Owing to the absence of the City Clerk the,mayor appointed Mr. W. 0. .. Dyer Acting Clerk, and announced that the Council was in session for the considers- tion of any business which might lawfully come before it. Donald Anderson sppoared before the Council in behalf of John Graves in regard to extending,lioense for Pop Corn Stand. .motion by Dickens seconded by Leighty the matter of Pop Corn stand be taken under advisement. motion Carried. Motion by Bollmen seconded by Johns that City Treasurer be instructed to take up the warrants made payable to Gabbey a moNeil for 0 ' on Local Improvement District -y 11, same being paid out of Cemetery Lot Perpetual'Care Fund. By $andmeyer. A RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF CALDYMLL, IDAHO, TO JOTER INTO A DONTRACT VITH H. J. M oNEEL, FOR TU SAin AND PURCHASE OF GRAVEL. ' WREREAS, The City of Caldwell, heretofore entered into a contract with H. J: McNeal, dated June 26, 1930, for the oonstraction of certain improvements in Local street Improvement District No. 9, wherein the said H. J. mol!eel agreed to receive i'hirty Five Hundred yollars (63600.00) of the last maturities of bonds of said district, and WHMMS, The said H. J. McNeal desires to exchange said bonds at per plus accrued interest to the City aE Caldwell, Idsho in lieu of cash in the . psrohaaa of send and gravel from said city for use in said oonstruotion of improvements in said Local street Improvement District No. 9. I r I + r^ I NOW, THERMORE, BE IT RESOLVED By the Mayor and Council of the City of Caldwell, Idaho: Section 1. That the Mayor of the City of Cal{lwell, Idaho, be and he hereby is authorized to enter into a contract for and on behalf of the City of Caldwell, Idaho, with H. J. UoNeel, whereby the said City of Caldwell shall far — nish to the said H. J. McNeal in the bunkers at the City's gravel crushers in tie City of Caldwell, Idaho, sand and gravel to be used by the said H. J. iHoleal in the oonetruction of said improvements in said Local Street Improvement Distriot No. 9= the City of Caldwell to receive one . Dollar ($1.00) per cubic yard for said sand and gravel so farniehed and to accept in payment thereof from the said H. J. MoNeel in lieu of cash the abave mentioned bonds of Local Street Improvement District No. 9,,at per plus accrued interest. Thereupon, motion was made by Sandmeyer, seconded by liaighty that Resolution No. 40 be adopted. The question being A Shall the Resolution paes7" The Mayor caused the Clerk to call the roll with the following results; . Those voting in the affirmative: Sol' -an., Dickens, Gordon, Johns, Leighty and, Bandmayer. Those voting in the negative: None. Absent and not voting: None. Thereupon, the Mayor declared the motion carried and Resolution No. 40 adopted. Whereupon, the Mayor,in open session of the Counoil signed and approved said Resolution. The Mayor and Council instructed the Clerk to notify John Graved to move Pop Corn Stand o[f Streets and Sidewalks sd thin the neat thirty ('30) days.
