COUNCIL CHAMBERS, JUNE 6, 1932

The Regular Monthly Meeting of the City Council met in the Council Room of the Oita
Hall, with the Yayor, Fred L. Lilly, presiding
On R011 Call, the following Councilmen answered present; A. 0. Keister, C. E. Bales
0. M. Johnston, JoeDickene and E. L. Vassar. Absent M. S. Sandmever.
The Clerk read,the Minutes for May 4th, May 9 and May 16th, which -ere approved
as read.
The Clerk read Bill No.� by Dickens, as follows:
A RESOLUTION AUTHORIZING THE CANCELLATION OF CERTAIN SPECIAL TAXES, LEVIED AND
ASSESSED AGAINST THE PROPERTY HEREIN DESORIBED.

WHEREAS, The hereinafter described lots have paid no taxes nor assessments to the
City of Caldwell, ydaho for many years prior to 1932, and
WHEREAS, Said late have teen sold by Canyon County to Nellie P. Frost for delin-
quent state, county and certain municipal taxes, and
WHEREAS, Said Nellie P. Frost has agreed to pay all taxes and assessments, in-
cluding alb. penalties, charges and interest, of Local Sever District Number 7 ( 7), levied
and assessed against said lots prior to the year 1932, and
WHEREAS, It has been determined by the Y! yor and Council of the City of Caldwell,
Idaho, that it is for the best interests of said City that all other taxes and assessments
including all penalties, charges axed interest levied,and assessed against said lots for the
years prior to 1932, be cancelled,
NOW, THEREFORE, BE IT RESOLVED, That ell special taxes and assessments including
penalties, charges and interest, levied and assessed against said lots gor the years prior
to 1932, excepting herefrom those taxes and assessments, including penalties, charges and
Interest,. levied and assessed for Local Sewer District Number Seven( 7), be and the same
axe, hereb$r cancelled and annulled, and said lots be, and the same are hereby relieved from
all liability whatsoever for the payment thereof; provided, however, that this resolution_
is not�ntended to and shall not be construed as cancelling taxes and assessments, penalties
charges and interest levied and assessed for Local Sesser District D ?umber Seven (7).
Said lots or premke @s are more particularly described as follows, to -wit:
Lots 5, 6 , 7, 6, 17, 18, 19 and 20 of mock 1, Frost Addition to the town
of Caldwell, Idaho.

AP` ORDINANCE PROVIDING FOR THE. REGULATION OF ','.OVABLE AWNINGS OVER THE SIDE+
WALKS OF THE CITY OF CALD% ^ELL, IDAHO AND PROVIDING FOR THE PUNISMITNT FOR VIOLATION
THEREOF.
BE IT CRDAINED BY THE 11AYOR A4?D COUNCIL OF THE CITY OF "ALDWELL, IDAHO.
Section 1. It shall be unlawfnl to erect or ^iaintain any awning on or over any
i•eet and- sidewelk within the limits of Caldwell, Idaho, e-cept ws herein has been
provided. __
Section. 2, All mova:cle :.innings shall be of canvass or duck and shall be affixed to
and suspend from the building. ;;wninrgs against the first or grade story of buillings shall
be of the roller type and be supported upon iron IXMXz arms so as to permit the awning to
be rolled compact against the building.
-Section 3. Awnings may extend over the sidewalk portion of the pjbli.c street a
i
distance equal to two- thirds of the width of the sidewalk; provided, that everey such.
awning frame shall be not less than seven feet and two inches ( 7ft. - Pin. ) above the
sidewalk immediately below, and that any fri.nrre attached to such awning shall be not less
than six feet and six inches( 6ft. - 6 in.) from the eidewe,lk leavel immediately below.
No awning shall project over the sidewalk in any ra.rt of Zone A or•B as dAfi.nei
in the Zoning Prdinances.
Awnings shall re maintained. in good state of repair and kept Clean, R. ragged or t
torn awning shall be removed,
Any person, firm or corporation erecting awnings over sid.ewelks, streets or alley
and against the first story, within the City limits shall first secure e permit from the
Building Inspector before srzcb on awning is erected anO shall stamp with indelible ink or
paint the permit number, the year and the hate of the permittee upon the canvas.
Any person, firm or corporation engaging in the business of erecting awnings ove
the streets, sidewalks or alleys of the City of Caldwell shall pay an annual license fee
therefor in the sum of Fifteen Dollars ($ 15.00) and no permit ehal.l be issued,until and
unless said .license fee has been paid.
Licenses shall be procured and. issued in the same manner as is provided in ordi-
nance No. 376 of the City of Caldwell, Idaho.
The Building Inspector shall upon application issue such hermit for movable
awnings when such proposed awnings.cocie within the provisions of this Ordinance and collet
a fee of $ 1.00 o,nd for such additional awning against the same occupancy $ 0.50.
It shall be unlawflrl to re -cover or make major repairs to any awning Or frame
that does not conform to this Ordinance.
Section 4. It is hereby made t = -e duty of the Police Denattment to see that the
provisigns of this Ordinance are strictly enforced. They shall notify the owner or oeoupan
of any building and pr.enisee having any a7ming or any other projection contrary to this
or any other Ordinance, to remove the same, or conform them to the requirements of the
Ordinances of the Cffity of Caldwell, Idaho.
Section 5. Any person or persons who.shall constrict any awning within the
city limits out of defective !aterial, or who shall cause, permit, suffer or alloy aucD
awning, either as owner, agent or oeeu;,ant to remain in an unsafe or insecure condition, of
from any cause so as to he dangerous to a passerby, after receiving 24 hours' notice from
the Chief of Police to re-love the same, said person or persons neglecting to remove said

T he Council proceeded to 2. consideration of the proposed Ordinance.
It wawmoved by Vassar and seconded by Dickens that the Rules requiring the reading
Bill on three senarnte days be - suspended. and that grcppsed Ordinance Flo. 50�be rea ond time by title and the third time in full, section by section, and placed on its
final passage,. The E4T r directed the Clerk to call the Roll on the motion with the follow-
ing results; Those voting in the affirmative erere, Reister, Bales, Johnston, Dickens and
Vassar. Those voting in the negative, Alone. Absent and not voting, Sandheyer.

The iiayor then declared the motion passed by the necessary three- foutthe majority
and directed the Clerk to read the proposed Ordinance the eecond time by title and the thin
time in full,. section by section. The Clerk rend the proposed Ordinance as directed. The
question then being, " Shell the nronosed Ordinance No. F02- Pass ?° The Mayor directed the
Clerk to call.the Roll with the following result. Those voting in favor were; lieister,
Bales, Johnston, Dickens and Vassar. Those voting in the negative, None. Absent and not
voting, Sand,nayer. Thereupon, the 1layor declared that the pronosed Ordinance 170.' had
passed and the Mayor , in open session of the Council duly signed and apnrovpd the Ordinan
and the Clerk. duly signed and attested the snare, which became Ordinance $o. 5OL' The Mayor
then directed. the Clerk to make Proper entry of the same and to cause Ordinance No. 5OZ to
be printed in the Opldwell News- Tribune, the official newspaper of the City of' Caldwell.
The Clerk read a request frmm the City Treasurer, asking permission to default
payment on the outstanding Bonds and Coupons in certain Im,rovement Districts as follows;
To the Honorable iiayor and Council.
The Assessments for the following Districts have all been paid or are delinquent
and there is insufficient cash on hand to gay the Bonds or the Coupons.

to notify the Oregon Short Line Rail Ro_d Company to repair their crossings at Fourth,

The following Bills were res,d and. on motion made by Dickens and seconded by
Bales that these Bills be allowed and 71arrants be ordered drain for the various amounts,
all of which had been approved by the acting Chairman of the Finance Committee.
