There being no further business to come before the Council, it was moved by Councilman Luby,
seconded by Councilman Smith that the meeting adjourn. A vote was taken and the motion unanimously carried.

The Council met pursuant to call and acknowledgement of notice in the following form:
We, the undersigned Acting Mayor and Members of the City Council of the City of Caldwell, Idaho,
do each hereby acknowledge notice of a Special Meeting of the said City Council, to be held in the Council
Chambers in the City Hall in the City of Caldwell, Idaho, at the hour of 5100 P. M., on the 27th day of
June, 1963, for the transaction of all business in connection with the following objects: Requests for Door -
to -Door Solicitors License, Re- Zoning, fill material and water meters.

Upon Roll Call, the following Councilmen answered present: E. L. Vassar, Emile Shorb, C. A.
Davenport, V. Jay Martin, and N. E. "Coley" Smith. Absent: Max Luby.
Request for Door -to -Door Solicitors License
Acting Mayor Vassar called upon Ns. Bill Norman who stated that he would like to present an
application for a Door -to -Door Salesman License on behalf of his business and for Mr. Henry Berstein who
would be working for him.
It was moved by Councilman Smith, seconded by Councilman Shorb that a Door -to -Door Salesman License)
v..a
be issued to Mr. Henry Bernstein at the reduced fee of $3.00 for a three months period. A vote was taken
the motion unanimously carried.
Mr. Norman thanked the Mayor and Council afterwhich he and Mr. Bernstein excused themselves from
the meeting.
Resolution No. 23 - Re- Zoning
Acting Mayor Vassar informed the Council that the Zoning Board had recommended the re- zoning of
five Blocks whereupon Councilman Martin introduced the following Resolution:
RESOLUTION NO. 23
BY COUNCILMAN MAR=
WHEREAS, It has been recommended to the Mayor and City Council of the City of Caldwell, Idaho, that an
ordinance be passed amending and altering the boundaries of the "A.B." Residential Zone by excluding there-
from the within described property and by altering the boundaries of the " O.D." Commercial Zone by including
therein the within described property, to -wit:
Beginning at the center of the intersection of Chicago Street and Thirteenth Avenue;
thence Southeasterly along the center line of Chicago Street to its intersection with
the center line of Sixteenth Avenue; thence Northeasterly along the center line of
Sixteenth Avenue to its intersection with the center line of Elgin Street extended;
thence Northwesterly along the center line of Elgin Street extended and of Elgin Street
to its intersection with the center line of Fourteenth Avenue; thence Southwesterly along
the center line of Fourteenth Avenue to its intersection with the center line of Denver
Stree; thence Northwesterly along the center line of Denver Street to its intersection
with the center line of Thirteenth Avenue; thence Southwesterly along the center line of
Thirteenth Avenue to the point of beginning, as shown on the official map of the City of
Caldwell, Idaho, adopted on August 21, 1961.
NOW, THEREFORE, BE IT RESOLVED:
1. That a public hearing be held by the City Council of the City of Caldwell, Idaho, in the Council
Chambers thereof on the Bth day of July, 1963, at the hour of 8:00 o'clock p.m., at which time all persons
interested may appear and protest said proposed changes.
2. The City Clerk is hereby ordered and directed to give notice of said public hearing by publication
of a notice in the News - Tribune, a newspaper printed and published in the City of Caldwell, in two issues
thereof, published on the 29th day of June, 1963, and the 6th day of July, 1963.
It was moved by Councilman Martin, seconded by Councilman Shorb that Resolution No. 23 be passed.
A roll call vote was called for with the following Councilmen voting in the affirmative: Shorb, Davenport,
Martin, and Smith. Negative: none. Absent and not voting: Luby. Acting Mayor Vassar declared that
Resolution No. 23 had passed.
Request of Canyon County Multi- Purpose Stadium Committee denied
City Engineer Mel Lewis reported that the Canyon County Multi- Purpose Stadium Committee, through
Ron Blakley, had redesigned their area to absorb 5,300 cubic yards of material which they now hoped they
could get through the City. Mr. Lewis stated that originally he had started out to determine whether they
could use it and if they had been ready to go, he could have stipulated it over there and that he found now
that this was the best proceedure because, in addition to what the City would pay to move the dirt elsewhere
by giving it to the Contractor, he had asked Mr. Bob Eaton, who was the only plan holder now, to estimate, for
the cost to move the dirt from the area to the site of the Stadium and his estimate was that it would
cost 35¢ a yard extra or around $2,000.00 more.
In answer to the question by Acting Mayor Vassar, City Attorney Dean Miller stated that he didn't
ow how the City could justify giving away $2,000.00 in that the City would be hiring Mr. Eaton or the
Contractor on the job to deliver the material to the Stadium and would be paying him approximately $2,000.00.
He said that this would not be a lawful City operation.
After some discussion, it was moved by Councilman Smith, seconded by Councilman Davenport that the
request of the Canyon County Multi- Purpose Stadium Committee be denied on the grounds of questionable legality
d secondly, that no funds had been provided in the budget for this purpose. A roll call vote was called for
hen the following Councilmen voted in the affirmative: Shorb, Davenport, Martin, and Smith. Negative: none
Absent and not voting: Luby. Acting Mayor Vassar declared the motion had passed.
City Engineer Mel Lewis stated that he would like to make some clarifying statements. He said that
first of all, at the time they had negotiated, they didn't know but that this would be as good a place as any
for the material providing the Contractor didn't want a premium for getting it there; then they found that
the Stadium group weren't ready for the material and then it was thought that they could possibly still haul
it over there if there was only around $200.00 involved but that it had gotten out of hand, cost wise.

City Engineer Mel Lewis then reported that he had soma additional information for the Council re-
garding the request by the Stadium Committee for a water meter. He said that without the concrete box which
was figured in the cost of $800.00 before; just the cost of materials to the City would be $!470.70, the labor
would be $108.00 and an oil cut, $15.00. This would be a total cost to the City (without the concrete box)
of $593.70 for the setup as requested. He then stated that the Water Superintendent had determined what it
would cost to lay 41' pipe to the meter, ready for any future use, and then a standard 2" meter; that on this
basis, the material costs would be $406.53, the labor $90.00 and the oil cut $15.00 or a total cost of
$511.53. He stated further that a 1' service wouldn't work.
This was then discussed afterwhich it was mo'.ed by Councilman Shorb, seconded by Councilman Martin
that no charge would be made by the City on labor for the installation of the water meter requested at the
Canyon County I+Lalti- Purpose Stadium. A roll call vote was called for when the following Councilmen voted in
the affirmative: Shorb, Davenport, Martin, and Smith. Negative: none. Absent and not voting: Luby.
Acting Mayor Vassar declared that the motion had passed.
Request for water meter - Bob Nicholes - water main extension necessary
Next considered was the request of Mr. Bob Nicholes for a water main extension to the office at hi
bulk plant on Franklin Road which would be 1,000 feet beyond the City's present water main on Chicago Street
Mr. Lewis, City Engineer, stated that the water study called for an 8" main and that he had estimated the
material costs for both 8" and 6 ". He explained the present status of the budget and then stated that the
material costs for 8" main with one hydrant would be $3,794.00; for 6" line with one hydrant would be
$2,673.00 and that another alternative under the Ordinance would be for Mr. Nicholes to buy his own water
service at 75¢ a foot beyond the 55 feet that the $70.00 meter charge provided for.
Mr. Lewis then explained the danger of laying smaller than a 4" line at Mr. Nicholes expense and
the later problems involved if others should wish to use the line and said that another alternative was to
enter into an agreement for a share in the cost where it didn't look like an economical project for the City.
After some discussion by the Council, it was moved by Councilman Smith, seconded by Councilman
Shorb that the City enter into an agreement with Mr. Nicholes to put in a 6 " main extension with Mr. Nicholes
share of the cost being $1,000.00.
A roll call vote was called for when the following Councilmen voted in the affirmative: Shorb,
Davenport, Martin, and Smith. Negative: none. Absent and not voting: Luby. Acting Mayor Vassar declared
that the motion had passed.
It was moved by Councilman Smith, seconded by Councilman Shorb that the meeting adjourn. A vote
was taken and the motion unanimously carried.

The regular monthly meeting of the City Council met in the Council Chambers of the City Hall, with
Acting Mayor E. L. Vassar presiding.
Upon Roll Call, the following Councilmen answered present: E. L. Vassar, Emile Shorb, Marc Luby,
C. A. Davenport, V. Jay Martin, and N. E. 'r Coley" Smith.
Complaint on odor - Mrs. Mahle McClemcnts
Acting Mayor Vassar called upon Mrs. Mable Mc Clements who stated that she had waited a little
while and that she was still getting an odor - she then presented petitions headed: "We the undersigned
