The City Council met on call of the Mayor, with the Mayor Emery L. Vassar,

siding.
On Roll Call the following Councilmen answered present: Edgar 1. Oakes, W. S.
Boynton, F. D. Mumford, G. M. Fenrich and W.R. Hollingsworth. Absent: None.
The Mayor stated that this meeting was called to take up unfinished business.
Mr. F.G. Hoffman appeared before the Council and asked that delinquent taxes be

cancelled on Block 109, Lots 13 -14 and 15 /belonging to Mrs. Geo Bartlett. The matter was
left on the table.
The Mayor stated that owing to the absence of P. A. Martin's attorney, S. Ben
Dunlap, his case would be posponed until the neat council meeting.
Mr. Emery Bales asked that the Council consider a 10%i adjustment of city employ-
ees salaries. The Mayor assured Mr. Bal(:s that this would be cnnsidered.
The Mayor appointed Councilmen Edgar L. Oakes and F. D. Mumford on the Spray
Cowmittee.
The Mayor and Council discussed the matter of painting the water tank but ar-
rived at no decision.
There being no further business to come before the Council, it was, on motion
duly seconded and oarried, declared adjourned,

Tune 3, 1935
MINUTES OF REGULAR MEETING OF THE CITY COUNCIL
The City Council of the Gity of Caldwell, Canyon County, State of Idaho, met
in regular session of said City Council on the 3rd day of dune, 1935, at the hour of
8 o'clock, P. M. said meeting being at the time to which the City Council adjourned its
regular meeting held on the 6th day of May, 1935, in the City Hall at said City.
The meeting was called to order by the Mayor and the roll call shoved the
following present, to -wit:
Mayor: E. L. Vassar
Members of the Council: F.D. Mumford, W.S. Boynton, gJ.W. Montgomery
G. M. Fenrich and W,R. Hollingsworth.
Absent: Edgar L. Oakes
City Clerk: O.E,Fritts
It appearing that there was a quorum of the City Council present, the Mayor
declared the meeting op,ned for business.
Therefore, the City clerk read the minutes of the Council meetings of May 6th
and 27th, which were approved as read.
The Mayor announced that the first matter of business would be the opening
and consideration of the bids for the purchase of $41 refunding bonds; which had
been made a special order of business for this meeting by the City Council at its meeting
of May 6. 1935, and that notice requesting bids for the purchase of said bonds had been
duly advertised, as required by law, said bide to be filed filth the City Clerk up to 8
o'olock, P. M:, of this day.
Thereupon the Mayor inquired of the City Clerk if there were any bids on file

for the purchase of said bonds, and the City Clerk produced one sealed bid and was direct-
ed by the Mayor to open said bid. Thereupon the bid was opened in the presence of the Olt:
Council in open session and was as follows, to -wit:
Bid by the Continental National Bank & Trust Company of Salt Lake
City, Utah, according to the advertised notice of sale for 641,000.00
three and one -half percent general obligation refundin bonds of the
City of Caldwell, Idaho, Series of July 1, 1935 in the denominations
of 01,000.00 each, maturing serially from Zuly 1, 1955 to July 1, 1947;
the bidder bid the aum Of 41,000.00, plfis accrued interest from date
of bonds to date of delivery and payment. Bonds at the time of delivery
to be accepted by a certified transcript of the proceedings authorizing
the issuance and.sale of said bonds, with the approving opinion of Chap-
man & Cutler, Attorneys at Law, Chicago, Illinole.
Said bid was accompanied by Check No. 1003 on the First National Bank
of Caldwell, Idaho, in the sum of Q2o50.00, as evidence of good faithl
After duly considering said bid, the following motion was made by Council-
men Mumford, and seconded by Councilman Boynton, to -wit:
It appearing to the City 6 ouncil, after due consideration of all
the bids offered for the purchase of the $41 refunding bonds
described in the Notice of Sale and requesting bids thereon heretofore
published by order of the City Council, that there have been one bid
filed and after due consideration of-all said bide, it appearing that
the bid of the Continental National Bank & Trust Company is a fair and
reasonable offer for the purchase of said bonus and is the beat bid
obtainable and that it is to the best interest of the City of Caldwell
to accept said bid of Continental National Bank & Trust- Company of
Salt Lake City, Utah;
NOW, THEREFORE, BE IT RBSOLVED That said bid submitted by Continental
National Bank & Trust Company be, and the same is hereby, accepted and
the bdid bonds are sold to the said bidder in accordance with the terms
of said bid.
BE IT FURTHER RESOLVED That the Mayor of the City of Caldwell is
hereby authorized to sign the acceptance of said bid for and on behalf
Of the City and that said acceptance be attested by the City Clerk
under the seal of the City.
Whereupon a roll call on said motion was ordered by the M the vote re-
sulting as follows, to -wit:
Ages: Mumford, Boynton, Montgomery, Fenrioh and Hollingaworth.
Nays: None
Absent and non - voting: Oakes.
Whereupon the Mayor declared said motion adopted and that said bid had been
accepted and the said bonds sold to Continental National Bank & Trust Company.
Thereupon, the Mayor, in the presence of the City Council, in open session,
signed the acceptance of said bid, and the same was attested by the City Clerk and the
seal Of the City attached.
Thereupon the Mayor called the attention of the City Council to the consid-
eration of and passage of an ordinance to provide for the issuance of said refunding bonds
by the said City of Caldwell, in the sum of $41,000.00, for the purpose of refunding a
like principal amount of outstanding bonds of said City, to -wit:
municipal Coupon Street Improvement Bonds, dated July 1, 1925, drawing
interest at the rate of 4-3/4% per annum, payable semi- annually, in the
amount of $41,000.00.
Thereupon Councilman Mumford introduced an ordinancenand requested that said
ordinance be considered; said ordinance being entitled:

AN ORDfgANCE PROVIDING FOR THE ISSUANCE OR REFUNDING BONDS OF THE CITY
OF CALDWELL, IDAHO, IN THE LMOUNT OF 041,000.00, FOR THE PURPOSE OF Rr-
FUNDING A LIKE PRINCIPAL AMOUNT OF OUTSTANDING BONDS OF SAID CITY, AND
PROVIDING FOR THE LEVY AND COLLECTION OF AN ANNUAL MAX SUFFICIENT TO PAY
PRINCIPAL OF AND ITNEREST ON SAID REFUNDING BONDS.
Said ordinance was then duly and carefully considered and discussed by the City Council
and thereupon Councilman Montgomery moved that that part of the Idaho Code Annotated,

1932, and the rules of the City, requiring the reading of all ordinances fully and distinc
ly on three different days, be dispensed with, as prescribed by law, and that the proposed

Ordinance No. 518 be read the first and second time by title and the third time fully and
distinctly, at length, and section by section, and then placed upon its final passage.
Said motion was seconded by Councilman Fenrich and the Mayor ordered the roll Ball on said
motion, which resulted in the following vote, tcrwit:
Ayes: MtL..ford, Boynton, 1 ,iontgomery, Fenrich and Hollingsworth.
Nays: None
Absent and Not Voting: Oakes.
Whereupon the Mayor declared said motion, having received the unanimous vote, of he
Council, adopted.
Thereupon the Clerk, under the direction of the Mayor, read the proppaed Or-
dinance No. 518, by title the first time, by title the second time, and the third time
fully and distinctly, and a length, section by section, and said Ordinance Nu. 518 was

placed upon its final passage The Mayor ordered the roll of the Council called, which
resulted as follows:

Absent and Not Voting: Oakes
Whereupon the Mayor declared said Ordinance No. 518 duly passed and directed
the Clerk to make proper record thereof. said Ordinance was then numbered 518; signed
in open meeting by the Mayor and attested by the City Clerk with his signature and the

seal of the City. The City Clerk was then instructed to publish the ordinance one time
in the The Caldwell -News Tribune, the official newspaper, a newspaper printed and publish-
ed and of general circulation in!.the said City of Caldwell.
Thereupon the Mayor announced to the City Council that it should take up the
consideration of a resolution which he placed before it authorizing the issuance and de-
livery of the ;44 of refunding bonds of said Uity of Caldwell, which at this meet-
ing of the City Council had been sold to Continental National Bank & Trust Company of
Salt Lake City, Utah, said bonds to be dated July 1, 1955, and known as "Refunding Bonds,
Series 1935 and being in the denominations of $1,000.00 each, numbered from 1 to 41,
\ - both inclusive, which bonds were 1 sold for the purpose of paying a like amount of
outstanding legal bonds of the City as set forth and described in the resolution passed
by the City Council at its meeting of May 6th, 1935, and also set forth and described in

®rdinanee No. 518, passed by the City OCuncil at this meeting. Thereupon Councilman
` Hollingsworth moved the adoption of said resolution, which motion was seconded by Council-
an Montgomery; said resolution being as follows, to -wit:

MERHAS, The City of Caldwell has duly authorized the issuance of $41,000.00
refunding bonds of said City dated July 1, 1935, in denominations of $1,000.00
each, numbered from 1 to 41, both inclusive, and

WHEREAS, all ordinances and matters necessary for the issuance of said bonds
have been passed, done and fully complied wi�,and said City is now ready
to have said bonds prepared under the direction of the proper officers of
said City of Caldwell in proper form, as authorized by Ordinance No, 518
of said Cityand to have the same signed by the Mayor of said City and attest-
ed by the signatures of the City Clerk and the City Treasurer of said City,
f all in compliance with law and said Ordinance No. 518 of said City, and
WHEREAS, the City Clerk is herFby directed to cause said bonds to be duly
printed, in accordance with said Ordinance No; 518 and to then r=.gister
the same in numerical order in a permanent public record book kept by him
in his office for that purpose and such registration endorsed on said bonds
and signed by the City Clerk, and when so registeredLthe City Clerk, shall
deliver the said bonds to the City Treasurer and take his receipt therefor
and said City Treasurer shall register the same in a permanent public record
i book kept by him in his office for that purpose in the manner provided by law;

NOW, THEREFORE, BE IT FURTHER RESOLVED That when said bonds are so duly ex-
ecuted by the Mayor, the City Clerk and the City Treasurer, as authorized
by said Ordinance No. 518, and duly registered by the City Clerk and the City
Treasurer, the City Treasurer be, and he is hereby, authorized and directed
to deliver said bonds to Continental National Bank & Trust Company; the pur-
chaser thereof, who shall on said delivery pay to the City Treasurer therefor
the sum of $41,000.00, and secured interest on said bonds. That the money so
received for said bonds shall be immediately deposited by the City Treasurer
ibn the First National Bank of Caldwell, Idaho, in a special separate fund
apart from all other funds of the City and shall be used only for the purpose
of paying the principal of the following outstanding bonds of said City, to-
wit:
$41,000.00 Municipal Coupon Street Improvement Bonds, dated July 1, 1925,
drawing interest at the rate of 4 3/4 % per annum, payable semi - annually,
numbered 1 to 41, both inclusive;
and no part of such fund shall be otherwise used until all of said bonds
are fully paid, retired and cancelled.
BE IT FURTHER RESOLVED That the City Treasurer is hereby authorized and di-
rected to authorize the said First National Bank of Caldwell, Idaho, to take
from said fund and pay any and all of said bonds, as presented, and deliver
such bonds so paid to the City Treasurer for cancellation and to charge the
said special fund of the City Treasurer, herein authorized to be created,
therefor and the City Mreasurer is hereby authorized to deliver to said bank
a•letter of instructions authorizing said bank to make said payments of the
principal of said bonds from said fond and charge the fund with the same until
all of sdid bonds herein mentioned are fully paid.
Said resolution and motion to adopt the same were then duly considered
by the City Council, after which the MayoX ordered the roll call of the Council to be
called on the motion to adopt said resolution, said roll call resulting in the following
vote, to-wit:
Ayes: Mumford, Boynton, Montgomery, Fenrich and Hollingsworth;
Nays : None.
Absent and Not Voting: Oakes.
Thereupon the Mayor declared the said resolution duly adopted.
Thereupon the Mayor called to the attention of the City Council the
fact that the City Treasurer'shouldi.be authorized. - to Will for payment the bonds to be - i
paid and retired by the sale of said $41,000.00 of refunding bonds sold by the City Coun-
cil at this meeting to Continental National Bank & Trust Company and authorized to be
executed and delivered at this meeting of the City Council.
Thereupon Councilmen Hollingsworth moved that the City Treasurer be,
and he hereby is, instructed and authorized to publish notice in the Caldwell News - Tribune
the official newspaper of the City; calling for payment the said outstanding bonds of said
City to "wit:
$41,000.00 Municipal Coupon Street Improvement Bonds dated
July 1, 1925, drawing interest at the rate of 4 3/4 A per
annum, payable semi - annually, numbered 1 to 41, both inclusive,
said bonds to be presented for payment on the 1st day of July, 1935, and that- the interest
on z aid bonds shall cease from said date. Said motion was duly s econded by Councilman
Mumford and after due consideration thereof the Mayor ordered the roll of the Council to
be called on the motion, which resulted.as follows, to -wit:
Aye's: Mumford, Boynton, Montgomery, Fenrieh and Hollingsworth.
Nay: None
Absent and Not Voting: Oakes
Phereupon the Mayor Declared said motion carried.
Mr. S.Ben Dunlap appeared before the Council on behalf of P. A.
Martin and stated that Mr. Martin wished to co- operate ud.th the Council regarding the -
operation of his C1ger Store. Chief of Police Boyd and Vahan stated that to their know-
ledge the gambling had been stopped. The Mayor informed Mr. Martin if he stayed within
the law the case would rest.
An Affidavit of Publication was read by the Clerk.

'The Clerk read a Petition signed by property owners requesting a +street light
on the corner of Linden and Cleveland.
The Mayor appointed Montgomery and Hollingsworth as a committee to investigate.
LL' Thereupon, on motion by Boynton, Seconded by Mumford the following Resolution

'A RESOLUTION AUTHORIZING THE CANCELLATION OF CERTAIIN SPECIAL CITY TAXES, 7'EVIED AND
ASSESSED AGAINST THE PROPERTY HEREIDAFTER DESCRIBED, AND NOW DELINQUENT.
MREALS, it has been made to appear to the satisfaction df the
Mayor and City council, that the properties herein particularly des-
: cribed have been assessed by the City for special taxes including
sprinkling and weed cutting and that none of said taxes have been paid,
and that the same are now delinquent against said properties, and,.
WHEREAS, it has been made to appear that the present owner of all
of said properties is desirous of improving said premises and will
place them on a tax paying basis,and,
WHEREAS, it appears to be to the best interest of the said City
to cancel the same,
NOW THEREFORE, it is ordered and this does order the City Treasurer
to cancel the delinquent taxes now levied against,
Block 102, ,Lots 13 -14 and 15 Goandu Addition to the City of Cald-
well, for the years 1920- 1921 - 1922 - 1924 -x.925 and 1926.
PASSED by the Council this 3rd, day of June 1935.
APPROVED by the Mayor this 3rd, day of June 1935.

Motion carried.
The Bills for May were read and on motion by Fenrich, seconded by Hollingsworth
that these bills be allowed and Warrants be ordered drawn for the various amounts all of
which had been approved by .a member : of the Finance Committee. Motion carried.

The _Ncyor appointed Oakes, Hollingsworth and Fenrich as a committee to inves—
tigate the salary ordinances.
Thereupon, no further business appearing, on motion of Councilman Boynton,
seconded by Councilmen Mumford, the City Council adjourned to meet on the 27th day of June
1935, at the hour of 8 o'clock, P. M., of said day, for the purpose of considering and
taking action on any matter necessary to complete the sale and delivery of said $41,000.00
refunding bonds sold at this meeting of the City Council to Continental National Bank &
Trust Company and for the calling and redemption of the bonds to be paid and redeemed
with the money redeived from the sale of said $41; of refunding bonds, and to con—
sideration of the appropriation bill, and any and all business that may lawfully come be—
fore the Council meeting.

Purauant to adjournment of the regular meting of June 3rd, 1935, the Mayor and
City Council met with the Mayor Emery L. Vassar,presiding.
Hn Roll Call the following Councilmen answered present:Edgar 1. Oakes, F.D. Mum.
ford, W.S.Boynton, G.W. Montgomery, G. M. Fenrich and W. R. Hollingsworth: Absent: None.
Thereupon the Mayor declared the meeting duly organized.
The Mayor and City Council proceeded to consider the estimate of the probable
amount of money necessary for all purposes to be raised by taxation in the City during
the fiscal year beginning the 1st of May 1935.
Moved by Hollingsworth, seconded by Oakes the Concil adjourn,for father consid—
eration of the above matter and for the consideration of any other matter that may lawfully
come before it, until 2:00 o'clock P. M. June 28, 1935, M ion carried.
