Page 123 The Mayor requested that everyone stand for the Pledge of Allegiance to the Flag. The Roll of the City Council was called with the following members present: Raymond, Valdez, Nancolas, Murdoch, and Houchins. Absent: Jarboe. (ADDITIONS TO THE AGENDA) The Mayor asked if there was any additions or deletions to the prepared Agenda. As there was not, the Mayor declared that the meeting would continue as outlined. (AUDIENCE PARTICIPATION) Mayor Dakan recognized Mr. Ivers Wiley, 119 Joliet, who requested permission to address the City Council and the Mayor. Mr. Ivers stated that he was addressing the City Council on a problem in his neighborhood which he had presented to the Council before. He explained that this was with regard to his neighbor next door. On their property, they have stored old automobile tires, old truck tires, lumber, engines, weeds, sheep and etc. The previous administration acknowledged that it was a bad situation, but they did not cure it. A fence of solid wood was installed just across the front of the property. This was supposed to hide everything from the public. Now, two years later, the fence is absolutely terrible. Mr. Ivers continued with the explanation of his concerns in the neighborhood. The Mayor and Councilman Nancolas informed him that they did go look at the property, but did not see any sheep. Mr. Ivers stated that they are often kept in sheds and cannot be seen by someone driving by. In conclusion, Mr. Ivers stated that he would respectively ask the Mayor and City Council to do something about the situation. After more discussion, it was MOVED by Nancolas, SECONDED by Murdoch that Dennis Crooks, the Planning and Zoning Director, be directed to contact the City Attorney and find out what steps could be taken to rectify - this situation and have an answer for the Council by the first meeting in August. MOTION CARRIED CONSENT CALENDAR Mayor Dakan presented the Consent Calendar as follows: 1. Dispense with the reading of the minutes of the June 18, 1990, City Council Meeting and approve them as written; 2. Accept and approve the minutes from the Historic Preservation Commission Meeting of June 7, 1990; the Library Board Meeting of June 7, 1990; and the Caldwell Senior Citizen's Center Commission Meeting of June 18, 1990; 3. Approve Catering Permits for the Sundowner to cater at the Trolley Square for the Vallivue 1970 Class Reunion on July 7th, Simplot Trucking Banquet on July 12th, Lovan wedding on July 14th and 1960 Class Reunion on July 21st; 4. MOTION CARRIED (SECOND READING OF BILL NO. 25 - CRE'ATING L.I.D. 90--1 - TINNIN SEWER) Mayor Dakan read Bill No. 25 by title only as follows: AN ORDINANCE CREATING LOCAL IMPROVEMENT DISTRICT NO. 90 -1 OF THE CITY OF CALDWELL, IDAHO; DESCRIBING AND SETTING FORTH THE BOUNDARIES OF SAID DISTRICT; PROVIDING FOR THE IMPROVEMENTS TO BE MADE THEREIN; APPOINTING AN ENGINEER; AUTHORIZING THE ADVERTISING FOR BIDS FOR SAID WORK; PROVIDING FOR THE ASSESSMENT OF COSTS AND EXPENSES OF SAID IMPROVEMENTS AGAINST THE PROPERTY WITHIN THE DISTRICT BENEFITED THEREBY AND THE METHOD OF ASSESSMENTS; PROVIDING FOR THE ISSUANCE OF LOCAL IMPROVEMENT DISTRICT BONDS AND WARRANTS; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE OF THIS ORDINANCE. The Mayor declared that this would be considered the second reading of Bill No. 25. NEW BUSINESS (RESOLUTION AUTHORIZING EXECUTION OF FARM LEASE WITH LELAND C. EARNEST AT THE AIRPORT) The memo from the Airport Manager, Jerry Olson, giving a brief background report was as follows: This is a lease back of property purchased from Mr. Earnest for Airport Clear Zones. Mr. Earnest plans to continue farming the property. This Lease was initially negotiated by Mr. Dean VanNoy of Northwest Right of Way Service. The terms are: 1) Time Period: From July 3, 1990, to December 31, 1995 with non transferable option to renew for five years provided City is satisfied with the first tenure. 2) $75.00 per acre for 5.361 acres ($402.00 per year). First year 1/2 ;payment for July - Dec. of $201.00 due on signing of lease. Remainder payments due on December 1st of each year. The recommendation was approval.
