The City Council met on call of the Mayor for the purpose of making arrangements to spray all Elm Trees against the Elm Beetle, with the Mayor, E. L. Vassar, presiding. On Roll Call, the following Councilmen answered present: Edgar L. Oakes, W. S. Boys, ton, Emery Bales. G. M. Fenrioh and W. R. Hollingsworth. Absent, 0. W. Montgomery. Thereupon, Councilman, G. M. &enrich introduced proposed Ordinance No. 509 as folls AN ORDINANCE PROVIDING FOR THE DESTROYING OF PESTS AND DISEASES FOUND UPON PLANTS, TREES, SHRUBS OR VINES WITHIN THE CITY OF CALDWELL, PROVIDING FOR THE ABATEMENT OF THE INFESTED PREMISES AS A PUBLIC NUISANCE, AND PRO* VIDING FOR THE MAKING OF ASSESSMENTS AND COLLECTING OF SPECIAL ASSESSMENTS .: AGAINST THE PROPERTY ABUTTING UPOM ANT STREET OR ALLEY AND AGAINST THE PROPERTY WHERE SUCH NUISANCE HAS--9EEN ABATED AT PUBLIC EXPENSE, AND REPEAL* ING ALL ORDINANCES, OR PARTS OF ORDINANCES, IN CONFLICT WITH THIS ORDINANCE. was read for the first time, and the Council proceeded to a consideration of the proposed Ordinance. It was moved by Bales and seconded by Hollingsworth that the rules requiring a proposed Ordinance to be read on three separate days be suspended and that the proposed Ordinanoe be read the second time by title and the third time in full. The Mayor directed �'- the Clerk to call the Roll on the motion as stated, which resulted as follows. Those voting in favor of the motion were, Oakes, BoAton, Bales, Fenrioh and Hollingsworth. Those oppose e None. Absent and not voting, Montgomery. The Mayor then declared the motion Carried by the neoessary three - fourths majority, and directed the Clerk to read the proposed Ordinance the second time by title and the third time in full section by section. The Clerk then read the proposed Ordinance as directed. On the question am put by the Mayor, " Shall the proposed Ordinance pass? ", the Mayor directed the Clerk to call the Roll, which resulted as follows; Those voting in favor of the proposed.Ordinance were; Oakes, Boynton, Hales, Fenrioh and Hollingsworth. Those opposed, None. Absent and not voting, Montgomery. Thereupon, the Mayor` j. Ideolared the proposed Ordinance passed, and in open session of the Council, the Mayor signed and approved the said Ordinance; and the Clerk duly attested the same, which, there upon, became Ordinance No 509. The Mayor then directed the Clerk to make proper entry of 9 the passage of the Ordinance upon the Journal of the,pzooeedings of the Council ae a part of the minutes of this meeting and further directed the Clerk to cause Ordinance No. 509 to be published in the Caldwell News - Tribune, the official newspaper of the City of Caldwel , The Clerk read Resolution No. 6, By W. S. Boynton , as follows: WHEREAS, It appears to the Mayor and City Council that many of the elm trees upon lots and parking in the City of Caldwell have become badly infested with the elm tree beetle, their worms and larva; and WHEREAS, Upon examination and advise of authorities, the condition is dangerous and is liable to destroy many of the valuable elm trees in the City of Caldwell; and WHEREAS,' Said elm leaf beetle, and their worms and larva, have become a.menace a$dl u are likely to destroy the beauty and symmetry of the City of Ualdwell, and it appearing to the Mayor and.01ty Council of the pity of Caldwell that an,emergency exists, NOW, THEREFORE, BE IT RESOLVED, That the presence of a large number of elm beetle their worms and larva, creates a condition causing an emergency requiring immediate attent4 - NOW, THEREFORE, BE IT RESOLVED, That the said Mayor and City Council of the City I of Caldwell do hereby declare the condition an emergency,requiring immediate action and the Mayor be and he is hereby authorized to direct the Street Commissioner to prooeed at once to exterminate, erhdiohte, destroy, remove or abate the said nuisance without further notice given to any person or persona, hereby authorizing the Street commissioner to go upon any lots or parking where elm trees are growing to destroy and abate the said•.auisanee Moved by Boynton and seconded by Oakes that the above Resolution be adopted. Motion Carried. i July 10, 1 933 Applications for Pool Ha11.Lioenses were read from Ceo. Franklin and Curtis Huston P. A. Martin, I. H. Waters and S. F. Bow, the fee accompaning each application. Moved by Bales and seconded by Hollingsworth that these applications be granted. i Motion Carried. Applications for Licensee to sell 3.2 Beer were read from the following: Ben H. br y, Franklin and Huston, E. G. Bow, B. F. Bow, P. A. Martin, Saratoga Coffee Shop, Sohra=— Johnson Drug Store, I. H. Waters, H. L. Windsor, H. H. Cheesebrough and The Elks Club. Moved by Fenrich and seconded by Bales that all the above applications be granted. Motion Carried.
