C' i 7 The regular monthly meeting of the City Council met in the Council Chambers of the City Hall, with Mayor Simm"erman presiding. Upon roll call the following Councilmen answered present: E. L. Vassar, Emile Shorb, Max Lpby, Charles E. Krause, V. Jay Martin, and N. E. "Coley"Smith. Mr. Leo Jefries - Recreation Center Mayor Simmerman called upon Mr. Leo Jefries, a senior at the Caldwell High School, and stated that he wished to address the Council in the interest of the Recreation Center which was being planned. Mr. Jefries presented to the Council a sketch of the tentative plans for the new Caldwell Recreatior Center which was now proposed to be located adjacent to Luby Park at the location of the present Jesse Drive - Inn. The property consisted of two City Blocks as explained to the Council and Mr. Jefries stated that the McOarvine had talked with an official of the City to determine whether or not it was thought that approval would be given for the location as a Recreation Center. Mr. Jefries explained further that the Center would be designed for the use of the entire family and answered any questions. He said that he would like to encourage the members of the Council and the general public to support the Center now and after its completior The contract for the property had been signed on this date. John Tuttle, Resident Manager of the Grolier Society, Inc. Mayor Simmerman then called upon Mr. John Tuttle, the Resident Manager for the State of Idaho for the Grolier Society, Inc. He said that they were listed today as the largest publishers of educational materials in the United States; that in addition to the encyclopedia, they print a large portion of the school books which are used throughout the country. He then stated that since they always get the approval of the Community before they move in and start to work, they now find that they are stalemated in that they final that the City has an Ordinance which requires a $10.00 per day license fee and that, needless to say, this was a little bit prohibitive and that they were looking for a special dispensation for the simple reason that they were not in competition with any merchant in the Community and that they were offering a service for which the public recognizes a need. He said that they do not work from door -to -door but work primarily from leads which are write -in inquiries from the families they contact and the balance of the contacts are made from unsolicited reports of people who have the program and are satisfied with it and feel that they have friends who might be interested in it. Mayor Simmerman then explained to Mr. Tuttle that he had prepared for presentation to the Council, some proposed revisions to the City Code and that these would be presented later in the meeting. Applications for Pool and Card Licenses An application was read from the Waldorf Cigar Store for a Pool License, accompanied by a receipt for the fee of $15.00. It was moved by Councilman Shorb, seconded by Councilman Luby that the application be approved and a license issued as requested. A vote was taken and the motion was unanimously carried. An application was read from Arthur E. Bock for a Card License at 107 So. 7th, accompanied by a receipt for $15.00. It was moved by Councilman Smith, seconded by Councilman Krause that the application be approved and a license issued as requested. A vote was taken and the motion was unanimously carried. An application was read from Royns Sport Shop for a Card and Pool License, accompanied by a receipt for the fee of $30.00. It was moved by Councilman Luby, seconded by Councilman Smith that the application be approved and a license be issued as requested. A vote was taken and the motion was unanimously carried. Application for Beer and Liquor License An application from C. H. Anderson for a Beer License at the Holiday Motel located at 5th Street and Highway 20 was read. The application was aeeomnanied by a receipt for $50.00. Also, an application from C. B. Anderson for a Liquor License at the Holiday Motel at this same address was read. The application was accompanied by a receipt for $375.00. The two applications were then referred to the City Attorney for examination. Police Chief Charles ,leford addressed the Council and reported that Mr. Anderson had not presented the applications to him and investigation had been made by his office. Councilman Martin moved that the applications be referred to the Chief of Police for investigation. ire was no second to the motion. It was suggested that any action be deferred at this time in order that the City Attorney could -ther examine the applications, and the City Code with relation to the City Park and the location of the iperty for which the licenses were being applied for, ter from Alvin K. Bates The following letter was read at this time: 18h 4th Street Idaho Falls, Idaho June 22, 1962 Ed Simmerman, Mayor City Council, City of Caldwell City Hall Caldwell, Idaho Gentlemen: May I express to you my sincere appreciation for the very fine letter received by me some weeks ago in acceptance of my resignation as Councilman, Third Ward. Also, I would like to express very belated thanks for the fine gift presented to me and my wife prior to our leaving Caldwell. You may rest assured that my period of residence in Caldwell, and particularly that spent on the City Council, will be one of my very finest memories. My family and I have met many fine people here in Idaho Falls, and we are all ad- justing to the move quite well. However, Caldwell will be our "hometown" always, and we shall follow the progress of the city with great interest, wherever we may be. Thank you again for your extension of good wishes. Bates n of Fred Alexander The following letter of resignation was reads June 28, 1962 To: The Honorable Mayor and City Council of Caldwell, Idaho Fromt Patrolman Fred Alexander Subject: R Gentlemen: This is to advise you of my wish to terminate my employment with the City of Caldwell, Police Department, effective June 30, 1962 to accept a better paying position at the La Grande Police Department, La Grande, Oregon. I have enjoyed my employment with the police department and would like to thank each one for the help and kind consideration they have given me. /S/ FA-mg Fred Alexander It was moved by Councilman Shorb, seconded by Councilman Luby that the resignation of Patrolman red Alexander be accepted. A vote was taken and the motion was unanimously carried. ppointment of John Casey and Earl Davis The following letter was read from the Chief of Police: July 2, 1962 To: The Honorable Mayor and City Council of Caldwell, Idaho From: The Cffice of the Chief of Police r Subject: Appointment Gentlemen: Your approval is requested for the appointment of John Casey and Earl Davis to the position of Patrolman. John Casey's appointment to be effective June 12, 1962 and Earl Davis's appointment to be effective July 1, 1962. Vacancies do exist due to the resignation of Harry P7into and Fred Alexander. The monthly report of the Police Department was read to the Council and it was ordered placed on Letter i etLer from Caldwell Night Rodeo The following letter was read: June 28, 1962 Honorable Ed Simmerman Mayor of Caldwell Caldwell, Idaho Dear Sir: It has come to my attention that the City's new Ordinance requires a license for the Carnival to be held in Caldwell, therefore I would like to request permission for the Monte Young Shows to appear in conjunction with the Caldwell Night Rodeo and 4 -H Fair to be held August 7 -11th. The Carnival undoubtedly will start setting up on either the 4th or 5th of August and commence tearing down on the 12th of August. The Monte Young 'haws have been appearing in Caldwell for a good number of years and we find them to be of outstanding nature, having had very little trouble with them through- out the entire time they have been here. Purcell I^ Manager Caldwell Night Rodeo Mayor Simmerman stated that he thought consideration should also be given to granting permission for he ticket booth dawn town and for the parade. It was moved by Councilman Vassar, seconded by Councilman Shorb that permission be granted for the onte Young Shows as well as for the placement of the ticket booth down town and for the parade which is held n conjunction with the Rodeo. A vote was taken and the motion was unanimously carried. rank Meek addressed the Council Mayor Simmerman then called upon Mr. Frank Meek. Mr. Meek stated that there were two things which he wished to bring before the Council; the first eing the cement thing which the City had placed at the intersection of South Kimball and Fillmore some years go. He said that it hadn't caused any wrecks as yet but that it was a miracle that it hadn't. He said that he next thing that he was concerned about was what the Council is ever going to do about telling people to pray their Walnut Trees or destroy the Walnut Trees for aphis. He said that there were conservatively 500 or CO Walnut Trees in Caldwell and that every one of them were impregnated with aphis; that he had sprayed his ast year and that he was going to have to spray again this week; that one spraying would stop it and he ought that two sprayings would eradicate it completely. He said that the Council could make people take the t as a nuisance or make them spray. He said that if the Council wasn't going to do something about it, he ould take his out. Mayor Simmerman informed Mr. Meek that he and the City Engineer would discuss the matter with the ark Superintendent on the following day. Mr. Bill Gigray - Marvin Ruse application for permit Mayor Simmerman called upon Mr. Bill Gigray who stated that he was present in behalf of Mr. Marvin Ruse and that as near as he could tell from reading the City Ordinances, he was entitled to a building permit that it would seem to him that it would be a use of premises and that after his garage was built, he didn't comply with the zoning, then the Council would have someneason to refuse but that this was his observation of it that they were asking that the Council grant the permit as he believed all of his applications were in order. The Board of Adjustment heard it and turned it dam and that the Council upheld the Board of Adjust- ment; that in his opinion, if a person is in compliance of the Ordinances, just because someone else isn't doing something properly or just because the Council doesn't particularly like what the man proposes to do, is no reason to refuse and particularly when his neighbors almost signed 100% to the use and have no objects to it. He said that he didn't want Mr. Ruse to have to resort to any sort of legal action to get the City c Caldwell to grant the permit and that he didn't think that was the intent of the law. He said that he was asking the Council for their reconsideration of the matter in view of the Ordinances and the applications. Mayor Sirmerman informed Mr. Gigray of the fact that this sort of thing had created no end of a problem for the City; that a person would start out with one truck, then buys another one and then another one, to the point where he is operating a Commercial endeavor in a Residential Area and he then pointed out that there were about of six of these problems now in existance on Canyon Hill. Mr. Gigray stated that as he looked at it, the Ordinance provided for private garages and that it didn't matter whether it was six care, that was what he was entitled to do and the fact that the Council nigh fear a misuse of property is certainly no reason to decline a building permit where the person is legally en- 31titled to it. After some further discussion by the Mayor and Council, Mayor Sinmierman informed Mr. Gigray that the Building Inspector would review the matter with the City Attorney. Miscellaneous Licenses discussed Proposed Ordinances for miscellaneous licenses omitted from the City Code as well as various 'additions and amendments were discussed by the Council. The Section amending Title IV, Chapter U was dis- cussed with Mr. John Tuttle and he apparently had no objections to the form presented. It was agreed that the licenses discussed should be placed in final, Ordinance Form, and again presented to the Council for adoption. Request for Bingo Game A request by Mr. Leo Jefries on behalf of the High School Juniors and Seniors for a Bingo Game to be held in conjunction with the Fourth of July celebration was discussed. Mr. Jefries stated that the Chamber of Commerce had no objections but that they had referred him to the City Council - this would be a project for raising funds in connection with the Recreation Center. The City Attorney informed the Council that Bingo was not legal under City Ordinances and the matter was referred back to the Chamber of Commerce. Beer and Liquor Licenses - C. B. Anderson The applications for a Beer and Liquor License by Mr. C, B. Anderson was again referred to and in answer to the question, the City Attorney stated that the State Law and City Ordinances only provide against the sale within certain distances of Churches and Schools. It was moved by Councilman Martin that the Licenses be issued subject to the approval of the Chief of Police and that the issuance of the Liquor License be subject to the presentation of the State License. The motion was seconded by Councilman Smith. After some further discussion the aforestated motion and second was withdrawn and for the purpose of allowing time for investigation by the Police Department and a subsequent report by that Department to the Council, Councilman Vassar moved and Councilman Krause seconded that the Beer and Liquor License applications of C. B. Anderson be tabled. A vote was taken and the motion unanimously carried. Claim of Caldwell Memorial Hospital City Attorney, Dean Miller, referred to the claim from the Caldwell Memorial Hospital in an amount of $576.95 for the treatment of a gun shot wound for Dale L. Turner and stated that he frankly did not know what the City liability was on it but that he thought it was properly a liability of Caron County and that he would like to get a determination on it so that provisions could be made properly in the future. After some discussion, it was moved by Councilman Martin, seconded by Councilman Smith that the claim of Caldwell Memorial Hospital in the amount of $576.95 be denied and that the City Attorney be instructed to initiate I — i r^ proceedings to recover the amount by the City to doctors for the care of Dale L. Turner from Canyon County. A vote was taken and the motion was unanimously carried. Councilman Smith appointed as member of County Zoning Board. Mayor Simmerman announced that he would like to appoint a member to the County Zoning Board to replace Lee Finley and named Councilman Smith. It was moved by Councilman Luby, seconded by Councilman Krause that the Council approve the appoint ment of Councilmen Smith as a member of the County Zoning Board to replace Lee Finley. A vote was taken and the motion carried. Increase in Sanitation Contract - new Contract allowed Mayor Simnexman explained a request for an increase in the cost of the Sanitary Landfill which would amount to $788.00 for the balance of the year and at the beginning of the new fiscal year, the contract was to be re- written. After a brief discussion, it was moved by Councilman Shorb, seconded by Councilman Krause that the City allow the increase in fee and also that a new contract be drafted and signed on the Fiscal Year basis. A vote was taken and the motion was unanimously carried. Councilman Shorb further announced that Canyon County had agreed to increase their portion of the Contract by 5 %. Water line - Went Ash City Engineer Lewis, discussed a water line on West Ash where one house is being constructed with i plans for another one to be constructed and he explained that this was in a section of a line where the line ,I i had been provided by Mr. Brock; that he had put the line in at a cost of $580.00 approximately and it was not a City main extension. He further explained that he had done some work towards a plan for re- inbursement in such cases and pointed out that although this property was in the City, the area was determined to not be sufficiently developed for the City to put in six inch main at the time. He also stated that with a plan for re= inbursement, that no re- inbursement should be considered beyond five years; that an average would be about $45,00 per year. With reference to agreements in such matters, the City Attorney stated that it would be his recommendation that the water lines revert to the City in the first instance if it was planned to draw up an ordinance on it. As a public utility, he said that the City is only required to service that which the City i deems to be economically servicable. After some further discussion on requirements for re- inbursement and transfer of ownership, it was felt that .something should be prepared in Ordinance form for consideration at a later meeting. speeding between Kimball and Tenth on Linden ,Councilman Krause presented s request that some of the hot- radding be stopped on Linden between Kimball and Tenth. It was felt that the City should set up its radar in this area for a time. Light on Fine - between Pine and Arlington Also Councilman Krause presented a problem between Pine and Arlington on Pine Street, where a light shines into the Hospital windows making it difficult to close the light cut of the windows and he stated that he wondered whether or not a shade could be placed on the light to prevent this. This matter was referred to City Engineer, Melvin Lewis. RESOLUTION NO. 14 BY: COLTNOILMAN MARTIN WHEREAS, There has been formed the Caldwell Multi - purpose Stadium Incorporated, a non - profit land I WHEREAS, It is their desire to provide a much needed facility wherein many different types of shows and athletic events may be held, and WHEREAS, Such a stadium is to be located in an area that is easily accessible to the people of Caldwell and Treasure Valley, and WHEREAS, The planned location between Blaine and the Railroad, 21st and Georgia appears to be far enough removed from the residential areas as not to be objectionable to the general public, and WHEREAS, Such a facility will serve the needs of the College of Idaho, the Schools, the Rodeo Board, the County 4 -H Fair and other organizations and thereby provide recreation and entertainment for many people !I of varied interests, and �j WHEREAS, Such a facility would be an asset to the City of Caldwell in attracting larger and better spot events; NCW, THEREFORE, BE IT RESOLVED: That the Mayor and Council of the City of Caldwell be on record as apnroving, commending and whole heartedly supporting the Caldwell. Multi- purpose Stadium, Inc. in its effort to provide such a facility for Caldwell and the surrounding area. It was moved by Councilman Martin, seconded by Councilman Vassar that the Resolution be passed. A vote was taken and the motion was unanimously carried. Bad corner at Idaho and Logan reported - also Tenth and Ash Councilman Vassar reported that he had had some complaints on a bad corner at Idaho and Logan on the right hand side going south where shrubbery had grown to whore it was almost impossible to see onto Log Mayor Si,mnerman stated that he would refer the matter to Mr. Deering and see that it was taken care of. He also referred to trees at Tenth and Ash and stated that these had been given to the Golf Course and they would be taken out this fall. Sewer and sewage charge discussed - Jess L. Smith The Clerk referred to a delinquent sewage charge at the residence of Jess L. Smith at 1601 N. Kimball in the amount of $69.60 in connection with the possible sale of the property. This matter was dis- cussed and referred to the City Attorney for collection. The City Engineer also referred to some difficulty with regards to the sewer in this location and it was thought that any new purchaser should be made aware of this. It was moved by Councilman Smith, seconded by Councilman Vassar that the bills presented for the end of June be approved and that warrants be issued in the various amounts for payment of them. A vote was taken and the motion unanimously carried.
