The roll of the Council was called with the following members
present: Gamboa, Dakan, Carter, McCluskey, and Williams. Absent:
Banks.
(REPORT - TRIP TO SEATTLE REGARDING NEW AIRPORT)
Bob Tunnicliff, the City Attorney, stated that he, the Mayor,
and Doyle Mecham made a trip to Seattle on Friday, June 13th,
1975, to deliver the acceptance of the Construction Grant,
approved by the Council at the Regular Meeting on June 3, 1975,
to make sure that there was no misunderstanding of the City of
Caldwell's ability to comply with the Grant. Another purpose
of the trip was for informative reasons; to inform the F.A.A.
as to the progress being made by the City of Caldwell as well
as verifying the F.A.A.'s understanding of the City's
limitations at this time regarding the Court proceedings pending
regarding the new airport. The City Attorney said that the
F.A.A. was pleased that they had delivered the Grant in person
and Mr. Tunnicliff as well as the Mayor and Mr. Mecham were
pleased with their meeting with the F.A.A. One of the things
discussed was a conditional award to the construction contractor
subject to the City not being restrained and subject to the City
acquiring the property.
(CONSTRUCTION AWARD - ASPHALT PAVING AND CONSTRUCTION CO., INC.)
The Mayor stated that the bid opening for the new airport was
held on May 16th, 1975, and was awarded to Asphalt Paving and
Construction Co., Inc. of Boise. A Notice and Construction
Award were drawn up to present to Asphalt Paving and Construction
Co., Inc.,'which they have already agreed to. The Mayor read
the Notice and Award as follows:
N O T C E
Written notice is hereby given that on or about the
16th day of June, 1975, the City Council, City of Caldwell,
State of Idaho, awarded the contract in the matter of the
Caldwell Industrial Airport construction to Asphalt Paving
and Construction Company, Inc., subject to conditions and
provisions set forth in the attached Award which is incorporated
and made a part hereof as though set forth in full.
Notice is further given that a contract of award
will be submitted to Asphalt Paving and Construction Company,
Inc., on or before December 15, 1975, subject to the terms
and conditions set forth in the invitation to bid in Project
No. ADAP 8- 16- 0045 -02, and the terms and conditions of the
award adopted by the City Council, City of Caldwell, State of
Idaho, June 16, 1975.

WHEREAS, Sealed bids having been opened and read, in
accordance with the law, and at the time and place and-as

provided in the invitation of bids, on a contract to construct
the Caldwell Industrial Airport, and it having been determined
upon the finding and report of the City Engineer that Asphalt
Paving & Construction Company, Inc. is the lowest qualified
bidder;
IT IS HEREBY ORDERED, This 16th day of June, 1975, that
the contract be awarded to Asphalt Paving & Construction
Company, Inc., that the City Attorney prepare the contract in
a form in compliance with the law and ordinances, and that the
same promptly be entered into by the Mayor on behalf of the
City of Caldwell, and be signed by the Mayor for the City
and attested by the City Clerk under the corporate seal of
the City.
IT IS HEREBY FURTHER ORDERED, That said contract and
this award is subject to the condition that the City of Caldwell
acquire all real property at the Caldwell Industrial Airport
Site sufficient to construct said facilities on or before
December 15, 1975, and subject to the further condition that
no court of competent jurisdiction enter a restraining order,
injunction, or other decree enjoining and /or restraining the
City of Caldwell from proceeding with the land acquisition
and /or construction of the Caldwell Industrial Airport.
In the event the City does not acquire all real property
at the Caldwell Industrial Airport Site prior to December 15,
1975, and /or in the event the City is enjoined and /or restrained
by any court of competent jurisdiction from constructing the
Caldwell Industrial Airport, then. and in that event, this award
shall be null and void„ and of no force and effect in law.
Further, the City Attorney is directed to incorporate said terms
in said contract providing in addition thereto that in the
event any of the conditions hereinabove set forth should
occur on or before DecE >mber 15, 1975, then and in that event,
the contract shall become null and void, and of no force and
effect, and no damages shall be awarded either the City of
Caldwell and /or Asphalt: Paving & Construction Company, Inc.
as a result of this award and /or said contract.
By vote of the City Council of the City of Caldwell, State
of Idaho, this 16th day of June, 1975, the following councilmen
voting yes
and the following councilmen voting no
APPROVED By the Mayor of the City of Caldwell this 16th
day of June, 1975.
MOVED by McCloskey, SECONDED by Camboa that this Notice and
Award be accepted and sent to Asphalt Paving and Construction
Co., Inc. in Boise, Idaho.
The Mayor called for a roll call vote. Those voting yes:
McCluskey, Williams, Gamboa, Dakan, and Carter. Absent and
not voting: Banks.

Further discussion was held concerning the new Airport. Mr. Mecham

assured the Council that he felt there would be very little
problem with the power company concerning subordination of
power easements as he had already contacted them and he felt
they would be cooperative.
Councilman McCluskey expressed his appreciation to the City
Attorney and to Doyle Mecham for their time and their help
regarding the new airport.
There being no further business, the meeting was adjourned at
4:40.
