The Meeting was called to order by Mayor McCluskey.

The Mayor requested that everyone stand and give the Pledge of
Allegiance to the Flag.
The Roll of the City Council was called with the following members
present: Raymond, L. Carter, J. Carter, Mallea, Betts, Cowles, and
Raymond. Absent: none.
(AUDIENCE PARTICIPATION)
The Mayor asked if there was anyone from the audience who cared to
bring anything before the City Council that was not on the prepared
Agenda. Since there was no one, the Mayor declared that the
Meeting would continue as outlined.
(DECISION WITH REGARD TO LANDSCAPING ON 'HIE INTERSTATE)
The Mayor called on Ron Redmond, the City Engineer, to discuss this
decision on the landscaping on the Interstate. Mr. Redmond stated
that he distributed copies of an estimate to members of the City
Council with regard to the costs of the landscaping. The report
included each of the three alternatives and the total figure for
each of them. There was a notation from the Parks Department that
it was their opinion that the shrub beds were more difficult to
maintain than the grass. Therefore, it was their opinion that the
alternative with more grass would be the one that would cost less
in the long run. Mr. Redmond further commented that the Parks
Department figured that the City would be looking at between
$11,000 to $15,000 for annual maintenance. The drawings of the
three proposed plans was then posted on the bulletin board for the
Council's study and discussion.
The landscaping decision was discussed at some length with members
of the City Council agreeing that they would like to have it look
as nice as possible, but still take into consideration the costs of
maintenance. The State was to put in all of the shrubs and grass,
but it was the City's responsibility to maintain the landscaping
after installation. It was pointed out that whatever plan was
accepted, it could be altered in the future.
The Mayor was called out of the City Council Chambers to another
meeting and the City Council President Jack Raymond took over the
meeting as Acting Mayor.
It was determined by the City Council that Plan No. 1 was more
grass, less shrubs, but that Plan 2 and 3 were very similar except
for two areas. Plan 3 did include some shrubs and seemed to be the
most desirable if shrubs were included along the sidewalk.
It was then MOVED By Mallea, SECONDED by J. Carter that Plan Number
3 be accepted with shrubs included along the sidewalk.

J. Carter. Those voting no: Betts. Absent and not voting: none.

(RESOLUTION NO. 33 -82 - REHAB LOAN FOR STELLA MAE WILSON)
Councilman J. Carter presented this proposed Rehab Loan by reading
Resolution No. 33 -82 by title only as follows:
RESOLUTION APPROVING A HOUSING REHABILITATION FOR STELLA MAE WILSON AND
PROVIDING AN EFFECTIVE DA'T'E.
It was then MOVED By J. Carter, SECONDED by L. Carter that
Resolution No. 33 -82 be passed as presented.
Roll call vote. Those voting yes: J. Carter, Mallea, Betts,
Cowles, and L. Carter. Those voting no: none. Absent and not
voting: none.

(AWARD BID FOR BLOCK GRANT STREET PROJECT)
The City Engineer, Ron Redmond, reported that the apparent low
bidder was Idaho Sand and Gravel in the amount of $167,015.62. The
Engineers estimate on the job was $224,439.00 so the bids were
substantially all under the estimate. It loops as though the City
will be able to add to the project, but no decision has been made
as to what would be added.
MUTED ,by Betts, SECONDED by Cowles that Idaho Sand and Gravel be
awarded the bid in the amount of $167,015.62 for the Block Grant
Street Project.

(REPORT FROM ENGINEERING DEPART ON CORNER AT RIM VIEW AND RICE)
Mr. Redmond, City Engineer_ reported that he did go out to view the
area with Gene Enebo about three days ago and Captain Wing, of the
Police Department viewed the area that morning. Some pictures were
taken which he passed around for. the City Council members to look
at of the corner in question. The curve in question has curb on
one side, but not on the outside and there was approximately
thirty-two foot wide pavement on both sides. Both he and Captain
Wing felt that there was no possibility that this street would ever
be anything but a Residential street. On a Residential Street, a
twenty -five mile an hour speed limit prevails. People traveling at
the speed limit should have no problem negotiating that turn and it
was suggested that no modification be done at this time. If it was
necessary for a modification and this was the determination, the
most feasible method would be to clip off the fence shown in the
picture to straighten out the curve. Since this property owner was
the one who complained about the curve, it was doubtful that he
would go along with this.
Councilman Cowles questioied as to whether there was a posted speed
limit sign there. Councilman Cowles thought that if those who
complained about the curve could see that the City had put in a
speed limit sign they would feel that the City had attempted to
help the situation. Councilman Betts also asked if there was a
sign that indicated there was a curve. Mr. Redmond stated that he
did not think so. Councilman Cowles further said that he thought
the people were complaining more about how fast the cars were
coming around the curve. If some indication could be given to the
drivers that there was a curve and a speed limit in that area, it
would help the situation.

After discussion, Mr. Redmond stated that they would put in a speed
limit sign and Councilwoman Mallea also asked that the Police
Department patrol the area for a while. The Acting Mayor also
asked if some yellow paint on the curb at its outer most point on
the curve would be helpful. Mr. Redmond stated that they would try
the speed limit sign first to see what happens and that he would
let Mr. Breshears know what the City Alas planning to do.
NEW BUSINESS
(CATERING PERMITS)
The City Clerk presented two Catering Permits for approval by the
City Council. The first was for Victor's to cater for the Chamber
of Commerce Tractor pull at the Rodeo Grounds on June 27th and the
second was for the Elks Club to cater for the Elks Benefit Baseball
Game at Simplot Stadium on the 11th of July. Both fees were paid
to the Office of the City Clerk and the Chief of Police gave his
approval.
MOVED by Mallea, SECONDED by L. Carter that approval be given for
the Catering Permits as presented by the City Clerk.
(RESOLUTION NO. 34 -82 - REHAB LOAN FOR VENICE GENSLER)
Councilman J. Carter read Resolution No. 34 -82 by title only as
follows:
RESOLUTION APPROVING A HOUSING REHABILITATION FOR VENICE
GENSLER AND PROVIDING AN EFFECTIVE DATE.
It was then MOVED by J. Carter, SECONDED By L. Carter that
Resolution No. 34 -82 be passed authorizing the rehab loan for
Venice Gensler.
Roll call vote. Those voting yes: Carter, Mallea, Betts, Cowles,
and L. Carter. 'Those voting no: none. Absent and not voting:
none.

(SEWER CLAIM)
Acting Mayor Raymond stated that a letter was received addressed to
the City of Caldwell fromn Leonard Wolfe. The letter stated that
he was sending copies of bills sent to him for work done at his
tenant house at 1122 Paynter. They worked on the sewer line trying
to unplug it after gettinng a distress call from the tenants. They
worked late into the night trying to unplug it and the next morning
found that it was in the City's main sewer drain. He felt that he
should be reimbursed for the labor paid out for a problem that was
the City's. The amount of the claim was for two amounts: $45.00
and $33':00.
The claim was turned over to Councilman Cowles for investigation
and the Acting Mayor requested that he report back to the City
Council at a future meting.
(RESOLUTION NO. 33 -82 - AGREMENT WITH RAILROAD)
Mr. Redmond, City Engineer explained that this agreement was
brought to the City Council about three months ago. This was for
the right to use the right of way and originally, they were going
to charge an annual fee of $3,200. The City felt that this fee was
excessive and went back to the railroad indicating this. The
Railroad then came back with a revised fee of $1,365. They also
informed the City that when the Railroad reassess the value of the

property, they will also reassess the value of the easement so the
fee could go up. This was a five year Agreement and was a new
easement for the East Cleveland Interceptor.

AGREEMENT WITH THE UNION PACIFIC RAILROAD FOR UNDERGROUND
SEWER PIPELINE ENCROACHMENTS.
It was then MOVED by L. Carter, SECONDED by Betts that Resolution
No. 33 -82 be passed.

Betts, and Cowles. Those voting no: none. Absent and not voting:

(SET DATE FOR PUBLIC HEARING)
Mr. Redmond explained that this was a request for the vacation of a
portion of Omaha Street. The request has gone through the Planning
and Zoning Cox mission and was now before the City Council to set a
public hearing. Mr. Redmond pointed out the area on the overhead
projector for the benefit of the City Council members. The portion
to be vacated was between Third and Illinois and from a traffic
standpoint, the City would be eliminating a potential hazard as
there would be created a number of intersections at a very close
proximity to each other. The City di_d request as a condition of
vacation that the person requesting the vacation grant the City a
triangular piece so if the City wanted to they could put in a right
turn lane onto North Illinois. This was agreed.
Mrs. Robison explained that the Monument Works were thinking of
buying the little triangle and use it. to expand their business.
She further stated that no date was picked as yet for the hearing,
but it would take about three weeks for the legal notices.
It was then MOVED by Mallea, SECONDED by J. Carter that - the Public
Hearing be scheduled and that Mrs. Robison determine what date this
hearing would be held.

(ACCEPT DEED FOR R.)aMSTER STREET)
Mr. Redmond presented the deed from Elwood and Nellie Siegmann for
Rochester Street. This was a Warranty Deed and was that portion of
Rochester Street that replaces the access of the vacated Rim View.
MOVED By Mallea, SECONDED by L. Carter that the Deed be accepted
and the City Clerk instructed to record the same.

(COMMITTEE REPORTS)
Councilwomman Mallea informed the City Council that she talked with
Mr. Morrison, the City Attorney and there seemed to be some problem
in getting the intern. Mr'. Morrison suggested that since it was
getting so late and the intern has not. returned his call, with - the
resolution of several legal matters that were pending, he may
proceed himself on regular time. Councilwoman Mallea stated that
she was disappointed in this, but hopefully it would work out.
Councilwoman Mallea also expressed her compliments to the Airport
Commission for the fine Airport Appreciation Day. Also,
compliments to the Golf Course Committee as she had heard nothing
but good things about the City's Golf Course. She attended the

Stadium Commission Meeting and they were setting a meting for the
Fair Building and the management of it. There was a chance of
having the Shrine Circus in Caldwell. The Good Sams were here this
year and enjoyed their stay, but would not be here next year.
There was a new concessions manager, Jan Stoddard. The Little
Britches Rodeo was starting July 6th and registration was slow.
Councilwoman Mallea also stated that Pat O'Connor requested three
trees from the nursery to put on the East corner of the Stadium.
She would ask permission from the City Council to have these trees.
All members of the Council approved this request.
Councilman J. Carter stated that he attended the Airport
Appreciation Day and everything went very well. It was his feeling
that Mr. Linscott and Mr. Shreve should be commended for a job well
done and would suggest that the Mayor write to both of them. He
also reported that he attended the Planning and Zoning Commission
nearing on the setback ordinance and it was not approved.
Councilman L. Carter also commented that he had heard nothing but
good comments with regard to the Caldwell Golf Course. He also
attended the Board Meeting for the Senior Citizens and they were
about to finish the kitchen and were planning a; six year
anniversary.
Councilman Cowles stated that he enjoyed attending the Association
of Idaho Cities Convention and would turn in a written report. He
further said that the best part was just sitting down and talking
with other City officials from around the State.
Councilman Betts reported that he also attended the Planning and
Zoning hearing. He also commented that he would like to commend
Captain Rorke for handling problems at the Police Department during
the absence of the Police Chief.
The Acting Mayor stated that there would be no meeting the next
Tuesday as it would be the fifth Tuesday of the month. He also
informed the City Council that the Softball Tournament went well
the last weekend. The Thursday evening project to put the fence up
for the minature golf course went well and they had a good turn
out. Mr. Jarboe will be back in town this week and they will put
in the minature golf course for the City. They were planning a
grand opening on July 3rd at 10:00 a.m..
The Acting Mayor also stated that there was a note left by the
Mayor that a Mr. Davis was to have appeared before the City Council
with regard to oil exploration at Purple Sage Golf Course, but Mr.
Davis evidently did not arrive to speak, to the City Council.
Councilman Cowles also stated that he would like to commend the
Acting Mayor for a job well done during the absence of the Mayor.
There being no further business, the Meeting was adjourned at 1.00
p.m.
