June 13, 1910. Council met in regular session pursuant to adjournment with Mayor Gowen presiding and Councilmen Devers, Farrar, Gartin, Harris, Paynter, present; Shorb, Clerk. H. D. Blatchley files written protest against College Heights Addition being included in Local Lateral Sewerage Improvement DistiTt No. 2, and on motion of Farrar, the Collegd Heights Addition was excluded from said district. Letter of Edward Redden respecting certain sidewalks was read and referred to City Engineer. Councilman Clark enters during reading of Bill No, 42, Bill No. 42 by Gartin, entitledt, "An Ordinance fixing the fire limits in the City of Caldwell, Idaho, and providing for the prevention of fire therein, providing for the erection and inspection of buildings therein. the appointment of a building inspector, specifying his duties and compensation, repealing all ordinances in con- flict with this ordinance, and providing a penalty for the Violation thereof" was read the second time by title and the third time in full and placed on its final passage. On the question, Shall Bill No. 42 pass7 the roll being called, the vote resulted: Ayes -- Clark, Devere, Farrar, Gartin, Harris - -5. Nays - -0. Absent--- Paynter. So Bill No. 42 passed, becoming Ordinance No. 172 The time coming on regularly for the hearing of protests against the establish- ing(.df Irocal Lateral Sewerage District No. 3, and there being no protests filed, the same was approved. i Bill No. 57 by Devere, entitled, An Ordinance declaring the intention of the City of Caldwell, Idaho, to establish within the limits of the said city a local improvement district to be called Local Lateral Sewer Improven sit District No. 4. and the intention of said city to establish therein a lateral sewdrage district" was read the first time. A motion we ado by Farrar that the rules be suspended and the readings on three separate days be dispensed with and that Bill No. 57 be read the second time by title and the third time in full and placed on its final passage. The roll being 11 called on the ipotion, the vote resulted: Ayes -- Clark, Rovers, Farrw Gartin, Harris - -5, Naya - -0.. Absent -- Paynter. So the motion prevailed. Bill No. 57 read second time by title. Bill No. 57 readthird time in full and placed on its final passage. On the question, Shall Bill No. 57 pass? the roll being called, the vote resulted: Ayes -- Clark, Devers, Farrar, Gartin, Harris - -5, Nays - -0. Absent -- Paynter. So Bill No. 57 passed, becoming Ordinance No. 173. Resolution No. 57 by Farrar, providing for the construction of a sidewalk according to Plan 3 of Ordinance 148 of the City of Caldwell, Idaho, along certain streets and avenues and in frontt,of certain lots and blocks of §he said city, and providing for the payment of such construction by an assessment levied and assessed against the property fronting and abutting on said sidewalk ", was read. The roll being called, the vote resulted: Ayes -- Clark, Devers, Farrar, Gartin, Harris - -5. Nays - -0. Absent -- Paynter. So resolution No. 57 passed. A motion was made by Harris that the claim of the Kennedy Construction No. in the sum of $1117.43 for Beware, be allowed and that warrants for the same be drawn on the General Fund. The roll being called on the motion, the vote resulted: Ayes -- Clark, Devers, Farrar, Gartin, Harris - -5. Nays - -0. Absent -- Paynter. So the motion Travailed. The following resolution was introduced by Clark. - WHF.RFAS, The National Humane Society New York City has offered to donate one of their beautiful animal drinking fountaind to the City of Caldwell, provided the City of Caldwell complies with certain conditions, viz: That the City of Caldwell will take the fountain from the care, place the game on a good foundation where there Is a large passing traffic, and where it can be approached from all sides, put in first class water connections, and quarantee ample and continuous water supply and proper permanent care, Resolved That the City Council on behalf of the people of the City of Cald- well, accept the fountain so graciously donated by the National Humane Alliance of New York City, and that we comply with each and every of the above particulars, and that the City Fngineer is hereby Instructed to have the same on its arrival, taken from the car and placed on a good and suitable foundation in the center of the inter- section of Arthur Streets and Sixth Avenue, and have the same connected with the City water mains, and the Superintendent of Water Works is'hereby instructed to supply the same with water at all times, and keep the same supplied with water, and be it further "I 3� a Resolved That the City Council on behalf of the people of the City of Caldwell hereby tenders to the said National Humane Alliance of New York City a vote I I of thanks for its kind donation of one of their beautiful animal drinking founatains, and that these resolutions be spread at length upon thr minutes and a copy thereof be furnished by the Clerk to the said National Humane Alliance. The roll being called on the motion, the vote resulted& Ayes -- Clark, Devers, Farrar, Gartin, Harris - -5. Nays - -0. Absent -- Paynter. So the resolution passed. Voted, on motion of Devers, that Council adjourn until June 20, 1910 at 8 P. m G G Monday, June 20, 1910. A motion was roads b; Farrar that the City Treasurer is hereby instructed to turn over to the Warren Construction Co., in exchange for warrants, $25,000.00 in Special Improvement Bonds, the said CompanYto pay accrued interest to the date of approved estimates. The roll being called on the motion, the vote resulted& Ayes -- Devers, Farrar, Gartin, Harris, Paynter - -5. Nays - -0. Absent- Clark. So the motbn prevailed, F. L. Thomas filed bond to tap sewers, which bond, on motion of Devers, was referred to the City Attorney. Bill No. 58 by Farrar, entitled, "An Ordinance to establish a Local Lateral Sewer Improvement District. ln.the City of Caldwell, Idaho, to provide for the appoiir- ment of a sewerage committee and conferring upon them certain powers, to provide for the construction of a system of lateral sewerage and sewerage disposal works in said improvement district ", was read the first time. A motion wgs made by Harris that the rules be suspended and the readings on three separate days be dispensed with and that Bill No. 58 be read the second time by title and the third time in full and placed on its final passage. The roll. being called on the motion, the vote resulteds Ayes--Devers, Farrar, Gartin, Harris, Paynter - -5. Nays - -0, Abdent-- Clark. So the motion prevailed. Bill No. 58 read second time by title. Bill No. 58 read third third time in full and placed on its final passage. On the question, Shall. Bill No. 58 pass? the roll being called, the vote resulted: Ayes -- Devers, Farrar, Gartin, Harris, Paynter - -5. Naya - -0. Absent -- Clark. So Bill No. 58 passed, becoming Ordinance No. 174.
