Pursuant to adjournment of the adjourned meeting of June 28th, 1035, the Council met in the Council Rooms, City Hall, with the Mayor, E. L. Vassar presiding. On Roll Call the following Councilman answered present: Edgar L. Oakes, F.D. Mumford, 19.S.Boynton, G. M; Fenrich and W.R. Hollingsworth. Absent: G. W. Montgomery. Moved by Boynton, seconded by Oakes that the Council adjourn to meet July 1, 1935, at 6:30 P. M. Motion carried. Mayor �F17Dl , �' City U Gler COUNCIL CHAMBERS, JULY 1, 1935. 8:30 P. M. The Regular Monthly Meeting of the City Council met in the Council Room of the ty Hall, with the Mayor, Emery L. Vassar, presiding. On Roll Call the following Councilmen answered present: Edgar L. Oakes, B.D. mford, 67.S. Boynton, G. M. Fenrich and W.R. Hollingsworth; Absent: G.9P. Montgomery. The following Resolution was presented by Councilman Hollingsworth: RESOLUTION NO?. By W.R. Hollingsworth. WHEREAS, There is levied and assessed for side walk improvements against the property hereinafter described the amounts set out for the years herein stated; and WHEREAS, The owner of said lots, to -emit : J. Jester Jr., has offered a compromise to the City of Caldwell, Idaho, upon the said assessment, and alleges that the said sidewalk improvement when placed in the project was not properly graded and was not useable during the winter and stormy season; and WHEREAS, said J. Jester, Jr., has offered to pay the City of Cald- well 0100.00 in full settlement of its claim against the property here - inafter described, The entry number, the year for which they were assessed, the property against which the assessment was made and the amount of the assessment is as follows, Entry on Segregation. No. 1020 Z or Sepegatlon.Ho. 9606 on original Mol 1877, for the year 1920, on Lots 9 to 16 inclusive New Home Addition to the City of Caldwell in the original sum of 487.20, and, WHEREAS, action has heretofore been commenced in the District Court of the Seventh Judicial District of the State of Idaho, in and for the County of Canyon, in accordance, wherein the City of Caldwell, Idaho., was plaintiff, and Ervin Goldsmith and J. Jester, Jr., and others, defendants, to foreclose the lien held by the City against the above described pro- perty which was heretofore commenced but has not been completed; and :9ED ,2EAS;.an order has been entered in said fiction directing the proper officers of the City of Caldwell to execute a proper satisfaction discharg- ing the said lien w )xen the lien of said assessments have been fully paid and settled; NOW, THEREFORE, BE IR RESOLVED, that upon the payment by said J. Jester, Jr., of the sum of $100.00 to the Treasurer of the City of Cold - 9 11, which amount the Treasurer of the said City of Caldwell is hereby thori2ed and directed to receive in full satisfaction of said assessments, C ud the Mayor of the City of Caldwell, under seal of the said city and duly ttested by the Clerk of said City of Caldwell, shall make, execute and deliver a satisfaction of the lien of the assessments and deliver the same to the said J. Jester, Jr., and IT IS FURTH R RESOLVED That the City Attorney of the City of Caldwell be, and he 1s hereby, authorized and directed to cause the said action to be dismissed as against the property hereinabove described. Mr, Boynton moved the adoption of the Resolution, which was duly seconded III, � I fl , 1 L by Mr. Oakes, A yea and nay vote was taken thereon with the following results: Yea: Oakes, Mumford, Boynton, Fenrich and Hollingsworth. Nays: None. Absent and non voting: Montgomery. Thereupon the Mayor declared the motion carried and the resolution duly adopted. A report was submitted by the Committee apnointed to investigate the salary ordinances. The matter was held over until the next Council.meeting. The following Resolution / was presented by Councilman Boynton: RESOLUTION N0. By W.B. Boynton. WHEREAS, The legislature of tYie State of Idaho passed an emergency act, which was approved by the Govenor of the State on March, 16, 1935, Chapter 99 of the 1935 Session Laws of Idaho, wherein it is provided that the Supervising Board of MunicipalitLes, Mayor and Council, should pass a resolution at a regular or special s@ssion, specifying the interest on warrants issued by the City, NOW, THEREFORE, in conformity with said Statute, It is hereby,_ and this does resolve, that all warrants h-reafter issued by the City of Caldwell, Idaho, which are presented to the Treasurer of said City for payment and not paid for want of sufficient funds shall yield and bear interest at the rate of six (6) percent per annum_. The Treasurer of said City be, and he is hereby, authorized and directed to endorse on each of said warrants presented for pay- ment and not paid for want of funds, the words, "Not Paid for pant of. Funds." and he shall endorse the date of said presentation, and also endorse apt words specifying that said warrants shall bear interest after presentation at the rate of six (6) percent per annum. Councilman Oakes moved the adoption of said resolution, which was duly seconded by Councilman Boynton. A yea and nay vote was taken thereon with the following results: Yea: Oakes, Mumford, Boynton, Fenrich and Hollingsworth. Nays: None. Absent and non voting : Montgomery. Thereupon the Mayor declared the motion carried and the resolution duly doptsd. The Mayor made the following appointments: SWITZIING POOL: Chairman, J. H. Lowell. Board: Mrs: O.E.Bales, Fred H. McConnel so Crookham, Jr., and Mrs. Earl Wheeler. POLICE: Chief, O.G.BOyd. Patrolman, F.E. Felton. Moved by Oakes, seconded by Montgomery that these appointments be approved. otion parried. A report was made by the Committee on the placing of a light at the corner of leveland arid Linden.; After due consideration the Council decided if the property owners would. stand he cost of installation the City would maintain the light. Applications for Pool Hall Licenses were read from Franklin & Huston, P. A. artin,:I. H.waters, S.P. Dow and Pastime Lunch, the fee accompanying each application. Moved by Hollingsworth, seconded by Boynton that these applications be allowed. lotion carried. Applications for license to sell beer were read from P.A. Martin, F. M. Wilson, S.F. Bow, E.G. Bow, Franklin & Huston and the Pastime Lunch, the fee accompanying.each application. Moved by Fenrich, seconded by Hollirgs}vorth that these applications be allowed. Motion carried. The following Resolution was presented by Councilman Oakes: RESOLUTION NO.? By Edgar L. Oakes. WHEREAS, It is ilgperative that the City of Caldwell purchase some better fire 1 '/ 3 ra fighting equipment and better fire fighting equipment if not purchased by the City will advance our insurance rates very materially, MOW, THEREFORE, :RE IT RESOLVED That the Clerk of the City of Cald- well be, and he is hereby, authorized and directed to call for bids up- on one five hundred gallon buster tank pumper with hose a:hd standard aquipment therewith, upon specifications to be supplied by Doyle Vender, the Fire Chief of the City of Caldwell, Idaho; that the said d all for bids shall be filed with the said City Clerk before the time for opening the said bids shall have arrived, and that same should be opened at 8 u o'clock, P. M., on the 19th day of August , 1935. I Councilman Oakes moved the adoption of the resolution and it was duly seconded by Boynton. A yea end nay vote was taken thereon with the following results: Yea: Oakes, :3oynton, renrieh, Mumford, and Hollingsworth. Nay: None. Absent and Non - voting: Mongtomery. Thereupon the Mayor declared the motion carried and the resolution duly adopts The Bills for June were read and on motion made by Boynton, seconded by Oakes, that these bills be allowed and Warrants be ordered drawn for the various amounts all of which had beE4approved by the Chairman of the Finance Committee.
