Council met in regular session persuant to adjournment of June 12, 1929, with

PRESENT. ABSENT: NONE.
This being the date eat for hearing the application of 0. A. Payne for per-
mission to erect a gasoline service station on the Northerly aide of the Interseetion
of 4leveland Boulevard and Linden Street, and hearing protests against said application.
The dlerk presented the Affidavit of Publication of said notice in the Caldwell
News- Tribune and the same being on file in the office of City Glerk with the application.
There being no objections to the application of 0. A. Payne to construct said Service
Station the Mayor announced that a resoultion authorizing same would be in order.
RESOLUTION NO. 5, BY BOLLMAN, was presented as follows:
"WHEREAS, 0. A. Payne, heretofore made application for permission to erect
and construct a service station within the city limits of the City of Caldwell, outside
the limits prescribed by Ordinance No. 468, and
"HEREAS, Said 0. A. Payne has fully complied with all the requirements of said
Ordinance No. 468, and
"WHEREAS, Notice and hearing having been given and had on said matter, persu-
andt to said Ordinance and the Mayor and Oounoil having duly considered all matters
arieingon said hearing and being fully advised in the premises,
"NOW THEREFORE, BE IT RESOLVED By the Mayor and Council of the City of Geld -
well, Idaho, as follows:
"Section 1. That 0. A. Payne be and he hereby is granted a permit to erect
and construct an automobile service station near the Northerly side of Intersection of
Linden Street and Cleveland Boulevard on the property of said applicant, said structure
to be located Eighteen (18) feet Northeasterly from Cleveland Boulevard and Ten (10)
feet Northerly from Linden Street: and said Service station to be of the description
and structure specified in the application for this permit and for the business of an
automobile service station, including the retail of gasoline and oil as prayed for in
said application ".
Motion was made by Sandmeyer, seconded by Leighty, that Resolution No. 5 be

adopted. On the question as stated the J"ayor directed the clerk to call the roll with
the following result:
AYES: BOLLMAR , DICKENS, JOHNS, LEIGHTY AND SANDMEYER.
NAYES AND ABSENT: NONE. Whereupon the Mayor declared the motion carried unanimous,
and Resolution No. 5 adopted. The Mayor approved and signed same.
It - me voted on motion of Dickens, seconded by Johns, that the oommittee on
Memorial Park and Airport Drainage, consisting of Sandmeyer, 3ollman and Leighty have
power to act with regard to filling the irrigation ditch through the airport, pulling
down the bank of drain ditch east of airport and cleaning the Drain Ditch from the inter-
Section of the new drain to the outlet of the pipe line near the Memorial Yark.

was voted on motion of Bollman, seconded by Sandmeyer, that the Road Cam -
mittee arrange with the Contractor and County commissioners to construct a Drain Ditch
from Indian Greek to such a point that would drain East Chicago Street and Franklin Road.

Luallon appeared before the Counail in the interest 1. P. Jones and
himself asking for an increase in salary furnishing team and driving sprinkler wagons.

The matter was taken under consideration.
J. F. Bales appeared before the Council and submitted plans for Municipal Air—
port Hangers which are being considered constructed, The estimated cost being from
42000.00 to $2200.00.
It was voted on motion of Uiokens, seconded by Leighty, that the plans be placed
on file.
Fred Nicholson of the idaho lower Co. appeared before the Upuncil asking per-
mission to install a water heater for the ?ire Department in the place of the old heater
for a certain price. The matter was taken under consideration.
It was voted on motion of Dickene, seconded by Leighty, that ®ouncil adjourn.
