COUNCIL 0 R
May 26, 1980
at 8 :00 o'clock P.M.
Council met in adjourned session pursuant to adjournment.on May 12th, 1930,
with Mayor M000nnel presiding, and Councilman Bollman, Dickens, Gordon, Jobne, Leighty
and sandmeyer present, Absent: Hone.
Owing to the absence of the City Work the Mayor appointed Mr. W. C.
Dyer Acting Clerk and e.nnonnoed that the Council was in session for the consideration
of any business which might lawfully come before it.'
A representative of the traffic department of the Oregon Shortlim Railroad
Company appeared before the Council and requested that action be taken Vhich would
result in permitting the changing of the speed of its trains through the city limits
of Caldwell by moving its "Slow down" signs to a point £000 fast east of 21st Avenue
and 2000 feet West. of Srd Avenue. After discussion of the matter by the Council iti
was moved by Sandmeyer and seow ded by Bollmon that the City Attorney be inetruated
to ; draw an amendment to Ordinanoe No., 377, in order to make the same conform to the
request of the representative of the railroad company. Motion carried.

Emile A. Shorb being duly sworn, deposes and says that he is foreman of CALDWELL
PUBLISHING OWANY, publisher of Me Caldwell Hews- Tribune, a semi- weekl9 newspaper
published at Oalgwell, Idaho; that the Said paper is in general circulation in the
County aforesaid; and has been for a W rind of 78 weeks preceding first publioatim
of this advertisement, a copy of which 1s attached hereto, and was published in the
regular edition of said The Caldwell Bewe- Tribuns three ooneecutive weeks beginnin4
with the issue of May 18, 1930 and ending with the issue of May 22, 1930.

The City Olerk reported that no objections had been filed to the Assessment
Roll of Local Improvement District No. 11. YA:erenpon the following order was made add
entered by unanimous action of the Council:

AN ORDER APPROOIRG AND OONFIRMIHG TEO ASSESSMENT ROLL OF LOCAL IMPMVENENT
DISTRICT N0. 11, FOR ME OITY OF CALDWELL, IDAHO.
IT APPEARING to the Council that the Assessment Roll of Local Improvement
District No. 11, for the City of Caldwell, Idaho; has been certified by the Committee
on Streets and the City Engineer of the City of Oaldwell, and was filed in the office
of the City Clerk of said city, on the 12th day or May, 1930,, and is now on file in Said
Office-. and
IT APPEARING, that the 26th day of May, 1930, at 5 :00 o'clock p.m., at the
City Hall in said city, was fixed by the Council for hearing and considering objections
to said Assessment Roll: and
IT FURTHER APPEARING, that the time for filing protests having expired. and
the time for hearing and considering the same having arrived and no protests having

been filed, and said Assessment Roll having boon fully and duly ooneidered by
the Mayor and Council of the City of Caldwell, and having been found legal, valid,
correct, fair and just and in compliance nth the laws of the State of Idaho,
and the ordinances of the City of Caldwell, in all particulars= now, it is hereby
ORDERRB. by the Mayor and Council of the City of Caldwell, Idaho:
section 1. That the Assessment Roll of Local Imissovement Distriot Ea.
il, for the City of Caldwell, in the County of Canyon State of Idaho be and the
same is hereby approved and confirmed.
sea. 2. That the Said Assessment Roll be placed in the heads of the
City Treasurer for collection. and that due notice of the time, place Bnd - mamner
*of making cash payments of the aseesemente contained in said Assessment Roll, be
given in the manner provided by the laws of the State of Idaho, and the ordinances
of the City of Caldwell.
The minutes of the meetings of May 6th, and May 12th, 1980 were read
and on motion by Leighty Seconded by Diokens were approved.
Thereupon, motion was made by Leighty, seconded by Dialens that further
consideration of the bid of H. J. MoNeel for performing labor, furnishing materials
and constructing the works proposed to be constrcoted in Local Street Improvement
District No. 9, of the City of Caldwell, Idaho, be continued for further considers.

in the city Hall, in the City of Caldwell, June 2, 1930 at 6:00 o'clock P.M. Those
voting in the affirmative: Bollman, Dickens, Gordon, Jolins, Aeighty' and 9andboyer.
Those voting in the negative: None. Absent aid not voting-. bone. Thereupon,
the Mayne declared the motion carried.
The Clerk presented and read to the council a form of contract be-
tween the City of Caldwell and the brogan Shortline & ailroad Company for an
easement across the railroad right -of -way on Kimball Avenue for the installation
of conduits for the street lighting System In Local street Improvement District
80. 10. After discussion of the form of contract by the council it was moved by R
sandmeyer and seconded by Leighty that the form of contract be approved, And
that the Mayor and Acting City Clerk be authorized and directed to sign said
contract for and on behalf of the City of Caldwell, and that the Acting City Clerk
affix the seal of the City of Caldwell thereto. Motion carried.
Thereupon it was moved by dollman and seoonded.by Viokems that the Council
adjourn. Motion carried.
