The Council met in regular session, pursuant to adjournment with Mayor Saley, absent, President of the Council, W.T.P,imbrough, presiding, Councilmen, Conley, Dutton, and Mumfo d, present, and McConnel and Wheeler, absent. RESOLUTIONS NO. 31 and 32, respectively, were submitted as follows to -wit: E Resolution No. 31 by Dutton " A RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR AND CITY COUNCIL TO ENTER INTO A C NTRACT WITH BUNTING TRACTOR COMPANY, FOR THE PURCHASE OF A TRACTOR, AND WITH RUSSELL GRADER MANUFCATURING COMPANY, FOR THE PURCHASE OF A GRADER AND SCARIFIER, ATA PRICE NOT TO EXC THE SUM OF $4700.00. Whereas, the road equipment belonging to the street department of the City of Caldw 11, Idaho has become so deteriorated and worn as to require immediate " replacement, in order toprop rly aafeguard the property and safety of the citizens of Caldwell, and, WHEREAS, it is necessary to purchase a tractor and heavy grader and scarifier to rep ace such worn out Machinery and equipment, in order to properly maintain and care for the str eta in the City of Caldwell, and, WHEREAS, Bunting Tractor Company of La Grande , Oreg_on, has offered to sell to the a ty one caterpillar thirty trac bar, F.O.B.Caldwell, for 'x3200.00, on tome of $800.00 cash and the balance in one year without interest, and,kas - &Blared WHEREAS, the Sta ward Machinery Company of Salt ake City, Utah, has offered to .ell to said city one Russell sttperepecial grader and scarifier for the gum of $1511.00, F.0.6,0a dwell, with a five per cent discount for cash; and the City Council have authorized the Mayor an Binance Committee to borrow sufficient sum of money to provide for the expense neoessar to purchase new street grading equipment; therefore Be it resolved by the Mayor and Council of the City of Caldwell,Idaho: Section 1. That the Mayor and City Clerk of the City of Caldwell are hereby authoriz d and directed to tinter into a contract with Bunting Tractor Company of La Grande, Oregon, for he purphmse of one caterpillar 30 tractor for the price of $3200.00, F.O.B.Qaldmell, to be pi id for 1n'the sum of 4800.00 on delivery, and the balance on or before Augustl, 1927, withou interest and further to purchase one Russell spperspecial grader and scarifier from the Stannard Machinery Comapny of salt Lake City, Utah for the sum of $6811.00, and to take ai vantage of the five per cent cash discount offered by said company. section P. The Mayor and Clerk of the City of Caldwell, Idaho, are hereby aeS #lied authorized and directed to enter into such contract as may be necessary with said Bunting Tractor Company and with stannard N+achinery Company, to carry out the purchase of said equipment n the terms hereinbefore specified, and to make aettelment with such company for the some in ac ordanoe with the terms herein expressed upon proper demonsteation of ss equipment having been m de to the satisfaction of the street committee of said city. RESOLUTION NO. 32 by Mumford, "A RESOLUTION AUTHROI.'.ING THE MAYOR AND FINANCE COI'aMITTEE TO BORROW A SUFFICIENT SIX OF MONEY TO PROVIDE FOR THE EXPENSE NECESSARY TO PURCHASE NEW STREET GRADING EQUIPMENT FOR THE STR1M DEPARTMENT AND TO REPLACE NECESSARY ROAD EQUIPMENT AND MACHINERY, WHICH HAS BECOME INEFFI IENT AND INADEQUATE, NOT RXCEFDING THE TOTAL SUM OF 4700.00" WHEREAS, it is provided by section 4056, Idaho Compiled o Latutes that the City Couna11 may order, by a two - thirds vote, the repair or restoration of any improvement, the necessity or which is caused by any casualty or accident happening after the annual appropriation is jade; and, WHEREAS, certain of the equipment in use by the street department has become eotx dete iorated as to require immediate replacement, in order to sagely properly safeguard the property a d 1 safety of the ,titizene of Caldwell; and; WHEREAS, the road grading machinery, used for maintenance of the streets and highways within the City of Caldwell has become so worn and depreciated as to be practically use — leas, and it is necessary that such equipment be immediately restored for the purpose of conserving, protecting and maintaining the streets in said city, to the end that the safety and property of the citizens of the City of Caldwell may be assured; &Ai r Therefore be it resolved by the Ilayor and Council of the Cit; of Caldwell, Idahoi Section 1. That an emergency exists wherby it is necessary that the City of C aldwell immediately purchase a tractor and road grader and scarifier, to replace worn out and depleted road equipment now in use in the street department. Section 2. The Mayor and Finance Co;nmittee Of the City of Caldwell are hereby authorized and directed to borrow a sufficient sum of money to provide for the expense necessary to be incurred in purchasing street grading equipment for the restoration of worn outt equipment heretofore in the service of the street department of said city, not exceeding the total sum of Four Thousand Seven Hlndred Dollara($4700.00). A motion was madeby Conley, seconded by Dutton that Resolutions No. 31 and 32 be adopted and approved.The Mayor directed the Clerk to call the roll on the motion wits the following result: AYES: CONLEY, DUTTON, KIXBROU'�H, AND MUMFORD. NAYES: NONE. ABSENT : MOCONNEL AND WHEELER. The Mayor decalred the motion had passed and the resolutions No. 31 and 32 adopted.
