COUNCIL CHAMBERS

The regular monthly meeting of the City Council met in the Council Chambers of the City Hall, with II
Mayor N. E. "Coley" Smith presiding.
17pon Roll Call, the following Councilmen answered present: E. L. Vassar, James W. 'Bill" Keys,
V. Jay Martin, Charles 71, Carpenter, and C. A. Davenport. Absent: Max Luby.
Aerial Photographs discussed
Mayor Smith informed the Council that Mr. Earl Brockman was having aerial photographs of Caldwell
and vacinity flown; that there would not only be the City limits of Caldwell but the edges too and he was
making them up to sell to realtors and other people at a cost of around $50,00 to $60.00 each. Yr. Brockman
had wondered whether or not the City would be interested.
Availability of similar maps photographed by the U. S. Government in 1957 or those obtained by the
State Highway Department were mentioned when, in answer to the question, City Engineer Melvin lewis stated
that the only value of Mr. Brockman'a maps over others available as mentioned would be for checking somathin
current and if a map was good enough, it would probably be worth that amount of money.
It was agreed that a determination in the matter would have to be made on the basis stated by the
City Engineer.
Resignation from Police Department - George R. Sweet, Jr.
April 21, 1964
To: The Honorable Mayor and City Council
Subject: Resignation
Bear Sirs:
This letter is to advise you that I am resigning from the Caldwell Police
Department effective May 21, as I have accepted a position with a company'outside
the State of Idaho.
I have enjoyed the 10 years that I have worked for the Caldwell Police
Department, and it is with some regret that i turn in this resignation.

It was moved by Councilman Carpenter, seconded by Councilman Keys that the resignation of Mr.
George R. Sweet from the Caldwell Police Department be accepted. A vote was taken and the motion unanimously
carried.
Transfer of Pool License
The previous approval of a transfer of the Beer License issued to Arthur E. Bock d/b /a Western Beer
& Lunch was referred to and an application from Mr. Bock was presented for a transfer of the Card License
from 107 So. Seventh Avenue to 707 Main Street, the latter being the new business location.
It was moved by Councilman Martin, seconded by Councilman Carpenter that the application of Mr.
Bock to transfer the Card License to 707 Main Street be approved. A vote was taken and the motion
unanimously carried.
Application for Bartender Permit
An application for a Bartender Permit from Joan M. Crouch was presented for consideration of the
Council with said application having been approved by the Chief of Police and was accompanied with a receipt
from the Clerk for the required fee of 162.50.
It was moved by Councilman Martin, seconded by Councilman Vassar that the application be approved
and that the Permit be issued. A vote was taken and the motion unanimously carried.
Lease extension agreement and chattel mortgage ratified and confirmed
A lease extension agreement and chattel mortgage between the City and Charles A. Nickel for lease
of Cemetery property as crop land was presented for the consideration of the Council. Mr. Nickel had paid
to the City the sum of $l,olo,00 as stiuplated in the agreement and had given a chattel mortgage for payment
of the balance of $1,010.00 on or before December 1 1964,
It was moved by Councilman Keys, seconded by Councilman Davenport that the signing of the Lease

Extension Agreement with Charles A. Nickel by the Mayor and Clerk on behalf of the City of Caldwell be
ratified and confirmed. A vote was taken and the motion unanimously carried.
Report of Sanitation Department
A report of the Sanitation Department was read and ordered placed on file,
Bill No. 9 - Ordinance No. 1029
This being the appointed time for hearing on the vacation of apart of Jefferson Street lying
between South Kimball Avenue and Seventh Street extended, Mayor Smith inquired if there was anyone present
to offer objections. It was determined that no one was present to object to said vacation; however, City
Attorney Wm. F. Gigray, Jr. explained his interpretation of Section 50. -1124 of the Idaho Code in that the
notice for hearing should be given by Ordinance rather than by Resolution of the Council.
Councilman Vassar then sponsored the following Bill No. 9, entitled -
AN ORDINANCE DETERMINING THAT THE VACATION OF THAT PART OF JEFFERSON.STREET LYING BETWEEN SOUTB KIMBALL
AVENUE AND SEVENTH STREET EKTENDED IS TO THE BEST INTEREST AND ADVANTAGE OF THE CITY OF CALDWELL, ITS
CITIZENS AND PROPERTY OffNERS; DETERMINING THAT NO DAMAGE WILL BE SUSTAINED BY ANY CITIZEN OR PROPERTY OWNER
BY REASON OF THE VACATION OF SAID STREET; PROVIDING THAT TYE TITLE TO SAID STREET AS VACATED SHALL REVERT TO
THE PROPERTY ADJOINING THE SAME; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH AND
PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE AND ITS TAKING EFFECT.
which was read for the first time and the Council proceeded to consideration of Bill No. 9. It was moved by
Councilman Vassar, seconded by Councilman Martin that the rules requiring the reading of a Bill on three
separate days be suspended and that Bill No. 9 be read the second time by title and the third time in full,
section by section. The Mayor directed the Clerk to call the roll on the above motion with the following
result: Those voting in the affirmative were: Vassar, Keys, Martin, Carpenter, and Davenport. Negative
votes: none. Absent and not voting: Luby. The Mayor declared the motion had passed by the necessary
three - fourths majority and directed the Clerk to read Bill No. 9 the second time by title and the third time
in full, section by section. The Clerk read the Bill as directed. It was moved by Councilman Vassar,
seconded by Councilman Martin that Bill No. 9 pass. The Mayor directed the Clerk to call the roll on the
above motion which resulted as follows: Those voting in the affirmative were: Vassar, Keys, Martin,
Carpenter, and Davenport. Negative votes: none. Absent and not voting: Luby. Thereupon, the Mayor
declared Bill No. 9 had passed and the Mayor in open session of the Council duly signed and approved the
Bill and the Clerk duly signed and attested the same which became Ordinance No. 1029.

The Mayor directed the Clerk to make proper entry of the same but to delay publication of said
Ordinance until further instructions.
Local Improvement District Bonds for off street parking discussed
The possibility of selling Local Improvement District Bonds for financing a proposal for off -
street parking presently under consideration was discussed when, in answer to the question, City Attorney
Wm. F. Gigray, Jr. informed the Council that it was quite obvious why no Bonding Company would do this
because in the Local Improvement District Code, the property assessed is that abutting and adjoining within
the radius of the half block around the parking lot and that he didn't think there was enough valuation in
the District area for the amount of bonds that would be needed.
Also discussed by the City Engineer was the enlarged area clause contained in the Code with
reference to the possible financing of the off- street parking.
Report on Public Dances
Mayor Smith reported to the Council concerning public dances and stated that at the two dances
held at the Cinnamon Cinder since allowing them to re -open with two special policement and one particularly
qualified policeman at the front door, they had had the same crowds with the new rules prepared by the Chief
of Police and the dances had been real peaceable with no problems.
Councilman Martin stated that the lamentable thing about the situation was the unfavorable
publicity had by the Police Department and that now, through their cooperation in getting the dances back on
a workable basis, as far as publicity was concerned, all there was, was bad for the Police Department and
the City Government as the latter developments would not be publicized.
Recommendation for Re- Zoning
The following recommendation from the Zoning Commission was read for consideration of the Council:

It has been recommended by the Caldwell Zoning Commission at a meeting held May 26, 1964
that the following described property, which is now zoned AB Residential, be re coned to
CD Commercial.
All the NE i of Block 6h; all the SW j of Block 65,
all the SW of Block 62, Dever's Addition, Caldwell, Idaho.
/S/ Barney Goal
At the request of Mayor Smith, City Building Inspector Barney Goal explained that the Zoning
Commission had heard a proposal by Mr. Don Winder who had presented a petition from a group of people on the
North side of Galveston Street between Kimball Avenue and North Tenth Avenue for re- zoning from "AB"
Residential to "CD" Commercial.
Councilman Martin suggested that the Council ask the Mayor to write a letter requesting
in connection with future Interchange development an it applied to these three blocks.
It was agreed that Mayor Smith would contact Mr. Norm Crosby of the State Highway Department for
the desired information.
Report on Recreation program
Councilman Davenport presented a City Recreation program and said that there had been a terrific
turn out; that in the Midget League for boys from 10 to 12 years of age, there were 140 boys out as compared
to 80 for last year; 170 showed up at the Caldwell Bowl for bowling and he said the Talbot Lanes wouldn't be
available until the following week. Councilman Davenport further reported that the Director had announced
that Instructions for gymnastics and dancing wouldn't commence until next week but that 40 girls showed up
for this portion of the program. He added that the weather hadn't been to good for swimdng but 20 to 25
children had turned out for instructions in the fundamentals of Tennis and there were a goodly number using
the Golf Courses. He said that he would try to have a more comprehensive report next time.
Bills presented for end -May
It was moved by Councilman Martin, seconded by Councilman Vassar that the bills presented for end-
May be approved and that warrants be issued in the various amounts for payment of them.
A vote was taken and the motion unanimously carried.

The Council met pursuant to recess and acknowledgement of notice in the following form:
We, the undersigned Mayor and Members of the City Council of the City of Caldwell, Idaho, do each
eby acknowledge notice of a Recessed Meeting of the said City Council, to be held in the Council Chambers
the City Hall in the City of Caldwell, Idaho, at the hour of 8:00 P.M., on the 15th day of June, 1964, for
transaction of all business in connection with the following object: New and unfinished business.

rort on Recreation program
The first order of business was a report on the Recreation program by Recreation Director Charlie
raro in which he gave the following brief summary of activities and participation. Swimming - 400 signed
not counting those from other towns coming in to the Caldwell pool or to those who would be signing for
s second class; Gym Program - 60 boys and 50 girls signed for dancing with classes to be held three times
eh week; Bowling - 215 using two alleys; Library - 200 children participating; Golf - 71 boys and the girl:
dn't started as yet; Tennis - 11;0; Baseball - 496; and something, new was a girls softball league for ages
to 14 with 120 signed up.
