 1997, a commission to
be known as the Zoning Commission shall be appointed to recommend the boundaries of the
various original districts and appropriate regulations to be enforced therein;
NOW, THEREFORE, BE IT RESORVED BY-THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL,
IDAHO:
Section 1. That there is hereby created a commission to be known as the Zoning Com-
mission, composed of seven members, to be appointed by the Mayor and Council of the City
of Caldwell, Idaho, from among the citizens thereof at iarge,.and not more than two members
of the Council of said city shall be members of the said commission.
Section E That the said Zoning Commission shall recommend to the Council of the City
of Caldwell, Idaho, the boundaries of Zoning Districts in said city, and regulations and
restrictions concerning the height, number of stories and size of buildings and other
(structures, the percentage of lot that may be occupied, the size of yards, courts and .
other open spaces, the density of population, and the location and use of buildingd, struot
urea and land for trade, industry, residence and other purposes, within said districts,
beet suited to promote health, safety, morale and general welfare of said oity.
Section S. That all such regulations shall be uniform for each class or kind of
buildings throughui& each district, but the regulations in one district may differ from
those in other districts. Such regulations shall be made in accordance with a comprehensive
plan and design to lessen congestion in the streets, to secure from fire, panic and other
damages; to promote health and the general welfare; to provide adequate light and air, to,:
prevent the over - crowding of land; to avotld undue concentration of population; to facili-
tate the adequate provision of transportation, water, sewerage, schools, Parke and other
public requirements. Such regulations shall be made with reasonable consideration, among
other things, as to the character of the gg district and its peouliat suitability for par -
tioular uses, and with a view to conserve the value of buildings and encouraging the most
-appropriate use of land throughout said city.

hearings thereon before submitting its final report to said Council.

The Mayor then appointed E. L. Vassar, G. F. Bales, Chas. Lanreneen, I. M. McCarthy,
Kra. M. L. .walker, Dr. F. M. Ohle and F. H. Miohneleon. as the above oommittee.
Moved by Johnson and seconded by Dickens that the Council confirm the Mayor!s
appointments.. Motion carried.
Hugh B. Caldwell appeared and asked the Council to permit W. M. Brooks to construct
a service station on sw 70feet of Lots 22, 23 And 24, Block 24, original Townsits. Mx.
Caldwell also. made formal application for permit to construct such service station.
The application for the above permit being outside the fire limits, it was moved
by sandmeyer and seconded by uiokens that the Council met August 17th. 1981, at 8 :00 P.. M.
as the date for hearing any protests to the above petition. Motion Carried.
On motion of Dickens and seconded by Roister, the Council stood adjourned.

The city Council met in regular session with Mayor, Fred L. Lilly, presiding:
On Roll Call. the following Counoilmen answered present: M. S. Samdmeyer, C. E.
Bales, R. L. Vassar, Joe Dickens and 0. M. Johnston. A. G. Reinter was absent when the
Roll was called but came in later and was marked present. _
Mrs. Geo. Bartlett appeared and asked that the Special City taxes of Sprinkling and
heed cutting be cancelled on Lots 13, 14 and 15, Block 102 Goandu Addition. Said taxes
amounting to 0 39.88.
Moved by Vassar end seconded by Dickens that the matter be taken under advisement.
H. F. Wegner, accompanied by his Attorney, Hugh N. Caldwell, appeared and took up
with the Mayor and council the matter of his oontrect of hauling the garbage from the
City.
gey Major appeared and asked that his 2* acres of land in Block 66, Mt. View Addi-
tion on Collage Avenue be vacated as to the platting.
Tom coohrane , with a number of others, appeared and asked'Ihlat if the Council
granted the Petition to open and grade 6th. 6treet was granted that,5th. Street be also
included in the work and that 5th. Street from Denver Street to Freeport be opened and
graded.
The Clerk read the minutes of July 7 and July 27. These Minutes were approved.
A Petition, signed by 27 petitioners, was presented to open Borth 6th, Street
from Albany Street to Plgin street. Said Petition was referred to the Road Committee.
The July bills were ran& and on motion made by Bales and seconded by Johnston these
bills were allowed and warrants were ordered drawn for the various amcante, all of which
had been approved by the Chairmen of the Finance Committee, as follows;
