COUNCIL CHAMBERS, JUNE 28, 1935.
2:00 P. M.
Pursuant to adjournment of the adjourned meeting of June 27, 1935, the
Mayor and City Council met with the Mayor Emery L.4assar, presiding.
On Roll Call the following Councilmen answered present. Edgar L. Oakes,
F.D. Mumford, W.S. Boynton, G. W. Montgomery, G. M. Fenrich and W.H. Hollingsworth.
Absent: None.
The - Council proceeded to consider the annual appropriation matters.
ESTIKATE OF THE EXPENDITURES OF THE CITY OF CALD17ILL, IDAYO,
FOR THE YEAR 1935 -1936.
The following is an estimate prepared by the Mayor and City Council of the
City of Caldwell, Canyon County, Idaho, for the probable amocint of money necessary for all
purposes to be raised by taxation in the City during the fiscal year beginning the first ,.

EIGHT O'CLOCK P. M, FOR THE PURPOSE OF GRANTING A PUBLIC HEARING, BEFORE THE APPROPRIATION
BILL PROVIDED FOR IN SECTIONS 49 -1716 AND 49 -1102 IDAHO CODES ANND:,TED AND CHAPTERS 17
OF TITLE 49 OF THE IDAHO CODES ANNOTATED, JHALL BE PASSED BY THE MAYOR AND CITY COUNCIL:
A COPY OF VTIICH SAID ESTIM --NE OF THE PRCPOSED APPROPRIATION BILL FULLY SET FORTH AT
LENGTH UPON HE MINUTES OF THE REGULAR M ET1NG OF 'SHE MAYOR .,ND CITY COUNCIL HELD ON JUNE

WHEREAS, at a regular meeting of the City "ouncil of the City of Caldwell, Idaho,
held on the 28th day of June, 1935, an estimate of the probable amount of money necessary

mittee, and which said estimate was entered at length its minutes, and

proper resolution be drawn fixing the time for a public hearing of protests against said
proposed appropriation bill, and giv due notice thereof;

Said Resolution and motion to adopt the same were than duly considered by the
City Council, after which the Mayor ordered the roll call of the Council to be called on
the action to anopt said resolution, said roll cell resulting in the following vote ,
THE CITY OF CALDWELL, IDAFIO:
Section 1. That the mMayor and City louncil of the City of Caldwell, Idaho
have determined that it will require a tax levy for general revenue purposes in excess of
ten mills to raise sufficient money for general purposes, es proveded by ter and as is
more fully'shown by the estimate of expenditures of the City of Caldwell, Canyon County,
Idaho, for the fiscal year beginning the first day of May, 1935.
Section 2. That before the passage of said appropriation bill and before said
levy be made, a public henrinp be granted, and that said public hearing is hereby called
and ordered to be helddat the City Hall of said City at the hour of 8 o'clock, P. M., on
the 30th day df July, 1935, upon said estimate and proposed appropriation bill.
Section 3. That notide of the meeting of public hearing shall he liven by at

least four publications in the S. . issue of the Geld ^.yell News - Tribune, a daily news-
paper, printed and published in the City of Caldwell, Idaho, :which said newspaper has,
in conformity of Section 154 of the 1033 Sessions Laws, in each issue at the head of the
editorial column announced the day of the week on which le=ral notices required by lam or

by order of any Court of competent jurisdiction to be published weekly, and which notice
shall be in substantially the following form, to-id t:

OF CALDWELL, IDAHO, FOR THE FISCAL YEAR BEGINITING TIM FIRST DAY OF MAY, 1935: SAID
ESTIMATE AND TAX LEVY FOR GFNF.RAL PURPOSES BEING IN EXCESS OF TEN MILLS.
The City COum2il and Mayor having determined that it will require a tax levy

said proposed appropriation bill to be held at the City Hall in the City of Caldwell,
Idaho, at the hour of 8 o'clock, P. 11., on the 30th day of July, 1935.

reference is hereby made to said estimate of expenditures hereinabove referred to and
fully set forth in the minutes of the meeting of the Mayor and City Council on the 28th

AN ORDINANCE AMENDING SUBDIVISION (a) OF SECTION 1 - ARID 3 OF ORDINANCE - NO. 508 EN-
ITLED " AN ORDINANCE LICENSING AND REGULATING PLACES OF BUSINESS FfHERE BEER IS SOLD TO
THE OONSumm, AND PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE, AND REPEALING
ALL ORDINANCES IN CONFLICT MTH THIS ORDINAITOE, PROVIDING A SAVING CLAUSE, AND DECLARING
AN EMERGENCY, "DEFINING THE WORD -BEER", ;,ND PROVIDING THE AMOUNT OF THE ANNUAL LICENSE
OR THE SALE OF BEER IN THE CITY OF CALDWELL, IDAHO.
Said ordinance was then duly and carefully considered and discussed by the City
Council, and thereuv Councilman Montgomery moved that the rules requiring the reading
of an ordinance fully and distinctly on three different days be suspended and that the
proposed Ordinance No. 519, be read the first and second time by title and the third time
ally and distinctly, at length, and section by section, and then placed upon its final
passage. Said motion was seconded by Oakes and the U5yor ordered the roll call on said
notion, which resulted in the following vote, to -wit: Ayes: Oakes, Mumford, Hollingsworth
oynton, Fenrich and Montgomery. Nays: None. Absent and not voting: None.
(hereupon the Mayor deClnred said motion, having received the unanimous vote of
he Council, adopted.
Thereupon the Clerk, under the direction of the Mayor, read the proposed Or-
inance No. 519, by 'title the first time, by title the second time, and the third time ful:
and distinctly, and at length, section by section, and said Ordinance No. 519 was placed
anon its final passage. The Mayor ordered the roll of the Council called, which resulted
as follows: Ayes: Mumford, Boynton, Montgomery', Fenrich, Hollingsworth and Oakes.
Nays: None. Absent and not voting. None.
Whereupon the Mayor declared said Ordinance No. 519 duly passed and directed the
Clerk to make proper record thereo', Said Ordinance was then numbered 519; signed in open
meeting by the Mayor and attested by the City Clerk with his signature and the seal of the
City. The City Clerk was then instructed to publish the ordinance one time in the Cald-
well News- Tribune, the official newspaper, a newspaper printed and published and of general
circulation in the said City of Caldwell.
Moved by Montgomery, seconded by Mumford that the Council adjourn till the first
day of July, 1935. Motion carried.
