B,Cooper, President of the homesteaders Stock -Shows -Night Rodeo Assoc., requesting a permit to operate the Monte Young Shows from August � to August 9th, also, weaver of license fee and that no permit be issued to another carnival or show during the period between July 1, and August 9. Moved by Newman, seconded by Fra'sher that this request be granted and the license fee cancelled. Motion c arried. Mr. Oscar Stengel appeared and called attention to the Zoning Ordinance and stated that it should either be enforced or amended, also, that the Sanitary conditions in the City should be investigated. The Mayor ddviseVthet these matters would be taken under consideration. Tt was moved by Bryant, seconded by McDannel that Council adjourn to most June 23rd., 1941, at 9 :00 P. M. Motion carried. Mayor. Citg Clerk. COUNCIL CHAMBERS, June 23rd., 1941,. 8:00 F.M. Pursuant to adjournment of June 9th., 1941, the Council met in the Co, Rooms with the Mayor H.E. McCluskey, presiding. On Roll Call the following•Councilmen answered present: Thurlow Bryant, Wilbur, Dakan, Floyd Blunt, E.E.Frasher, Fred E. Newnan and G. 0. McDannal. Moved by Daken, seconded by Frasher that Indiana Avenue be oiled. Motion carried Moved by McDannel, seconded by Daken that Councllmin'arise and address the Chair before presenting business to the Council. Motion carried. This being the time data set for hearing protests against the proposed estimate of expenditures of the City of Caldwell for the fiscal yesr beginning the first day of May 1941. The s aid estimate and tax levy being in excess of 10 mills for general purposes. And that the publisher of said TFiE CAMBELL NEIFS- TRIUNE, a daily newspaper, has all the time since the 5th day of July, 1933 and in each issue thereof, at the head of the editorial column of said newspaper, announced the day of the week to -wit: Saturday, on which legal notice required by law or by order of any Court of competent jurisdiction to be published weekly, will be published; that the said paper is in general circulation in Canyon County , Idaho and has been for a period of seventy -eight weeks preceding the first publication of this advertisement, a copy of which is attached hereto, and by reference thereto made a part of this affidavit and was published in the regular Saturday issue of TITE CALDWELL NE'h'S*TRIBUNE for 2 consecutive weeks beginning with the issue of June 14th., 1941 and end- ing with the issue of June 21st., 1941. .) It was moved by McDannel, seconded by Blunt that the rules requiring that the reading of a Bill on threeseparate days be suspended and that Bill No 1, be read the second time by title and the third time in full, section by section and placed on its. final passage. The Mayor directed the Clerk to the roll on the motion with the following result: Those voting in the affirmative were: Bryant, Dak&n, Newman, Blunt, Frahser and McDannel. Negative: None, Absent and not voting: None. The Mayor declared the motion had passed by the necessary three - fourths majority and directed the Clerk to read Bill No. 1, the second time by title and the third time in full,sectinn by section. The Clerk read the Bill as directed. The question then :being "Shall Hill No 1, pass? The Mayor directed the Clerk tocall the roll on the above question which resulted as follows: Those voting in the affirmative were: Bryant, Dakan, Newman, Blunt, Freshsr and McDannel. Those vot- ing in the - negative were None. Absent and not voting.- None. Thereupon, the Mayor declared Bill No. 1,. had passed, and the Mayor in open session of the Council duly signed end approved the Bill, and the Clerk duly signed and attested the same which became Ordinance No 574. The Mayor directed the Clerk to make proper entry of the same end to cause Ordinance No 574, to be published in the Caldwell News - Tribune, the official newspaper of the City of Caldwell, Idaho. . Upon motion 1Qy McDannel., 4e,ennded by Blunt, the Clerk of ,the City of Caldwell, Idaho was reeuested and instructed to insert the following Advertisement for Bids in the Official Newspaper of the City of Caldia Idaho, in the issues of June 28th., and July 5th., all in the year 1941, to rA t: ADVERTIETVENT FOR BIDS Sealed bids will-be received at the Office of the City Clerk in the CityHell of the City of Caldwell, Idaho, by the Mayor and Council of the City of Caldwell, Idaho, until July 7th., 1941, at 5:00 o'clock P.M., for the construction of a Cemetery Bgilding for a aid City to be erected in the Cemetery of said City; and, ,said bids will, on said date at the hour of 6:00 o'clock P. V., be then and there opened and publicly read aloud. Bids. received after the time fixed herein for receiving the same will not be considered. . Plans and specifications for said building may be examined at the officd of the City Clerk in the City 7911 in the City of Caldwell, Idaho, and a set of said plans and specifications may be obtained at said office. The City Clerk read a petition signed by property owners petitioning the Mayor an Council to open an alley in block 14, Fair Acres Addition. Moved by Frasher, seconded by Blunt that the City accept the deed for a strip of land running through Plock 14, to be used for an alley. Motiln earned. Application for Beer License was read from H.F. Inman, the fee accompanying the appl' cation. Moved by Blunt, seconded by Frasher that this license be granted. COUf]GIL CF,A &'E "R8, JULY 7, 1941, 0:00 P.M. The Regular Monthly Meeting of the City Council met in the Council Room of the City Pall, _rith the PayOr, H.E. KcCluskey, presiding. On Roll Call the following Councilmen answered present:•Thurlow Bryant, Fred E, Newmgm, Floyd Blunt, E.E, Frasher, •Wilbur Dakan and C. 0. LMcDannel. The Minutes of June 2nd., 9th., and 23rd., were read and approved as read'. Councilman Newnan informed the M"Mayor and Council that a newmerrF' d s orngchildren` had been installed at the Colden Gate Park. The Mayor appointed 1W CARLSON on the POiTCE ?ORCC at a salary of rllO per month to fill the vacany left by the resignation of John Dobson. Moved by Dakan, seconded by Frasher that this appointment be confirmed. •Mots n carried.
