M., on the 8th day of July, 1966, for the transaction of all business in connection With the following object: Receiving and opening bids for const ion of the Pump House for the 18th Avenue and gain Street Well No. 6. Witness our signatures this 8th day of July, 1966. Upon roll call, the following Councilman answered present: Charles C. Banks, James W. "Bill" Keys, V. Jay Martin, Charles W. Carpenter, and C. A. "Chat° Davenport. Absent: William S. Harrison. 'Opening of Bids Mayor Smith briefly reviewed the purpose of this meeting afterwhicb the following bids were opened Yor the construction of the panp house for the 18th Avenue and Main Street Well No. 6. Engineer's estimate s $5,222.28. B. M. David G. Councilman Harrison entered the meeting at this time and the bids ware reviewed for his information City 'Engineer Mel Lewis explained that the completion date for the construction in accordance with the specifications was August 15, 1966 with a penalty clause of $25.00 per day. He also explained that he hay been informed by two of the bidders that there may be some delay in obtaining the hollow core, steel doors as they were not standard and, in answer to the question, he stated that the penalty clause would not apply in an instance of this kind. i It was moved by Councilman Martin, seconded by Councilman Banks, that the low bid of B. M. Hayes ,be accepted. A vote was taken and the notion carried. Request concerning I.M.L. Convention Councilman Davenport, as General Chairman for the I.M.L. Convention in Caldwell approximately a ye ( from this time, requested that each Councilman be observant at the coming Convention in Coeur d'Alene and bring back any constructive criticisims that could be applied for improving the Convention in Caldwell. It was moved by Councilman Banks, seconded by Councilman Harrison, that the meeting adjourn subject to the recess of the meeting held on July 5, !966. A vote was taken and the motion carried. Witness our signatures this 18th day of July, 1966. f m ayor i Upon Roll Call, the following Councilmen answered present: William S. Harrison, James W. "Bill" Keys, V. Jay Martin and C. A. "Chet° Davenport. Absent: Charles C. Banks and Charles W. Carpenter. _ Request to place tale on sidewalk for sale of merchandise approved - Manson's Trading Post Mayor Smith informed the Council of having received a request from Munson's Trading Post located at 42h Main Street for the placing of a table on the sidawaik to sell merchandise. The table would be placed against their building and they would want to do this two days each week. Mayor Smith pointed out the pre- cedent for this in that it .ras being done by Super - markets in the down town area. It was moved by Councilman Keys, seconded by Councilman Davenport, that the Munson's Trading Post be granted the request with the stipulation that the table not be over 36 inches in width and on the basis that the granting of the request could be rescinded at any time. A vote was taken and the motion carried. Request to vacate alley approved conditionally Mr. Glenn Koch was recognized and he informed the Council that they had been working on a develop- ment for a full Block on South Kimball Avenue between Everett and Fillmore Streets and Seventh Avenue. He said they had met with very good response from nearly all of the property owners; had options on all of the properties excepting one with their problem being that they wanted to have the alley closed in the Block a-a they wanted to know what the Council's position would be on closing the alley if they did not have 100% of the property. A drawing was presented for information to the Council with the set -backs and building location being explained and in discussion, Mr. Koch stated that they could obtain the one piece of property but h hadn't been able to agree on a price; they were still negotiating on it although they were still a long ways i apart. He also stated that they had discussed the plans with the City Engineer and they were aware of the f easements that would be necessary, etc. It was pointed out that the back portion of the proposed building would probably be within about ten feet of the house now located upon the property that Mr. Koch hadn't ob- tained an option for the purchase of although it was also agreed that this could still happen whether or not the alley were closed. Mr. 'fach stated, however, that they were far enough along that they would like to ask for the alley to be closed. After some further discussion; it was moved by Councilman Harrison, seconded by Councilman Keys, that the Council agrees to approve the vacation of the alley in Block 101 of the Original Townsite as request ad by Mr. Koch subject to a forty by thirty -eight foot parcel of ground available to property not acquired and to all utility easements. That said Assessment Moll of Local Improvement District No. 58 of the City of Caldwell, Idaho, be and the same is hereby approved and confirmed. Section 2. That the City Clerk shall immediately certify and file said Assessment Roll with the City Treasurer of the City of Caldwell, for collection of said assessments according to law; and that due notice of time, place and manner of making these payments of assessments contained in said Assessment Roll given by said Treasurer of the City of Caldwell, in the manner provided by the laws of the State of Idaho, and the ordinances of the City of Caldwell. It was moved by Councilman Martin, seconded by Councilman Keys, that said Order confirming and approving the Assessment Roll in Local Lsiprovement District No. 56 be passed. A roll call vote was called for when the following Councilmen voted in the affirmative: Harrison, Keys, Martin, and Davenport. Negat votes: Bone. Absent and not voting,: Banks and Carpenter. Mayor Smith declared that Order No. 2 had pas 82 Letter of appreciation to retiring employees Mayor Smith referred to those employees who had retired from the employment of the City on July 1 1966 after many years of service and he informed the Council of the letter he had written to each as follows: "I want to thank you personally for the many years of faithful service you gave the City of Caldwell as an employee. — I sincerely hope you enjoy many years in retirement and wish you the very beat of luck in the future. The council joins me in expressing to you our gratitude for your honest and faithful service." Those employees who had retired were Ernie Masan, George Hammer, Guy Healy and Sam Hartkopf. In response to the Mayor's letters, replies of thanks had been received from Ernie Mason and George Hemmer. Request from Chief of Police for new Ordinances considered The following request from the Chief of Police for new Ordinances was presented for the considers- Iltion of the Council: It is requested that the following ordinances be passed as soon as possible as there is no state law making it unlawful to Sniff Glue, take 13D compound or runaway from home. It shall be unlawful for any person to inhale, or breath, or drink, or take into his or her Il veins, any compound, liquid, chemical, or any other substance known as glue, adhesive, cement, mucilage, dope, or any other material or substance or combination thereof with the intent to become intoxicated, slated, dazed, paralyzed, irrational, or in any other manner changing, distorting, or disturbing the eyesight, thinking process, balance, or corridnation of such person. For the purpose of this ordinance, any such conditions so induced shall be deemed as an intoxicated condition. - It shall be unlawful for any person under the age of 18 years to be living or found to be living, or remain to be a person in the City of Caldwell whc has runaway from, or out of the control of their parent, guardian or other legal custodian, The above ordinances are needed in order to cite the juvenile offender into probate court. The GLue Sniffing and LSD Compound ordinance could also pertain to any person who wanted to induce any of the above conditions. /S / Charles W. Astleford Chief of Police 1 In discussion of the above request, the City Attorney inquired as to the definition of the word "dope ", and the word "runaway" as it was intended in the proposed Ordinances. He also expressed his opinion in that such laws would be quite difficult, if not impossible, to enforce. The Chief of Police, Charles Astleford, explained his reasons for making the requests and it was agreed that the City Attorney should examine the request and report back to the Council. Appointment of Bud Grant to Zoning Board approved Mayor Smith announced the appointment of Bud Grant to the Zoning Board to fill the unexpired term of A. R. Steunenberg with term expiring December 31, 1968 and he asked for approval of the appointment. It was moved by Councilman Davenport, seconded by Councilman Martin, that the appointment of Bud Grant to the Zoning Board be approved as recommended. A vote was taken and the motion carried. Report on Trailer Homes - Building Department Reference was made to action taken by the Council at a meeting held on July 5, 1966 (Mimites - Pagel 73 and 74) with regards to a letter from Mrs. Harold Shaw and the tabling of the matter pending a report on other trailer houses and locations. The following report from the Building Inspector was read: _ July 13, 1966 To: The Honorable Mayor and City Council From: The Building Department Subject: Trailer homes parked outside of trailer parks and maintained as living quarters inside the city limits of Caldwell The latest available complete record was made in March, 1960 and at that time sixteen (16) l 83 - - - -�� trailers were registered with the Building Department. Cf these original sixteen trailers, only four remain. All of these remaining were at their present location prior to April 7, 1958 and are exempt under Chapter 5, Section 4- 5 -4(f) of Caldwell City Code. Their locations are as follov:s: 1. E. D. Sisty - 413 Harrison - on location 12 to 15 years. 2. W. L. Cummings - 115 Plymouth - old trailer replaced on variance of City Council approximately January, 1960 - used for night watchman. 4 3. Gwendolyn Avery - 509 Belmont - on location since 1948 or 1949. 4. W. J. Duno - 223 Ithaca - on location 13 years. In addition, permits have been issued since to the following: 1. Slacker's Appliance and Furniture - 12 -18 -62 - no time limit specified - used for night watchman. 2. Mrs. Harold Shaw - temporary permit expires on March 14, 1967. 3. Seal Bros. - 2023 Georgia - L -18 -61 - moved out. 4. Rulon Davis - 107 Kearney - 2 -4 -63 - moved out. In addition to the above, the following were found to exist. (Some record may exist on these but to date have not been found, due to inability to determine exact date of occupancy) 1. J. R. Simplot - 1900 Block on Chicago Street - 5 to 8 years - used for caretaker and feed lot operator - changed to larger trailer it April, 1966 - no permit issued on this change. 2. Bob Richardson - Rt. #r2, Caldwell - 4 years, supposed to have been verbally approved by Mayor. 3. Roble Smith, Rt. #2, Caldwell - approximately February 15, 1966 - stored on back of property - used for sleeping and living quarters for elderly lady - no permit found. 4. Victor Romey - 1009 N. Michigan Street - August, 1960 - No record found. This constitutes a total of ten (10) trailers found to exist within the city limits at the present time - six under the provisions of a permit and four with no record available. Respectfully submitted, /S/ Jesse Downs Building Inspector No further action was taken by the Council at this time. Report on convention (Idaho Municipal League) for 1967 - 1968. Mayor Smith announced for the record that although the League Convention for 1967 was to have been held in Caldwell, they had cancelled it out in exchange for the Convention in 1968, due to the housing situation. He added that he understood there were two, sixty unit Motels, in the offing for Caldwell but that they couldn't take the chance for that many people in 1967. Applications for Bartender Permits approved Applications for Bartender Permits from Kathryn Thomas, Philip T. Marshall, Oleta Simeon, Donald L. Bass, Jean McCourry, Joyce A. Krueger, and Christina Garcia were presented for the consideration of the Council. Each application had been approved by the Chief of Police and were accompanied by a receipt from it the Clerk for the required fees. It was moved by Councilman Davenport, seconded by Councilman Martin, that the applications for Bartender Permits be approved as presented and that the Permits be issued. A vote was taken and the motion carried. Bills for Mid -.July It was moved by Councilman Martin, seconded by Councilman Davenport, that the warrants for claims be approved as per list and filed in the City Clerk's office. The meeting adjourned at 8:50 P. M. r k J yor City 1 COUNCIL CNAMBMS AUGUST 1, 1966 8:00 P. M. The regular monthly meeting of the City Council met in the Council Chambers of the City Hall with N. E. "Coley' Smith presiding. Upon roll call, the following Councilmen answered present: Charles C. Banks, William S. Harrison, II _ W. °Bill^ Keys, V. Jay Martin, Charles W. Carpenter, and C, A. "Chet" Davenport. t for permission to haul own trash - Christensen Motor Sales Mayor Smith presented the following request for consideration of the Council: Mayor and City Council City of Caldwell, Idaho July 23, 1966 Dear Sire: We, Christensen Motor sales, at 2514 Cleveland Boulevard, Caldwell, Idaho, would like to haul our own trash to the sanitary land fill near Lake Lowell and to be excused from the City Sanitation program. Our reason for this request is that we do not have an alley in which we can place our trash cane and we have been told that we have to comply to the City program. We have been told that our trash cans are not acceptable to the trash man and that we must place our cans in front of our business for pickup. This would involve moving our trash and cans at least twice during the week to move it into the street for collection or to leave them on Cleveland all of the time and have trash spread all over the block by kids who drive up and down the street to drive in and out of the drive -in's. Too we have spent a lot of money in trying to build our business and to improve the looks of our property and we feel that by placing trash cans in front of our property and we feel that by placing trash cans in front of our business we would be detracting from the looks of our property. We have in years past hauled our own trash and would like to do it again out of consideration for time spent in moving small amounts of trash to the front of the building. We have had City service for our trash about one year and are very desireoua of discontinuing this service of the City's and handeling this service ourselves. Sincerely Christensen Motor Sales 2511L Cleveland Blvd. Caldwell, Idaho by Dell Christensen Councilman Banks offered additional information in regard to the request in stating that Mr. p - istensen had asked him as to what he should do and that he (Mr. Christensen) had said that one of the .ngs he didn't explain in the letter was that when they kept their cans in the back, they had people there load them when the trash man came but that this wasn't acceptable to the trash people and they wanted them ,aide which was an impossibility without putting then out front. He further commented in that they didn't 'I the property back of the building. In discussion, it was agreed that probably the cans wouldn't add any attraction if they had to be cod in front of the business although it would probably be in- advisable to establish a precident by grant- the request. It was then agreed that the City Sanitation Officer, Mr. Minto, investigate the problem and , if a solution couldn't be worked out with the Christensen Motor Sales so that the trash cans could be ated in such a way that they could be emptied by the Contractor and that the Sanitation Officer submit a to the Council at the next meeting.
