The Mayor stated the meeting was set by notice to hear nrotests to the amendment of Section 5 -102
land Section 4 -104 of the Caldwell Code defining the boundaries of "A" Residential Zone and "C" Commercial
,Zone.
The following were present to protest: Joe Ostler, 2119 Cleveland, Kenneth UeHart, 7123 Cleveland,
Arthur T. Smith, 2107 Cleveland, Robert Smylis, 1920 Elaine,£iwrrtCorn 1907 Blaine, Robert C. Shupe, 1900

Blaine, Boyd Henry 2021 Cleveland and Elcen Marsh, representing the College of Idaho.
i' Boyd Henry was spokesman for the group.
The following were present anti in favor of rezoning: Peter Boyd, Ralph Smead and Melvin Kirkland.
Councilman Vassar: I am not ready to make adecision at this time.
Councilman Finley: I do not believe in spot zoning, but, in this instance I believe it is to the bes�

i of the City, also, I would like to state at this time the Planning Commmission is making a study of
the Zones of Caldwell.
The Mayor informed those present this matter would be taken under advisement.
Mr. T. W. Cole appeared on be�lalf of Mrs. Pearl Temple of 2205 College Avenue and asked if a com-
!!promise could be agreed upon by the City and Mrs. Temple regarding a 'igher curb.
Councilman Finley: The cost to the City w— be jr200 or S?CO if the change in the curb was made.
Councilman Luby. The City should keep the curb uniform. !

Councilman ° horb: The City Attorney and the City Engineer are competent and we should abide by
their decision in this matter.
I� Councilman Eldredge: I have been in this Council for a long time and this is not a problem of per-
sonal opinion.
Colonel Easterday, Wayne Davis and Ben Anderson brought up the subject of military leave of
absence for employees who are �n the armed forces�to attend a military training school.
The City Attorney stated the Idaho Code did not require a Municipality to give leave of absence,
but if the City should decide on leave of absence each case should be taken individually, also an employee
could take military leave without pay from the City and still have two weeks vacation pay. .
City Engineer: An employee should not be denied the right to attend the school but it should I

be counted as vacation if the City pays wages for that period.
Councilman Finley reported he has sold the old street flusher to the nodeo Board for X11500 with
a down payment of 4500.
Re- Zoninng of " A" Residential Lone and "C" Commercial Zone and construction of Bowling Aleey was
again brought up for discussion.
r The City Attorney's opinion was to the effect the College of Idaho should be contacted regarding
l their attitude toward a bowling alley.
Moued by Eldredge, seconded by Vassar the City obtain a letter from the Board of Trustees of the
College of Idaho setting forth their attitude toward the bowling alley. 1

Whereupon Councilman Vassar presented the following Resolution and moved the adoption thereof,

BFFORE THE APPROPRIATION BILL PROVIDED FOR IN SAID SECTION SHALL BE PASSED BY THE MAYOR AND COUNCIL OF THE

WHEREAS, at a special meeting of the Mayor and City Council of the City of Caldwell, Idaho, held
on the 23rd day of June, 1958, an estimate of the probable amount of money necessary for all purposes to be
raised in the City of C Idaho, daring the fiscal year begin May 1, 1958, and ending May 1, 1959,
including principal and interest due on the bonded debt and sinking fund, itemizing and classifying the
different obects and branches of expenditures as near as may be, with the �atement of the entire revenue
of said city for the previous fiscal year, was submitted to thesaid Mayor and City Council by the Finance
Committee and which said estimate was entered at length upon the ru:utes of said meeting of the Mayor and
City Council; and
WHEREAS, s,id Mayor and City Council desire that p_oper resolution be drawn granting and firing
the time for a public meeting for hearing protests against said proposed appropriation bill, and give due
notice thereof;
NOW, THF: B IT RESOLY!G), By the 14ayor and City Council of the City of Caldwell, Idaho;
Section 1. That the Mayor and City Council of the Cit^ of Caldwell, Idaho, avedstermined that
it will require a tax levy for general revenue purposes inexcess of ten mills to raise sufficient money for
general purposes as provided by law for the fiscal year beginning May 1, 1958, and ending May 1, 1959, and
is more fully shumn by theestimate of expenditures of the City of Caldwell, Idaho.
Section 21. That before the passage of said appropriation bill and before said levy be made,
a nublic hearing be granted, and that said nuhlic hearing upon said estimate and proposed appropriation bill
os hereby called and ordered to be held at the City Hall of said City at the hour of 5:00 o'clock P. M. on
the 7th day of July. 1958.
Section 3. That notice of said meeting and public hearing shall be given by at least two oubli-
cations in The News - Tribune, a daily newspaper nrinted and published in the City of Caldwell, Idaho, which
said notice shall be printed in the Saturday issue thereof on June 28 and 1 5, 1958; which mid notice
shall be in substantially the following °orm:

The City Council and Mayor of the City of Caldw -11, Canyon County, Idaho, having determined
at a meeting duly and regularly called and held in the City of Caldwell, Idaho, on the 23rd
day of June, 1958, that said City will require a tax levy for general purposes, as provided
by law, for the fiscal year beginning May I, 1958, and as fully set out in the estimate
of expenditures of the City of Caldwell, Idahom for the fiscal year beginning May 1, 1958,
duly adopted, passed and anproved by the Mayor and Louncil at said meeting of June 23, 1958,
andaopearing in the minutes of said meeing, held on s.id date, and said Mayor and Council
havingdatermined at said meeting that it will be necessary to pass and appropriation bill
appropriating inexcess of ten mills for general pur oses of said City for mid fiscal year.
NOTICE IS H3rEBy GIVEN: That a public meeting and hearing is hereby granted on said aopropri-
atioh bill to be held at the City Hall in the City of Caldwell, Canyon County, Idahom at the
hour of 5! ^O o'clock P. M. on the 7th day of July, 1958.
For further detailed information concerning the said proposed appropriation bill, reference
is hereby made to the said estimate of expenditures hereinabcve referred to and fully set
