The Cobnoil met in regular session pursuant to adjournment with Mayor Maley, presiding,
Councilmen, Conley, Yimbrough, Mumford, and Wheeler, present, and Dutton and Mo
absent. S.Earle Boyer, City Clerk,being absent, the Mayor appointed W.c.Dyer as Clerk
of the meeting.
The Clerk presented to the Council the Affidavit of Publication of the Ordinance
of Intention to create Local Imrppvement District No.6, which Affidavit was and is in
words and figure as follows, to -wit:

TRIBUNE PUBLISHING COMPANY, publisher of UN CALDWELL TRIBUNE, a weekly newspaper
published at Caldwell,Tdaho; that the said paper is in general circulation in the County
afotessid, and has been for a period of 78 weeks preceding first publication of this
advertisement, a copy of which is attached be reto, and was published in the regular editiox
of ea id THE CALDWELL TRIBUNE, 2 consecutive weeks, beginning with the issue of June 11,
1926 and ending with the Lean& of June 18, 1926.

It was moved by Conle,:, duly seconded by Wheeler, that the Clerk be instructed
to insert said Affidavit of Publication as a part of the minutes of this meeting.

Thereupon the Mayor announced that this •gas the time for the consideration of pro-
tests filed against the creation of local improbement district No. 6 and the - making if
proposed improvements therein. The Cler): stated that no protests had been filed against
the creation of local improvement district No.6 and the making of the proposed improvements
therein. Thereupon Councilman Wheeler presented the following resolution and moved its
adoption:
RESOLUTION NO. 27
WHEREAS, heretofore and an the 7th day of June,A.D.,1926 Ordinance No. 422 entitled:
"An Ordinance declaring the intention of the Council of the City of li aldwell,Idaho, to
create and establaih Local Street Imrpovement District No. 6 of the city of Caldwell. Idaho,
for the purpose of paving certain streets and alleys therein, stating the streets and
alleys upon which said improvement is to be madem and the pdints between which said improve,
meat is to be made, the generaloharactar of said proposed improvements, the estimated cost
of the same, and that such cost is to be assessed against the property abutting,fronting,
contiguoua or tributary( and included in the assessment district herein provided) on such
streets to be improved; and fix the time within which protests against said proposed
improvements may be filed in the office of the City Clerk, declaring the intention of the
Mayor and Council to provide for the coat and expense of such improvements by issuing
i bonds of the said district, repealing all ordinances, resolutions, and orders, or parts
i thereof in conflict herewith, and decllring an emergenoy; "was duly passed and approved
dec]a ring the intention of the Counoil to create Local Street 1mrpovemelt District No. 6
in the City of Caldwell,Idsho, for the construction of pavement therein; and,
WHETMAS said Ordinance No, 422 was duly publsihed as provided by law £n two oonsecu £ve
issues of the Caldwell l41bune, the official newspaper of said City, publishAd and of g
circulation therein, before the time fixed in said Ordinance for the filing of protest
against said proposed improvements by the ownersm of lands and lots abutting on said im
and included imsig. said assessment district; and,
MIEREAS, the original Pabliahers Affidavit of the publication of said Ordinance N0.4
aforesaid , has filed with the City Clerk;andr
WHEREAS, no protests have been filed agaiant the creation of said Local Street Improve
District No. 6, or the proposed improvements to be made therein; now, therefore, be it
Resolved by the Mayor and Council of the City of Caldw -11, Canyon County, Idaho.-
Section 1. That the Mayor and City Council proceed with the work of establishing and
creating Local btreet Imppovement District No.6 in the City of Caldwell,ldsho, and the
constructionof the pavement therein, as provided by Ordinance No. 422, passed and appoo
June 7th, 1926 W.C. DYER

The motionfor the adoption of said Resolution was duly seconded by Conley. The qv
being, "SHALL THE RESOLYTION PASS?" The Mayormddirected the Clerk to call the roll, whit
resulted as follows:
AYES: CONLEY, KIMBROUGH, MUMPOT.?D, AND WHEELER.
NAYES: NONE,
ABSENT: DUTTON AND MOCONNEL.
Whereupon the Mayor declared the motion carried and Resolution No..27 adopted, and dil
the Clerk to record the same upon the journal of proceedings off the Council, as a part
minutes of this meeting; and thereupon the Mayor and Clerk in open session of the Count
duly signed and aT•proved said Resolution.
Thereupon Councilman Mumford introduced Bill No.17.by Dutton, entitled:
"An ordlasnoe creating and establishing a Local Imppovement District to be called '
Street Improvement District No.6 in the City of Caldwell, Canyon County, Idaho;desigi
the streets and points between w ^ich said improvement shall be made, and providing for
construction of pavement thereon;providing that the coat and expnese of said improvemei
be taxed and assessed upon all the property in said improvement distriot fronting or a'
or contiguous or tributary to theporyiona of siad streets so i- .proved; and presorib£ng
method desanh assessment and thepayment therof; repealing all ordinances, resolutions
or parts thereof , in conflict herewith, and decalring an emergency." Bill No. 17 was
read in fall by the Clerk and considered by the Council.
The Chief of Police reported that the office of the position of city poundmaster we
by reason of the sale by Ed Campbell of his interest in the livery barn and corral her
used% as the city pound. Thereupon it moved by Conley,duly seconded by Kimbrough, that
Luellen be appointed pound master to fill theunexpired term of Ed Campbell.Motion m ar
The Clerk presented the application of J.Weil for license for the operation of a pool
and card room on gimbell Avenue in the location formerly occupied by S.J.btvesay. Acoc
the application was a check for $4.17.Thereuptn the Chied of Police reported that the
had been in operation several days without a license. Itwas then moved by Mumford. dul
seconded by 4heeler, that the application of J. 77sil for license for poll hall and ea:
room be re�eoted and the City Clerk be directed to return the check attached to suol
application, and that the Chief of Police be directed to 0118e suvh pool hall if it
to opaate. Motion carried.

The Caldwell State - ank presented its a plication to be designated as a depository
of the funds belonging to the City of Caldwell and tendered a trust receipt leaned
by the First National Bank of Idaho, covering w10,000.00 of the United States Second
L iberty Loan Bpnd No.000123438.Thereupon the Council proceeded to examine the
securities in its possession deposited by the depositories to secure funds of the
City now on deposit. The following trust reoeipte heretofore deposited with the City
Treasurer by the First national Bank of Caldwell were examined:
Trust receipt issued by Continental National ° ank of , alt F ake City, Utah,
covering 10 $1000.00 City of Caldwell, buniaipal Coupon Street improvements Bonds
dated July let, 1925, numbered 25,26,27,28,29, 30, 31, 32, 33, and 34, with coupons
attached beginning with the coupon maturing Huly let, 1926;
Trust receipt issued by the Continental National Bank of Salt L ake City, Utah, for
10 $1000.00 Notus- Parma Highway District Bonds , dated October let, 1925,numbered
46,47,48, 49, 50, 61,52, 63,64, and 66, with coupons attached beginning with coupon
maturing July let, 1926;
Three trust receipts issued by the Continental National yank of Salt Lake City,
Utah, for United States Second Liberty Loan Bonds, numbered 000079753,000071188, and
300080620, in the sum of $5000.00 each and trust receipt issued by the same bank for
$10,000.00 Third Liberty Loan Bond No.114316; agggegatinga total of $45,000.00.
Whereupon Rumford presented the following resolution and moved its adoption:
RESOLUTION NO. 28,BY R04FORD,
A Resolution in compliance with the provisions of Chapter 256,Laws of 1921,of the
State of Idaho, as amended by Chapter45, ''awe of 1925,of the State of ydaho, redbting
to deposits of municipal funds.
Be it resolved by the Mayor and Council of the City of Caldwell:
Section 1. That the First National ' of Caldwell,Idaho, be and the same is
hereby redesignated as a depository of the funds belonging to the City of Caldwell,
and that the Caldwell State Bank of Celdwell,Idaho, be and the same is hereby
designated as a depository of the fu de belonging to the City of Caldwell, end that
the City Treasurer of the City of Caldwell, is hereby authorized to keep on deposit in
the First National Bmik of Caidwell,Idaho, not to exceed the sum of $60,000.00, and is
hereby authorized to keep on deposit in the Caldwell s tate Bank of Caldwell, Idaho,
not to exceed the sum of v30,000.00, of thefunds coming into the hands of the
Treasurer by virtue of his office; provieid however, that at all times such depositories
shall keep on deposit 7'ith the City Treasurer securities sufflcient to protect the
deposits carried by suh depositories from time to time.
Section 2. T#6t the securities offered by said depositories and in the
possession of or under the custody and control of the City Treasurer, having been inv0s-
tigated by the finance Committee of the City Council of the City of Caldwell, and
foundsufficiant, is hereby deoalred to be sufficient securities for the funds now on
deposit in said depositories, as contemplated by the provisions of the state depository
law, as defined in Chapter 256 of the Laws of 1921, State of Idaho, as amended by
Chapter 45 of the Laws of 1925, ° tats of Idaho.
Section 3. That the City Clerk of the City of Caldwell is hereby authorized and
directed to give notice in writing to the Treasurer of the City of Caldwell, of the
Maximum amount which the Treasurer shall keep on `epoist in tIr depositories herein
designated, as required in Section 16 of Chapter 256, "awe cE the State of Idaho
of 1921, as amended by Section 4,of Chapter 45 of the Laws of 1926, ''tote of Idaho.
Section f. That the City Treasurer of the City of Caldwell, is hereby directed
said depositories to deposit additional. securities from time to time, so that at all times
there shall be in possession of the City Treasurer or under his custody or ocmtrol securities
deposited by ouch depositories aufffioient at all tirm s to secure the deposits of said C ty as
required by low.
Section 5. That the City Treasurer of the City of Caldwell, is hereby authorized and
directed to deposit with the County Auditor of Canyon County, such securities as may fr time
to tics come into his possession or under his custody and controls as security for the epodi6t
of funds of said City of Caldwell.
The motion fof the adoption of said Resolution was duly aeooniid by Kimbrough. Th question
being !,!Shall the Resolution pass?" The Mayor directed the Clerk to call the roll, which resulted
as follows:
AYES: CONLEY, KIIRBOUGH, MWORD, AND WHEELER.
NAYES: NONE.
ABSENT: DUTTON AND MCCONNEL.
Wheredpon the Mayor deaelred the motion had aocried and the Resolution No. 28 adopted and
directed the Clerk to record the same on the hournal of proceedings of the Council, as part of
the minutes of this meeting, and thereupon the Mayor and Clerk in open session of the ouncil
dulysigned and apporved said Resolution.
It was noted on motion of Kimbrough, seconded by Mumford, that the City purchase a ohn
Deere Mower at the price of '095.00.
It was moved by Mumford, duly seconded by Wheeler. that the Council adjourn to Wee esday
Juna 23rd, 1926 at 8 P.M.. Motion Carried,
