The regular mthly meeting of the City Council met in the Council Chambers of the City Ran with Mayor Charles W. Carpenter presiding. Upon Hall Call, the following members of the Council answered piesenti Alta E. Williams, Alfred H. McCluskey, Joe Gamboa, James R. Dnkan and Lester E. Carter. Absent: Charles C. Banks. Invocation Mayor Carpenter called upon Reverend Gerald Crownover of the First Assembly of God Church to deliver the Invocation. Variance granted - Jim Vavold For the first order of business, the Mayor recognised Mr. Jim Vavold who requested a variance to move a building onto the lot in the 2500 block of South Ohio. He stated that the lot size was 571 x 100 and added that most of the members of the Council bad seen the property. It was moved by Counc McCluskay, seconded by Councilwoman Williams, to grant the variance to Mr. Vavold. A vote was taken, and the motion carried. Vacation request - Chet Welch The Mayor next recognized Mr. Chet Welch. Mr. Welch informed the Council that he lived at Pleasan Ridge No. 2 and presented the following petition requesting the vacation of the Laurel Street right -of -way: Mayor Charles Carpenter June 3rd ,1973 Caldwell, City Council City of Caldwell Caldwell, Idaho A PETITION WE, THE UNDERSm11ED, PETITION THE CALM) LL CITY COUNCIL FOR PERMISSION TO VACATE A NAMED HUT UNOPENED STREET RIGHT -OF -WAY IN PLEASANT H ME #2 ADDITION TO CALDWELL IN CANYON COUNTY, STATE OF IDAHO. Laurel Street is located between Block 13 and Block 12 of Pleasant Ridge #2 and extends from Birchwood Drive to Sycamore Drive, only. All of the landowners of Plots #3 & #4 of Block 12 and Plots #1 and #5 of Block 13 have not desire to open this road in the future and do not plan any future building thereon. The owner of Plot #1 (C.C. Welch) wishes to sell an but 100 (one hundred feet) on the south of Plot #1 to Larry B. Evans (owner of Plot #3). It is understood by the undersigned that the easement that extends across said road right- of-way between Plots '#1 and #5 & Plots #3 and #4 Will remain dedicated, as surveyed on Plat 329, Plat Book 8 Page 14, as recorded with Canyon County, State of Idaho, July 38 1966. On March 12, 1973, the Farmers Home Administration and the Caldwell Fire Department were notified of our intentions with no objections from either to our proposal. This petition was first presented to the Canyon County Pl anning and Z Board on March 14th, 1973. Later, it was determined that this said road was within one mile of the Caldwell city limits. Shaman 560 After a brief discussion, it was moved by Councilman McCloskey, seconded by Councilman Carter, that the request and petition be turned over to the City Planning Commission for determination at their next meeting. Upon vote, the motion carried. Recreation Beard recommendations Mayor Carpenter recognized Mr. Barrel Daide who presented the following recommendations from the Recreation Board regarding the sw imming pool: Children 12 and under .25 Children 17 to 12 .35 Adults .75 Book of 20 tickets Children 12 and under 3.00 Adults 10.00 Children 17 to 12 5.00 A motion was then made by Councilman Dakan, seconded by Councilman Carter, to accept the recommen+ dations of the Recreation Board to set the rates at 25¢ for children 12 and under, 350 for children 12 to 17 and 75¢ for adults and make available books of tickets to be sold at $3.00 for children 12 and under, $5.00 for children 12 to 17, and $10.00 to adults. After a vote, the notion carried. Report on water line to industrial area The Mayor requested City Engineer Mel Lewis to report on the water line to the industrial area. Mr. Lewis stated that the line had been connected€ and was in service. He added that he had notified Mr. H. D. Shively, General Manager of Sit Manufacturing Company, that the line was in. Mr. Lewis informed the Council that Townhouse was being worked and it was necessary to extend a main down North Indiana. He added that it was anticipated to be finished by the and of the month. Bill Mo. 11 Councilman Gamboa introduced in written form Bill Mo. 11 entitled: Aid ORDINANCE DSLMMMM THAT CERTAIN LAND IS CONTIGUOUS AND ADJACENT TO THE CITY OF CLUMMJL, STATE OF IDAH( AND DECLARING SAID LAND, Be PROPER LEGAL DESCRIPfICN THEREOF, TO BE A PART OF THE CITY OF CALUAS14 CANYON COGNIR, IDAHO. which was read for the first time and the Council proceeded to consideration of Btll No. 11. It was moved by Councilman Gamboa, seconded by Councilman Carter, that the rules requiring the reading of a bill on three esparate days be suspended and that Bill Me. 11 be read the second time by title and the third time in full, auction by section. The Mayor then directed the Clerk to call the roll on the above motion which resulted as follows: Those voting in the affirmative: Gamboa, Dakan and Carter. Negative votes: Williams and McCloskey. Absent and not voting: Banks. City Attorney Wayne E. Davis stated that according to the Idaho Code the ordinance could not be passed at that time, but considered as the first reading only. He then read the following from the Idaho Cede: 50- 902: The passage or adoption of every ordinance and every resolution or order to enter a contract shall be by roll call of the council with the yea or nay of each being recorded, and to pass or adopt any ordinance or any such resolution or order, a majority of the council shall be required. Ordinances shall be read on three (3) different days, two (2) readings of which may be by title only and one (1) reading of which shall be in full, unless one half N) plus one of the members of the full council shall dispense with the rule. He pointed out that as there had been three affirmative votes and two negative votes, this ordi- nance had not been passed by one half plus one of the members of the full council. Mayor Carpenter then declared that Bill No. 11 had had its first reading. Comments from Councilman McCloskey In regard to the copy of the policy statement distributed by Building Inspector George Dufur, Councilman Mccluskay inquired if something could not be added referring to the responsibilities of the Building Inspector. Mayor Carpenter suggested that an addition could be included to state that "before any constructio is started, the Building Inspector inspect the staking ". Councilman McCloskey asked Mr. Dufur to add this to the policy statement and then present it at the next meeting. Councilman Gamboa stated that there should be a second stamp which showed that the work was done as planned. The Mayer stated that there could be another check after the footings were poured. Comments from Councilman Carter and McCloskey In reference to a comment from Councilman Carter, Councilman McCloskey commended both Councilman Carter and Councilman Gamboa for their work in acquiring and erecting the flagpole for City Hall. 561 Easements approved - -- --- - - - - -- . -__— Mr. Lewis next presented a sewer easement from the TowrAmse p"ject and an easement from Helen Bann for the Marble Front Project No. 2. He recommended that the easements be accepted. _ It was moved by Councilman Gamboa, seconded by Councilman Carter, to accept both easements and to instruct the Clerk to record them. Upon vote, the motion carried. Comments on Marble Front Project For the information of the Council, Mayor Carpenter stated that Engineer Ron Blakely had indicated that the bid opening for Marble Front Project No. 2 would be held an June 25th at 4:OO P.M. Bequest to purchase spray equipment The Mayor read the following letter from J. B. Joyner requesting the purchase of spray equipment from the City: May 30, 1973 GILSOCOAT MFG. J. B. Joyner 3003 S. Indiana Caldwell, Idaho 83605 Mayor's Office City Nall Caldwell, Idaho 83605 Dear Sir: I would like to offer you fifty dollars ($50.00) for some =old orchard spray equipment I have seen at the cemetery here in Caldwell. It doesn't appear to have been used in some time. If you are interested in selling said equipment, please let me knew. You can reach me at the above address or call 459 -6732. THRNA YON, J. B. After some discussion as to exactly what equipment was involved, it was suggested by Councilman Gamboa to delay action until it could be determined what equipment had been referred to. Comments from Councilman Carter Councilman Carter stated that he had been down to the City Shop area and had noticed a number of old signs and scrap. He recommended that the different department heads, sometime in late fall, gather this up and in some manner dispose of said material. Bill No. 12 - Ordinance We. 1298 Councilman Carter introduced in written form Bill No. 12, entitled: AN ORMNANCE TO AMEND TITLE 11, CHAPTER 3, SECTION 5(D) OF THE CITY CORE OF akin ELL, COUNTY OF CANYON, STATE OF IDIHO, BY ADDING THERETO THE PROVISION THAT VEHICULAR TRAFFIC MAY ENTER AN INTERSECTION TO MM THE MOVEKEiT INDICATED BY AN ARROW OR SIGN. which was read for the first time and the council proceeded to consideration of Bull No.12. It was moved by Councilman Carter, seconded by Councilman McCloskey, that the rules requiring the reading of a bill on three separate days be suspended and that Bill No. 4 be read the second time by title and the third time in full, section by section. The Mayor declared the motion had passed by the necessary one half plus one of the members of the full Council and directed the Clerk to read Bill No. 12 the second time by title and the third time in full, section by section. The Clerk read the bill as directed. It was moved by Councilman Carter, seconded by Councilman McCloskey, that Bill Me. 12 do pass. The Mayor directed the Clerk to call the roll on the above motion which resulted as follows: Those voting in the affirmative: Carter, Williams, McCluskey, Gamboa and Dakan. Negative votes: None: Absent and not voting: Banks. Thereupon, the Mayor declared that Bill No. 12 had passed and the Mayor in open session of the Council duly signed and approved the Bill and the Clerk duly signed and attested the same which beca::e Ordinance No. 1298, The Mayor directed the Clerk to make proper entry of the same and to cause Ordinan No. 1298 to be published in the News - Tribune, the official newspaper of the City of Caldwell, as required by law. Clain denied - Clinton Wilson Mayor 'Carpenter presented the following claim from Clinton *Rllsen: May 29, 1973 TO Clinton Jay Milson 1301 Everett St. 562 On the afternoon of May 28 - the main sewer line of City of Caldwell (1300 block between Sberett & Dearborn) basked up causing our basement to flood with sever Water. Consequently, we are filing this claim for damages done. Clean & sanitize couch covers 5.00 Replace 12' x 20' Lee Carpet 100.00 It Was moved by Councilman Dakan, seconded by Councilman Gamboa, to deny the claim and refer it to the City's insurance carrier. After a vote, the motion carried. Bartender Permits approved Applications for Bartender Permits more then presented for the Council's consideration from David L. Sleeper, Wallace A. Collins, Carol Box, Lynn Stafford, Joan F. Janes and Edward G. Hill. Each application had been approved by the Chief of Police and was accompanied by a receipt from the Clark for the required fee. It Was moved by Councilwoman 4 lliama, seconded by Councilman McCluskey, to approved the applies - tiona for Bartender Permits and the Permits be issued. A vote was taken, and the motion carried. Cents regarding claims to Idaho Department of Parks For the information of the Council, Mayor Carpenter stated that they were in the process of sub- mitting Claims No. 3 and 4 to the Idaho Department of Parks for the swimming pool. He added that so far none of the previous claims had been paid and proceeded to explain the reasons given him for the delay.
