Pursuant to adjournment of the Regular Monthly Meeting held on May 5th., 1941,
the Council met in the 8ouncil Rooms with the Mayor H.E. McCluskey presiding.
On Roll Call the following Councilmen answered present% Thurlow Bryant, Wilbur
Dakan, Floyd Blunt, E.E.Frasher, Fred E. Newman and C. 0. McDonnel.
The Council Frocoeded to consider the annual appropriation bill.
W - hEUPON, Councilmen Bryant, presented the following Resolution and moved the
Adoption thereof, which motion was duly seconded by Councilman Blunt:
BE IT RESOLVED, That the following is an estimate of theexpanditures of the City
of Caldwell for the fiscal year 1941 -1942, and that the following be, and is hereby, adopt-
ed, and the following is an estimate prepared by the 1 ''3yor and City Council of the am ity of
Caldwell, Canyon County, Idaho, for the probable amount of money necessary for all purposes
to be raised bytaxation in the City during the year beginning May, 1, 1941, including
principal end interest due on bonded indebtedness and sinking funds, itemizing and class-
ifying the several branches of expenditures as nearly as may be, to -wit:

Section 11. That before the passage of the said appropriation bill and before
said levy be made, a public hearing beg ranted and that a aid , public hearing is hereby called
and ordered tote held at the 'ity Hall of said City at the hour of eight o'clock 9.M „ on
the 23rd day of June, 1941, upon the said estimate and proposed appropriation bill.
Section 111. That notice of the meeting of public hearing shall be given by at
least two publications in the Saturday issue of The Caldwell News- Tribune, a daily news-
paper, printed and published in the City of Caldwell, Idaho, which said newspaper has, in c
conformity with Chapter 154 of the 1933 Session Laws of Idaho, in each issue at the head
of the Editorial Column announced the day of the week on which legal notices required by
l or by Order, of any Court of competent jurisdiction to be published weekly will be
published, and which notice shall be in substantially the follwing form, to -wit:

The City Council and Trayor of the City of Caldwell, Canyon County, Idaho having
determined at a meeting duly and regularly called and held in the City of Caldwell, Idaho,
on the 9th day of June, 1941, that said City willTrequire a tax levy for general purposes
in excess of tmi mills to raise sufficient money for general purposes, as provided by law,
for the fSsoal year beginning May 1, 1941, and as fully set out in the estimate of ex-
penditures of the City of Caldwell_, Idaho for the fiscal year beginning May I 1941, duly
adopted, passed and a pproved by said Vayor and Crnincil at §aid meeting of June 9th, 1941,
and appearing in the minutues of said meeting, held on Said date; and said Ma'aor and
Council having determined at said meeting that it will be necessary to pass an appropriat
bill appropriating in excess of ten mills for general purposes of said City for said fisca
year;

Section 1V. That the said notice shall be the same as hereby ordered, and that
the City Clerk of the City of Caldwell is hereby ordered, authorized and directed to
cause said notice to be published as hereinnbove meRtioned.and to secure proof of said
publication.
A "Yes ". and "no" vote was had on said Resolution with the following results,
to -wit:

WhEREOPON, the Mayor declared the motion carried and the Resolution duly adopter
The City Clerk read a letter from A. B.Cooper, President of the Homesteaders
Stock -Fhows -Night Rodeo Assoc., requesting a permit to operate the Monte Young Shows from
August 4 to August 9th, also, walver of license fee and that no permit be issued to
another carnival or show during the period between July 1, and August 9.
Moved by Newman, seconded by Frasher that this request be granted and the
license fee cancelled. Motion c arried.
Mr. Oscar Stengel appeared and called attention to the Zoning Ordinance and
stated that it should either be enforced or amended, also, that the Sanitary conditions ir.
the City should be investigated.
The Mayor ddviaed?that these matters would be taken under consideration.
Tt was moved by Bryant, seconded by McDannel that Council adjourn to meet June
23rd., 1941, at 9 :00 P. M. Motion carried.

Pursuant to adjournment of June 9th., 1941, the Council met in the Council Rooms
with the Mayor H.E. McCluskey, presiding.

Daken, Floyd Blunt, E.E.Frasher, Fred S. Newman and C. 0. McDannel.
Moved by Daken, seconded by Frasher that Indiana Avenue be oiled. Motion carried
Moved by McDannel, seconded by Daken that CbuncilmO-n'arise and address the Chair
before presenting business to the Council. Motion carried.
This being the time date set for hearing protests against the proposed estimate
of expenditures of the City of Caldwell for the fiscal year beginning the first day of
May 1941. The said estimate and tax levy being inexcess of 10 mills for general purposes.
The Clerk presented the affidavit of publication of said notice wtiich is in
words and figures as follows:

L. L. SHEPHERD, being first duly sworn, deposes and says: That lie is the
Foreman of Caldwell News - Tribune, Inc., publisher of The Caldwell News - Tribune, a daily
newspaper published at Caldwell, Idaho, within the meaning of Chapter 154 of the 1933
Session Lpws of Idaho; published six consecutives days a week except legal holidays. And
that the publisher of said THE CALDWELL NEIL'S- TRIEUNE, a daily newspaper, has all the time
since the 5th day of July, 1933 and in each issue thereof, at the head of the editorial
column of said newspaper, announced the day of the week to -wit: Saturday, on which legal
notice required by law or by order of any Court of competent juri!�diettan to be published
weekly, will be published; that the said paper is in general circulation in Canyon County ,
Idaho and has been for a period of seventy -eight weeks preceding the first publication of
this advertisement, a copy of which is attached hereto, and by reference thereto made a
