CALDl9ELL? IDAHO 2nd. 1919.
COUNCIL met in regular session in the Council Chambers with
Mayor PJ Grant Hurd presiding, upon roll call the following Councilme
were found present;
Joe Dickens, S Ben Dunlap, H H Harman, F T Fouling
Frank Moore and A E Sutton.
minutes read.
The minutes of last regular meeting read and on motion
of Hayman seconded by Fouling same were ordered approved as read.
Petitions ate.
Hon T A Walters presented s resolution which was introdua-
ed by Councilman Dunlap for the vacation of the plat of
OU21 ADDITIOIS TO TdE CITY OF OALDFI'ELL. IDAHO
on motion same was laid over until next meeting.
P E Engle presented a petition signed by a number of tax -
payers asking that the Corrals and stock yards lying South of Indian
Creek and between 9th. and 11th. streets be declared a nuisance, action
on same by motion was deferred for the present.
I If Paynter made verbal request for extension of the Cdty
ufater works in North hest part of town, no action taken at this time.
T A ,'alters presented a petition of a majority of the
residents of Dearborn praying for the widening of the Parking on
Dearborn Street from Eighth street south. On motion Dunlap seconded by
Fouling same was referred to Street and Park committees, City Attorney
and City Engineer for investigation and report at next meeting.
Mr Hogue and Mr Bond of the UNITES STATES RECLAEATION OFFICE
APPEARED BEFORE THE Council asking that the road up Canyon Hill at the
foot of Ninth Street be abandoned and that they would construct road up
the gulch East of water tank, on motin Dunlap seconded by Dickens same
the mayor
was referred to a committee of Two councilmen, the City Engineer jw.i
The mayor appointed Hayman and Dickens.
Mr Bowe request for extehsion of side -walks in East part of
City was referred to Street committee.
Petition of J Jester and others for extension of Water
]plains was referred to Water committee and City Engineer for report
and investigation.
Petition of A H Clambey et al protesting against the flooding
of the streets by 0 Royce referred to the Street committee.
Sexton salary.
On motin of Hayman seconded by Dunlap the salary of
J W Roes sexton was raised to 690.00 per mont beginning with June let.
The following bills were presented by the city clerk
and on motion of Hayman seconded by Dickens same were allowed and the
clerk instructed to issue warrants on the respective funds for same;

AN ORDINANCE DECLARING THE INTENTION OF THE CITY OF CALDWELL, STATE OF IDAHO,
TO CREATE AND ESTABLISHLOCAL SEWER DISTRICT NO. 6 OF THE CITY OF CALDWELL ?STATE OF ID
IDAHO. FOR THE PURPOSE OF CONSTRUCTING A SUITABLE SEWRE SYSTEM THEREIN: STATING MM
SPECIFIC BOUNDARIES OF SAID PROPOSED DISTRICT: THE GENERAL CHARAOTER OF SAID
PROPOSED PORTION OF THE S3 SYSTEM AND THE ESTIMATED COST OF THE SAME AND
THAT SUCH COSTS ARE TO BE ASSESSED AGAINST THE PROPERTY INCLUDED WITHIN SUCH SEWEit-
AGE DISTRICT AND PROVIDING THAT ALL COSTS AND UPEITSES OF THE SAID SEWERAGE IMPROV-
EMENTS MADE IN THE SPACES FORMED BY THE JUNCTION OR INTERSECTION OF STREETS AND
AVENUES AND IN THE SPACES OPPOSITE ALLEYS IN SUCH DISTRICTS SHALL BE BORNE BY THE
PROPERTYABUTTINE. COISFRONTING. CONTIGUOUS OR TRIBUTARY TO SAID INTERSECTION AND
SHALL BE A LIEN UPON SAID PROPERTY THE SAME AS ANYOTHER ASSESSMENT AGAINST SAID
PROPERTY IN SAID DISTRICT: FIXING THE TIME WITHIN WHICH PROTESTS AGAINST SAID
PROPOSED IMMPRA OVEMENTS MAY BE FILED IN THE OFFICE OF THE CITY CLAERX. DECLARING THE
INTENTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDOML. STATE OF IDAHO. TO
PROVIDE FOR THE PAYMENT OF THE COST AND EXPENSES OF SUCH IMPROVEMENT BY ISSUING
IMPROVEMENTS BY ISSUING IMPROVEMENT BONDS OF THE DISTRICT AND DECLARING AN EMERGENCY.
Thereupon Councilman Dunlap moved that that part of the revised
codes of Idaho requiring the reading of ordinances fully and distinctly on three
different dgys be dispensed with in the manner prescribed by law and that Ordinal
No 319 be read the second time by title and the third time in Hill and placed on
its final passage. Said motion was seconded by Councilman Dickens.
The mayol stated the zloti6Aa and puttthot4uestin� and the vote upon slid
question was aefollows:
Those voting yea; Dickens, Dunlap, Fouling, Hayman, Moore ans Sutton.
Those voting No and absent none
The mayor then declared that said motion had duly carried by the neces-
sary three - fourths vote and, under the motion directed the clerk to read ordinance
No 319 the second time by title.

The mayor stated that under the motion, that ordinance stood for
third reading, and directed the clerk to read the same fully and distinotly at length

The mayor stated, under the motion, that ordinance No 319 had been

" Shall ordinance No 319 pass as read ?"
The mayor directed the clerk to call the roll, and upon roll call,

the vote upon the the final passage of said ordinance resulted as follows;
Those voting "Yee" Dickens, Dunlap, Feeling, Hayman. Moore anda5utton
Thies voting "No" and absent none.
The mayor declared said ordinance No 319 to have duly passed and directs
the clerk to make proper record thereof.
Ordinance No 319 having duly passed, the same was presented to the 11cayo
for his approval, and the mayor having considered the same, thereupon in open
session of the council, signed and approved said ordinance No 319.
Ordinance No 319 was thereupon ordered to be recorded in Ordinance
B000k No 3 of said City, and was thereafter duly recorded therein at pages
xv yS to - � 7 J7 inolusive.
It was further ordered that said ordinance No 319 be published at
length on time in the regular issue of the Caldwell Tribune.
The official paper of the city of Caldwell, Idaho.
On motion Hayman seconded by Dunlap it was voted to allow '�60.00
per month for Band Leader.
On motion Dunlap seconded by Sutton it was voted that it is the
sense of the council that the band concerts be continued during the summer.
On motion Dunlap the city clerk was instructed to call for- bids
for the city printing for the fiscal year.
J paving resolution
The following resolution was unanimously adopted;
BE IT RESOLVED BY THE MAYOR AND CITY COUNCILOR THE CITY OF CALDWELL.
TEAT.
The city clerk is hereby ordered and directed to advertise for
sealed proposals and bids to be received by the City Council of Caldwell,
at the office of LheCity Clerk in the City Hall until the 24th.-day of ffngq
1919, at 1 o'clock 2 M,for the paving with bitulithio with cement concrete
base or asphalt with cement concrete base or bitulithio with bituminous
concrete base or plain oement concrete y_An all those alleys and streets desc-
ribed in Local Street -Improvement Districts Not and-No 3. in the manner
provided for by ordinances No 312 and 313., iv in addition ordered and directed
to advertise for sealed proposals and bide to be received by the City Counedl
of Caldwell, Idaho, at the office of the City Clerk in the City Halluntil
the 24th. day of June, 1919, at 2 o'clock P M. for the enlargement, extension,
repair and improvement of themunicipal waterworks plant of said city as
provided for by ordinance No 314. No proposal on either proposition to be
considered unless accompanied by a certifed check in favor of the city of
Caldwell, for five percent of the total amount bid, as evidence of good faith,
to be forfeited if the successful bidder fails neglects and refuses to enter
into a contract and provide a suitable bond-.for the faithful performance of
the work and protection of the labor and materialmeh, in case the contract is
awarded him. The amount of the bond in either proposition is to be a sum
equal to the total amount of the successful bid. The right to be reserved
to the city to reject any and all bids or to let the work as a whole or in

parts, as may appear to the best interests of the city. Carried unanimously.
Done by order of the mayor and council of Caldwell. Idaho, this
2nd. day of 1919.
On motion Dickens seconded by Sutton that the specifications as
Prepared by the city engineer for the construction work of the proposed paving
and extension of the water works be accepted, on roll call the vote was as
follows: _
Ayes Dickens, Dunlap, Haymah Fouling, Moore and Sutton
Noyes and absent . Hone.

Motion Dickens seoohded Hayman council adjourned until 'Wednesday

COU1401L met in regular session pursuant to adjournment of the tad. inst
with Mayor W Grant �!ard presiding. The roll being called the following councilmen
were found present: Dickens, Dunlap, Fouling, Hayman, Moore and Sutton.
Vacation resolution.
The resolution presented by T A Walters praying for the vacating
of Plat of Capps addition was again presented and on motion by Dunlap seconded
Dickens acme was adopted. The roll being called the result was as follows:
Ayes, Dickens. Dunlap, Fouling, Hayman, Moore and Sutton,
M ayes and absent, None.
The notice of the residents of Uitchells acreage west of town for
withdrawal from the City was read and on motion of Dunlap seconded by Sutton
the City Attorney was instructed to file protest with District Court.
RESOLUTION
The following resolution was inbriduced.

ALONG AND IN FROAr OF CERTAIN LOTS AND BLOCKS IN SAID CITY. AND PROVIDING FOR
THE PAYMENT FOR THE REMOVAL OF SUGH CONDEMNED WALKS BY AN.: ASSCMT LEVIED AND
ASSESSED AGAINST THE PROP= FRON_ING AND ABUTTING ON SAID SIDEWALKS.
On motion Moore seconded by Hayme. n that the resolution be adopted
the roll being called the vote was as follows:
Ayes, Dickens, Dunlap, Fouling, Hayman, Moore and Sutton.
Noes and absent. none.
The mayor announced that same had carried and the clerk was
ordered to make proper record thereof.
