Councilman Davenport asked where these people would he living and Vr. Dakan replied they will live in trailers, possibly parked at Simplot Stadium; at any rate, there will be no trailers parked on the street Councilman McCluskey stated that inasmuch as this proposal appeared to be entirely unfamiliar to the most of the Councilmen, including himself, he would like to make a motion that this matter be tabled unt the nest afternoon for further investigation. The motion was seconded by Councilman Martin. A vote was taken and the motion carried. Councilman Keys noted that the Businessmen's Association would hold their regular meeting the next day at noon, and Councilman Martin suggested that the Fire Chief and Police Chief also attend the meeting to help determine the safety factor involved in holding a carnival on the downtown streets. Building Inspector's Report The report for the month of May, 1970 was submitted by Building Inspector, George Dufur, with the explanation that the new business securing a permit was the Do -Nut House at 323 Cleveland Blvd. Sunnybrook Village Subdivision Plat The Sunnybrook Village Subdivision Plat was presented to the Council by City Engineer, Melvin Tavi+ It was moved by Councilman Martin, seconded by Councilman Dakan that the Sunnybrock Village Sub- division Plat be accepted. A vote was taken and the motion carried. swimming Pool Councilman Hanks, Chairman of the Recreation Committee, reported that the Municipal Swimming Pool is open to the public daily, and is cleaned and drained daily. LID #66 City Engineer, Melvin lewis, reported to the Council that the concrete work in connection with LID #66 is finished on Cinderella Park; West Oak; Cedar and Cherry Streets. Bills for End -May It was moved by Councilman Martin, seconded by Councilman Dakan, that the warrants for claims and payrolls be approved as per list and .tiled in the City Clerk's office. A vote was taken and the motion carried. It was moved by Councilman Banks, seconded by Councilman McCluskey, that the meeting recess until 4:00 P.M., June 2nd. The meeting recessed at 10:05 P.M. The Council met pursuant to recess and acknowledgement of notice in the following form: We„ the undersigned Mayor and Members of the City Council of the City of Caldwell, Idaho, do hereby acknowledge notice of a Special Meeting of the said City Council to be held in the Council Chambers in the City Hall in the City of Caldwell, Idaho, at the hour of 4:C0 P.M., on the 2nd day of June, 1970, for the transaction of all business in connection with the following objects: Consideration of a request 33® from the Caldwell Jaycees and the Retail Merchants Committee for permission to set up a Carnival in the II downtown area. N I Witness our signatures this 2nd day of June, 1970. ` Mayor V Mayor Charles W. Carpenter presiding. Upon Roll Call, the following Councilmen answered present: Charles C. Banks, Alfred H.McCluskey, V. Jay Martin, C. A. "Chet" Davenport, and James R. Dakan. Absent: James W. "Bill° Keys, Request for permission to set up a Carnival in the downtown area considered and withdrawn Mayor Carpenter announced that the purpose of this Special meeting was for the consideration of a request from the Caldwell Jaycees and the Retail Merchants Committee for permission to set up a Carniva]. in the downtown area and the following was read: TO THE CALDWELL CITY COUNCIL WE THE CALDWELL JAYCEES AND THE RETAIL MERCHANTS COMMITTEE DC HEREBY REQUEST PERMISSION TO SET UP A CARNIVAL IN THE DCWNTOWN AREA. THIS REQUEST 15 SUBJECT TO THE OPERATCR OF THE CARNIVAL, MR. JOE WILLIAPiS, PROVIDING THE NECESSARY BOND AND MEETING AND SAFETY REQUIREMENTS. IN THE EVENT THIS IS NOT POSSIBLE WE WILL SET UP AS PREVIOUSLY PLANNED AT THE SIMPLOT STADUIM. RESPECTFULLY SUBMITTED /s/ Clyde Coursey Mr. Rodney Dakan was recognized and he told the Council that he had been appointed as the spokes- man for the Caldwell Jaycees. Mr. Dakan then told the Council that he thought this would be good for down- town Caldwell and they could work with Mr. Perfect, City Fire Chief, on the safety requirements and the City Engineer on bonding requirements; that Mr. Williams was wholeheartedly in favor of anything they had to do in order to get the Carnival downtown, and he would be in town tonight and would attend their meeting at which time some of the details could be worked out. In answer to the question, Mr. Rodney Dakan said that letters were sent out from the Chamber of Commerce to the merchants in the area saying that the Retail Merchant's Committee was considering this item and, if they had a nay vote to present themselves; that there were no nay votes prior to last night althoue. he didn't know about today. Mayor Carpenter added that there had been no nay votes at the Testing today. Councilman Davenport stated that he would like to comment in that he thought, in the future, it would be quite appropriate that the Council have a little bit more communication prior to the time that the Carnival was to be set up and he thought everyone would feel better about it. Mr. Rodney Dakan said there had been a misunderstanding on his part in That he had come to the Mayor about it and had mentioned it; that the Mayor had said he would be more than willing to go along with whatever they wanted to do so he had assumed from this conversation that, i° they wanted to have it downtoo and close off the streets, all they had to do was get an order from the Mayor and it was done; that it was a mistaken impression on his part. Mr. John Myers of Rexall Drug Store then spoke in opposition of having the Carnival downtown and said he couldn't see why any business should be closed or any street should be closed for one organization; that any time a street was closed, people were just too lazy to walk so they werentt going to come by and stop. He said he was absolutely aFainst closing Main Street and Kimball Avenue and that, as far as having been notified, he didn't think any of the merchants had been notified and some of the boys who belong to 33 1 the Merchants Association said that they were not notified by letter or by any other way and didn't know anything about it until the paper came out. Mr. Myers added that this had been tried before for a oar show and that it didn't work out and closing a street would just close those businesses down. Mr. Dan Combs of the Kimball Barber Shop spoke and said he felt the same way Mr. Myers did and that if these streets were closed off, the businesses on those streets were going to suffer for the reasons stated, that he wished to protest it as he objected to it. Mr. Mel Hickey of Coast to Coast Store told the Council that this was the season for lawn mowers and other heavy merchandise and people weren't going to run, a lawnmower down the street for three or four blocks and he just as well close up for four days if the street were to be closed. Mr. Hickey further stated that he couldn't see ,by the Carnival couldn't be located in another section of town, on the outskirt of Main Street or down by the Post Office where no one would be botkered and it would still draw customers. Councilman Davenport indicated his interest in just what the letter notifying the merchants of this had said and he also referred to the revenue to the Stadiun if held there. Councilman Martin told the Council that they were told at noon by, he thought, Mr. Pasley of the Retail Business Men's Association, that they had an agreement with the Jaycees that they would contact every business that would be affected in the area by the street closure, whether they were members of the Association or not. Also, that he had made the statement at the meeting that he thought there had been a lack of communications and that this should have come before the Council at an earlier date over and against the Carnival dates and that, if the Council did approve it, they would de so with a little different attitud. Mr. Gale Burns of King's Variety Store spoke in favor of the program and anything that would generate foot traffic down town. He referred to shopping center stores around Idaho Falls and Twin Falls and said these were exactly the type of things that they try desperately to get in and they ran their advertising around it for free rides for kids accompanied by their parents, etc. He added that he thought the down town merchants had all missed the boat by not sticking together and going on this type of promotion that it was working at Karcher Mall. Councilman McCluskey told the Council that, at the meeting had this noon, there had been abaoluteZ no opposition and said he thought they had led the members who were there to believe that the City would go along with it, or at least he did, subject to the approval of the Police Department, Fire Department and Public Works Director. He spoke of the need for additional information from the rest of the businesses involved in this area and the surrounding area and said this was rather difficult to get at this late date. in answer to the question, 7olice Chief dstleford told the Council That he thought they were going to have nothing but problems such as with people parking on the street and sleeping, problems of sanitation for lack of restrocm facilities, and lack of drinking water, that these were things that had to be worked out. Chief Astleford also referred to some who follow Carnivals who are "Shaddy ", so to speak, and it approved by the Council, he said they would do the beat they could and would put all the personnel they possibly could spare in the down town area to control it. Councilman Keys entered the meeting at this time. Fire Chief Harold Perfect told the Council that his first thought was with regard to the problem of fires and said there was going to have to be good access to all buildings for the fire engines; that he didn't know what the ?olice Department could do with the people present but this would be their problem. Other street locations that had been considered were reviewed by Rodney Dakan and the reasons Main and Kimball had been selected. He pointed out that, if the Carnival was located at Simplot Stadium, they were going to ne drawing traffic from the down town area and he told tae Council that the Jaycees had netted $900.00 on the Carnival last year which was something like 7% of the gross sales of the Carnival, that they needed the $900.00 but did they need to hurt the down town merchant in doing it by drawing traffic away from the down town area to another site. He told the Council that the down town area was sorely 332- hurting for traffic, that parking was a problem, and the Retail Merchants Committee couldn't get behind a solution for the parking meters, so, if it was the feeling Of the Council that this was going to cause hard i feelings between the Council, the Jaycees, and the down town merchants, than he would suggest that they deny) the request, ry l Mr. Jack Raymond spoke in that he thought having the Carnival down town would be for the good of the Community. Councilman Martin referred to the statement that this promotion was designed to promote business in the down town area and he pointed out that, against this, was the added placement of responsibility and the potential fire hazard which were the things he was concerned about - because of the number of businesses the type of some of the structures involved on some of the streets, and the duration of the program for five days which he said was a bit different than one day. Councilman Banks spoke of the Council's concern for the down town businessman and said he thought that, if anything the Caldwell businessmen had lacked in the last few years was business promotion; that he believed in business promotion as a business man and he didn't think the Council should stand in their way. Councilman Davenport again referred to the Simplot'Stadium complex and that without the partici- pation of the merchants, the complex wouldn't be there; that this was a big business in itself with the selling point being that the City would have a place for its Rodeos and Carnivals. He said that, if this came to a vote, he would vote against having the Carnival up town for the reason that he thought it belongec out at the Stadium complex to support that enterprise which was composed of business men of Caldwell. Councilman Keys stated that it seemed that they, as a City Council, were being called upon to mediate this proposal and he didn't think this was their position; that apparently the merchants were not together on it. After considerable more discussion, Mr. Rodney Dakan referred to a previous situation where the Council had gotten into trouble and had taken a great deal of abuse from numerous citizens in attempting to mediate a problem between the Jaycees and the Caldwell Rite Rodeo Board and he said that, if this was going to create a problem for the Council, he would like to withdraw the request. It was then moved by Councilman Banks that we issue the request to the Jaycees for a down tosm Carnival. The motion was seconded by Councilman Dakan. After some further discussion by those present for the meeting, Mr. Rodney Dakan, in behalf of the Caldwell Jaycees, fornally withdrew their request for a change in the location of the Carnival from Simplot Stadium to down town Caldwell. The motion, with the consent of the second, was then withdrawn by Councilman Banks. Mr. Rodney Dakan thanked the Mayor and Council for their consideration and deliberation on this matter and said they could rest assured that on the 1st of January, next year, they would be in before the Council to see if they couldn't do some good for the merchants and said that between now and then he was going to talk to the merchants and see if they couldn't do something about making Caldwell the number one City in Idaho and he thought that iaith some discussion, they could assure the various and sundry business men down town that it could be done. He also stated that he agreed with Councilman Martin in that the lack of communication between the Jaycees, the Retail Merchants, and the Council was very had and the Council's consideration was very much appreciated. It was moved by Councilman Dakan, seconded by Councilman Banks, that the Special Meeting recess until June 15, 1970, at 8:00 P.M. A vote was taken and the motion carried.
