Page 100 The Mayor welcomed everyone and asked Bishop Bob Christensen of the LDS Church to lead in prayer. Everyone remained standing for the Pledge of Allegiance to the Flag. The Roll of the City Council was called with the following members present: Blacker, Oates, Hopper, Callsen, Dakan and Wells. Absent: None SPECIAL PRESENTATIONS Mayor Nancolas presented the Employee of the Month plaque to Doug Brown, Caldwell Fire Marshal. He read a letter from Fire Chief Wendelsdorf nominating Mr. Brown for this award. Mayor Nancolas read the names of the committee members from the Caldwell Core Area Steering Committee: Bob Carpenter (Chairman), Gina Lujack, Patty Rector, Bob Jenkins, Steve Fultz, and Tom Ensley. He expressed appreciation for their service for the past 4 1/2 years. Bob Carpenter and Gina Lujack were present and accepted plaques presented by Mayor Nancolas. ADDITIONS OR DELETIONS TO THE AGENDA MOVED by Wells, SECONDED by Oates to amend the agenda by deleting Item #6 under New Business and adding Item #8 under the Consent Calendar to appropriate $7,500 of contingency funds for the purpose of electrical upgrades to the City's portable generator. MOTION CARRIED AUDIENCE PARTICIPATION Glen Grossenbach, 601 South 13"' Avenue, addressed the Council concerning working as a community to resolve our over - crowded jails and criminal problem. He suggested that community workshops be conducted to resolve this problem. CONSENT CALENDAR: The Mayor presented the following items on the Consent Calendar for approval by the Members of the City Council: 1. Approve acceptance of the minutes from the Regular City Council meeting held on June 5, 2006 and the Caldwell Traffic Commission held on June 5, 2006; 2. Approve Order of Decision for Case No. SUB- 109(1)F -04 for Whitney Springs Subdivision #1 Final Plat; 3. Approve Order of Decision for Case No. SUB- 94F -03 for Newbury Subdivision Final Plat; 4. Approve Order of Decision for Case No. SUB- 58B(6)F -06 for Blackhawk Subdivision #6 Final Plat; 5. Approve Resolution #90 -06 authorizing the execution of the AIP Grant Agreement with the Federal Aviation Administration for consultant services and construction at the Caldwell Industrial Airport; 6. Approve Resolution #88 -06 authorizing the execution of the Local/State Agreement with Idaho Transportation Department (ITD) for the Caldwell Train Depot Rehabilitation, Phase I, Construction Consultant Contract Services with Cole + Poe Architects; 7. FOR A 30 -DAY EXTENSION FOR THE FINAL PLAT OF SKY RANCH BUSINESS CENTER NO. 1 PHASE 2) Brian Billingsley presented the staff report and outlined the facts concerning the 30 -day extension. Jamie Hoover from Freehold Development, 3994 West Quail Ridge, Boise, stated his desire to extend the final plat for a 30 -day extension. In response to questions from Council Member Wells, Mr. Hoover reported that over 50 percent of the punch list items have been completed. MOVED by Blacker, SECONDED by Oates to approve a 30 -day extension for the final plat of Sky Ranch Business Center No. 1 Phase 2. Those voting yes: unanimous. (PUBLIC HEARING [LEGISLATIVE]: TO CONSIDER BILL NO. 33 [ORDINANCE NO. 26081, A REQUEST BY ECKHARDT COMPANY, INC. TO VACATE A PORTION OF AN INGRESS, EGRESS, AND UTILITY EASEMENT OVER AND ACROSS A PORTION OF CHARMAE STREET, WITH A REQUEST TO WAIVE THE RULES AND PASS ON THE FIRST READING) Gordon Law presented the staff report and outlined the facts as written. Brian Billingsley presented the staff report and outlined the facts as written. Jed Wyatt of Landmark Engineering, 104 9"' Avenue South, Nampa acknowledged being sworn in and spoke in favor of this development. He presented a large subdivision plat map, which Mayor Nancolas labeled as CC -1000. Mr. Wyatt noted that the proposed development abuts the existing Pheasant Run subdivision and includes walking paths /stub streets to neighboring properties. BOOK 47 Page 102 In response to a question from Council Member Hopper, Brian Billingsley noted that there is connectivity across the northern portion of the Solomon Drain from previously approved Pheasant Run developments. He noted that there is no connectivity to the east of the development by the Copper Creek Subdivision. MOVED by Blacker, SECONDED by Hopper to close the public testimony portion of this hearing. ANN- 117 -06: MOVED by Hopper, SECONDED by Blacker that based on the Findings of Fact and Conclusions of Law, the Caldwell City Council orders that Case No. ANN - 117 -06, a request by Landmark Engineering and Planning to annex approximately 21.65 acres into the City of Caldwell as R -1 (Single - Family Residential) zone designation, to include a development agreement spelling out the terms and arrangements of the rezone, and also to include a Comprehensive Plan Map Amendment designating the property for low- density residential use is hereby approved with the conditions as outlined in the staff report. SUB- 144P -06, A REQUEST BY JOHN EVANS FOR PRELIMINARY PLAT APPROVAL OF CUMBERLAND ESTATES SUBDIVISION CONSISTING OF 155 RESIDENTIAL LOTS AND 9 COMMON LOTS.) Mayor Nancolas declared the public hearing open. Brian Billingsley presented the staff report and outlined the facts as written John Evans, 5699N. Riffle Way, Garden City acknowledged being swom in and spoke in favor of this development. In response to questions from Council Member Hopper, Mr. Evans stated that their landscape plan includes berms along the 10"' Avenue corridor and not only privacy fencing. He noted that fencing would also be included along the perimeter of the development. Mayor Nancolas asked if the privacy fencing issue, as noted within the P &Z Commission testimony, had been resolved with the neighbor. Mr. Evans responded that fencing would be provided along the west boundary ( Ustick Road to the Phyllis Canal) which will keep children from entering and molesting the neighboring farm property. Sheila Dines, 413 Parkhurst, acknowledged being sworn in and read a letter into the record regarding privacy fencing between the proposed site and the neighboring farm property, which Mayor Nancolas labeled as CC -1000. Dean Strange, 205 West Ustick, acknowledged being sworn in and spoke as neutral to the development. He addressed his concerns regarding children from the proposed development bothering his cattle, the right to continue farming his parcel, and the lane which divides the two properties being accessed by residents of the subdivision. In rebuttal, Mr. Evans clarified that the access right -of -way referred to by Mr. Strange runs west of the property between Ustick Road and the Phyllis Canal. He noted that this right -of -way is part of the proposed development and will not be available for access purposes upon completion of the subdivision. He noted that there is a right to farm provision included on the plat. MOVED by Oates, SECONDED by Hopper to close the public testimony portion of this hearing Roll call vote: unanimous. SUB- 142P -06 AND ANN - 115 -06, A REQUEST BY BRIGGS ENGINEERING FOR ANNEXATION OF 101.30 ACRES AS R -1 (SINGLE- FAMILY RESIDENTIAL) ZONE, TO INCLUDE A DEVELOPMENT AGREEMENT, A COMPREHENSIVE PLAN MAP AMENDMENT DESIGNATING THE SITE LOW- DENSITY RESIDENTIAL, AND PRELIMINARY PLAT APPROVAL OF JORDAN MEADOWS SUBDIVISION CONSISTING OF 318 RESIDENTIAL LOTS AND 19 COMMON LOTS) Mayor Nancolas declared the public hearing open. Brian Billingsley, 621 Cleveland Boulevard, acknowledged being swom in and presented the staff report. He read a memorandum from Brent Orton from the City Engineering Department recommending that the three out parcels associated with the development provide right -of -way improvements, which Mayor Nancolas labeled as CC -1000. In response to questions from Council Member Oates, Mr. Billingsley stated that the development was not located within the airport overlay zone. Mark Hilty, 1303 — 12"' Avenue Road, Nampa acknowledged being sworn in. He noted that the out parcel recommendation by the City Engineering Department is a policy and not a City ordinance. He emphasized that if the development was not approved by Council at this time, annexation should also be deferred. Sebrina Whitehead, applicant's representative of 1800 West Overland Road, Boise, acknowledged being sworn in. Ms. Whiteheld spoke in favor of the application. She clarified that the applicant was Jordan Meadows, LLC and not Briggs Engineering as stated within the staff report. She reported the applicant's opposition to improving frontage along the three out parcels as stated within the development agreement under Items #10 and #40. She reported that the parcels had been split from the original parcel over three years ago. Josh Wilhelmsen, 18037 Midland Boulevard, Nampa acknowledged being swom in. He read a letter of opposition concerning right -of -way improvements along his parcel frontage, which Mayor Nancolas labeled as CC -1001. Glenn Jordan, 18181 Royal Way, Nampa acknowledged being sworn in. He read a letter of opposition concerning right - of -way improvements along his parcel frontage, which Mayor Nancolas labeled as CC -1002. Mr. Jordan clarified that the out parcels are 1.56 acres in size. Brian Niblett, 18165 Midland Boulevard, Nampa acknowledged being sworn in and read a letter of opposition concerning right -of -way improvements along his parcel frontage, which Mayor Nancolas labeled as CC -1003. He noted concerns regarding widening of the road which would require the existing power poles to be relocated closer to his house. Douglas Jordan, 1470 Whitewater Court, Nampa, acknowledged being swom in and spoke in favor of the application. He noted that he has been involved in the landscaping business for over fifteen years and has provided additional landscape features within the proposed development. Lee Jordan, applicant of 18439 Midland Boulevard, Nampa was sworn in by the deputy city clerk. He spoke in favor of the application. He expressed his concern with the road widening requirement since it would interfere with existing power poles and gas lines along the right -of -way. John Marshall, 601 W. Bannock, Boise was sworn in by the deputy city clerk. He reported that he represents the applicant, Jordan Meadows, LLC. John Howell, 203 W. Main Street, Boise acknowledged being sworn in and spoke in favor of the application. In rebuttal, Ms. Whitehead again stated opposition to the out parcel frontage improvements as proposed by the City and requested that Items #10 & #40 of the development agreement be waived. She stated that they are proposing a 4 -foot, paved walking path in front of the out parcels to be located within the 24 -foot right -of -way. In response to questions from Mayor Nancolas, Ms. Whitehead clarified that each out parcel is 1.59 acres in size. BOOK 47 Page 105 In response to questions from Council Member Hopper, Gordon Law addressed the out parcel roadway improvement concerns and the discontinuity that could be created within the street facility. He suggested additional research be conducted by staff concerning the dates which the out parcels were created and improvements to the right -of -way. MOVED by Hopper, SECONDED by Callsen to continue the public hearing with the testimony portion open to a time and date certain, which would be July 5, 2006 at 7:00 p.m. Council Member Hopper stated that Item #4 (page 6) of the staff report should be corrected to read: "Midland Road is classified as a Minor Arterial. The applicant shall be required to dedicate as public right -of -way a forty -five (45) foot one- half width right -of -way along the Midland Road frontage (minus existing) to meet City of Caldwell requirements." Also, he noted that the staff report should be corrected to show the applicant as Jordan Meadows, LLC. Mayor Nancolas stated that Council is requesting clarification on the time table involving the creation of the out parcels and staff should work with the applicant concerning a right -of -way improvement plan. MOTION CARRIED (FINANCE AND HUMAN RESOURCE REPORTS) Councilman Wells reported that the Finance Committee has reviewed current accounts payable in the amount of $815,742.13 for the period ending June 14, 2006 and a net payroll in the amount of $211,800.76 for the pay period ending May 27, 2006 and in the amount of $215,083.30 for the pay period ending June 10, 2006. MOVED by Wells, SECONDED by Callsen that accounts payable in the amount of $815,742.13 represented by check numbers 35704 through 35945 and the total payroll in the amount of $426,884.06 represented by check numbers 10127 through 10427 and direct deposits be accepted, payments approved, and vouchers filed in the Office of the City Clerk. Those voting yes: unanimous. MOTION CARRIED (COUNCIL COMMENTS) Councilman Oates reminded the Council Members that he will be gone from June 22 through the first meeting in August. He requested that the conference telephone system be used so that he can participate in the sessions. The City Clerk will make the arrangements for teleconferencing. Councilman Hopper suggested that the subdivision packets include maps showing surrounding subdivision boundaries and platted stub streets in order to not overlook potential connectivity issues. Brian Billingsley and Gordon Law will discuss how this information can be provided. Councilman Blacker reported that he has heard many positive remarks concerning progress on the Sky Ranch Business Park facility and the "Clean Sweep" project. Councilman Wells stated that he is looking forward to the July 4 event and the new generator being used. (MAYOR'S COMMENTS) Mayor Nancolas noted that letters of appreciation were received by the Boy Scouts concerning the outstanding condition of Curtis Park for their jamboree since it was cleaned up by the Street and Parks Department. City Council budget workshops will be held on June 20"' and 21s at 6:00 p.m. at the Caldwell Police Department community room. The Mayor reported that he and Gordon had recently attended the Economic Development Association (EDA) presentation in Seattle. He reported that the EDA board stated that the City of Caldwell has met the job creation requirements for the industrial park grant and they look forward to our next application. He stated that they also attended an FAA meeting which was very informative. It was determined that the airport terminal does qualify for FAA funding; however, land acquisition figures were not as high as originally anticipated. FAA encouraged the City to apply for funding and it was reported that the Caldwell Municipal Airport is the second busiest airport in the State of Idaho. The Mayor reported that six students from the Mayor's Youth Advisory Council attended the AIC conference which was mainly paid for through their fund raising efforts. He noted that funding of public transportation issues was heavily discussed. The Mayor presented information packets to Council Members concerning the proposed Corridor Public Access Management Plan Agreement from COMPASS and the 2007 -2011 Transportation Improvement Program Plan for the Nampa Urbanized Area for their review.
