The roll of the Council was called with the following members present: Gamboa, Dakan, Carter, McCluskey, Williams and Banks. Absent: None (APPROVAL OF MUTES, MOVED BY Carter, SECONDED BY Williams, to dispense with the reading of the June 18th minutes and they be accepted as written. MOTION CARRIED (COUNCIL ACTION RESCINDED) Gamboa read a motion that rescinded Council action at the May 20th, 1974 meeting wherein, by a vote of 4 -2, Council decided to stand on the original proposal to the School Board on the property change. SECONDED BY McCluskey, the Mayor called for a show of hands. Members of the Council voting Yes: Gamboa, Dakan, Mecluakey and Banks. No: Carter and Williams. MOTION CARRIED (BILL NO. 21) MOVED BY MoCluakey, SECONDED BY Gamboa to delete the name Carnegie Public Library from the proposed ordinance and insert Caldwell Public Library. MOTION CARRIED Mayor Pasley declared this was the second reading of Bill #21, and Councilman McCluskey read the following by title only: AN ORDINANCE CF THE CITY OF CAIDWELL, A MUNICIPAL CORPORATION OF IDAHO, DECLARING THE INTEND TO EXCHANGE THE FOLLOWING DESCRIBED REAL PROPERTY TO SCHOOL DISTRICT NO. 132, CAIDWELL, CANYON COUNTY IDAHO, SAID PROPERTY BEING OWNED BY THE CITY: CAIDWELL PUBLIC LIBRARY SITE Lots 19, 20, 21, 22, 23 and 24 of Block 24 of Dorman's Addition to Caldwell, Idaho. PROVIDING THAT THE CONSIDERATION RECEIVED BY THE CITY OF CALUWELL IS ADEQUATE; PROVIDING THAT SAID EXCHANGE IS IN THE BEST INTERESTS OF THE CITY OF CALDWEL4 PROVIDING THAT A PUBLIC Book 15 Page 83 BEARING SHALL BE HELD ON SAID PROPOSED EXCHANGE; PROVIDING THAT NO EXCHANGE SHALL OCCUR UNTIL AT FAST SIXTY (60) DAYS HAVE EXPIRED FROM DATE OF PASSAGE AND APPROVAL OF THIS ORDINANCE, PROVIDING THAT SAID EXCHANGE SHALL BE SUBJECT TO CERTAIN TERM AND CONDITIONS; PROVIDING NOTICE OF PUBLIC HEARING SHALL BE PUBLISHED; PROVIDING FOR THIS ORDINANCE TO TAKE EFFECT AFTER ITS PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW. Councilman Carter asked the City attorney to clarify an Ordinance and Tunnicliff stated that the procedure was to pass an ordinance of intent and then after 60 days a public hearing would be held where opinions would be expressed. (VARIANCE - ARTHUR T. HONEY) Councilman Carter advised he had had a call from Arthur Honey relative to the Variance request presented to the Council at the last meeting and Honey stated that he had sold his rabbits and would be getting rid of the hutches and wanted to withdraw his request for a variance. This was agreeable with those present. (HOLIDAY) . Mayor Pasley announced publicly that the City and City Hall offices would be closed Friday, July 5th. (RESIGNATION) Mayor Feeley read a letter from Police Chief Astleford relative to Captain Siegmann's resignation and then read letter of resignation from Captain Siegmann. MOVED BY Dakan, SECONDED BY Banks, that the resignation be accepted and a letter of commendation sent to Captain Siegmann. MOTION CARRIED Mayor Paslay stated that Captain Siegmann and Pete Wykert would be honored at a dinner Thursday, July 11th. (CLAIMS - DENIED) The Mayor presented the following claims: J. H. Martin, $25.00, Damage to 3 speed bicycle by vandalism while parked in rack at swim pool. Darwin L. Owens ) Undeterminate amounts for Mrs. Merle Talkington) swimming pool mishap when Alan Threlfall ) chlorine gas escaped. Charles M. Gissen ) M VSD BY Banks, SECONDED BY Carter, to deny the claims and refer then to the City's insurance carrier. MOTION CARRIED The Mayor stated that the swimming pool mishap was a human error and the City was at fault. (BEAUTIFICATION COMNITTEE RECOMMMATIONS) The Mayor advised he had put a sheet of paper into the mail box of each councilman and councilwoman for their list of recommendations for appointments to the Beautification Committee and if they could get them back before next Council meeting, a list would be submitted for their approval. (WAREHOUSE STREET EXTENSION) MOVED BY McCloskey, SECONDED BY Gamboa, to close the extension of Warehouse Street from Paynter Avenue to lst Avenue to coincide with the ordinance passed at the last meeting. MOTION CARRIED l (LAND APPRAISALS) MOVED BY Banks, SECONDED BY McCluskey, that the City Engineer be authorised to appraise pieces of land involved in the trade between the City and owners of Lot 1, Block 12 in the Strahorn Addition. MOTION CARRIED Book 15 Page 84 (WATER DEPARTMENT PAMNTS) Mayor Pasley stated that since the Water Department had gone to cycle billing, there has been nothing but confusion, so he had investigated Moscow's method of handling water department billings. Moscow is comparable in size to Caldwell and provides a service that most other cities do not provide. Permission is received from the water user to send their bills directly to the bank where they have given authorization to have the bill deducted from their checking account. It is processed by the bank and included with their bank statement at the end of the month. The City is given immediate credit. ' Bills are sent to the bank on the let (this would eliminate the $520.00 it costs Caldwell each month to send out individual water bills); they become delinquent on the 8th; if not paid, a 5 0 # service charge is added, on the 12th a past due notice is sent out; on the 16th, if not paid, an additional $1.50 is added, making a total service charge of $2.00; on the 18th the water is turned off. It would be the responsibility of those who did not wish this service, or who do not have a checking account, to find out from the City the amount of their water bill. After acme discussion, it was MOVED BY Carter, SECONDED BY Dakan, that the Mayor should investigate this further, analyze it in order to protect the property owner on rentals and discuss the plan with the banks. NOTION CARRIED (NEW BEER. LICENSE - LARKIN) It was MOVED BY Carter, S - BY Banks, that the new beer license for Larkin's Pool Palace, 713 Main Street, be approved. MOTION CARRIED (PRESENTATION CF EASEMENTS) Mr. Lewis presented the following Basements and recommended I their approval. Eleanor Gibbous, now known as Eleanor Lytle, regarding the title to one easement for the Junior High School. It was MOVED BY Oamboa, SECONDED BY Banks, that this easement be approved. MOTION CARRIED Ronald Van Auker, for RDA sewer. MOVED BY Banks, SECONDED BY Carter, that this easement be approved. MOTION CARRIED One easement from Idaho Neat Packers for EDA sewer extension along South and East side of 21st Avenue and one water line easement for small portion that was not obtained in original negotiation. MOVED BY Gamboa, SECONDED BY Carter, that these be approved. NOTION CARRIED (STREET DEPARTMENT TRUCK BID) Mayor Pasley advised that Burns Chevrolet would not honor a bid awarded them last November on a 2 Ton truck for the Street Department in the amount of $6,569.00, as the factory had cancelled all the 1974 trucks they had an order. Carter stated he felt when a bid is submitted it should be honored. Gamboa questioned bonds and the Mayor answered that bonds are not I required on local business men. City Attorney Tunnicliff stated the City could award the bid to the second bidder - who would probably not want it - or rebid it under similar specifications and hold the bidder who did not comply liable for the difference.
