The Mayor requested that everyone stand and give the Pledge of
Allegiance to the Flag.
The Roll of the City Council was called with the following
members pr?sent: MalWa, Marcus, Cowles, Raymond, and Norman.
Absent Carter.

The 7 asked if there was anyone from the audience who cared
to bring anything before the City Council that was not on the
prepared Agenda. As there was no one the Mayor declared that
the Meeting - would continue as outlined.
OLD '�'USINESS
(REPORT FROM J.U.D. FJH�GINET,<.S)
!'he Mayor statetJ that al.]. members of the City Council received a
Bio-Energy Recovery Study for the Cities of Nampa and Caldwell
from J.U.M. Engineers. A representative from the Company, Kirby
Vickers, was present at this meeting to give a report an the
s t u d y . Mr. Vic,;' was recognized and discussed at some lengtn
with the City Council the study that was requestH by both the
City of Caldwell and the City of Nampa. Mr. Vickers stated that
the project of 'building a refuse incineration plant in the County
that could ' .>reduce saleable energy in the form of steam was not
only feasible, but also cost effective.
The City Council agreed to take the study under advisement for
possible further action at a later date.

The X.ayor stated that he would, like to recognize Darrol HocketIc
from the Civil Defense to address this itcm On the Agon--
Mr. Nockett informed the City Council that the issue at this
point in the planning stage of the 9-1-1 Program was to g2tt
started. one of the first steps necessary was for the City and
the County to pass a Resolution si o,rin that they agree to
partici,p in the system �,, process. The Coonty dij this

The Board of County Commissioners is committed to the
concept of a 911 emergency dispatch system for the health,
safety, and benefit of all citizens of Canyon County, and
the Board will provide, as _;uickly an, efficiently as
possible, a Public Safety Answering Point for all County
telephone prefixes which can be mate accessible to a 911
emergency service; that the County shall bear the cost of
the Public Safety Answering Point and the cost of direct
dispatch for all agencies which choose to accept direct
dispatch; the County will bear the cost of handling ant,
effecting the direct transfer of emorq ncy se.rviC2 calls to
those agencies which choose to handle their own dispatch;
the cost of the transfer lin to affect transfer of
em,era2ncy service calls from Public Safety Answering Point
to tnosc agencies choosing to 'nandl.- their own dispatcn mnust
be borne by those agencies.
M Hackett further said that Edith regard' to organizing the plan,
on the 29th of February a meeting was held with the Mayors of
Nampa and Caldwell, the Fire Chiefs, the Police Chiefs,
Paramedics, Sheriffs, and etc. A Task Force was appointed at
that time which was relatively non effective. Tie reason for

this being that the costs needed to be ascertained and could not
be done until. the Plan was better organized. Van Bishop ;_Manned
to be at the meeting today, but was unable to do so, but stated
that be would happy to attend a planning and work session with
the cities. Fr. I-Iockett said that Mr _ Bishop was the man they
decided should draw tq the agreements and etc., as he has had a
cheat deal of experience in this area and also some legal
qualifications. Mr. Bishop also knew how the system should be
configured, costs and etc.
Mr. 'Hockett further said that there was also a decision that had
to be made with regard to t'e area to be covered. This was more
or loss answerecl in the County Resolution passed by the
Commissioners as well as the inventory of emergency services ar,d
selection and location of public safety answering point.
Deciding on answering center modes would have to be worked out on
an individual basis. Planninq activities would be the
coordination of the contiguous agencies. Mr. Hockett further
explained to the City Council other: planning matters that must be
addressed.
Mr. Hockett stated that the main issue at this time was to get
started. Ne would ask that the City of Caldwell adopt a
Resolution similar to the County's showing that they agree to
participate in the System Planning Process. This would not be
agreeing to dollars, equipment or people, but simply that the
City was willing to sit down and Work with Mr. 'Rishop to get the
agreements and plans organized.
MOVED by Mal-lea, SECONDED by Raymond that the City Clerk prepare
a Resolution as requested by Mr. Flockett for possible action at
the next City Council M=eeting.

(UPDATE Oi] DAY CARE ORDINANCE)
The Mayor informed the City Council. that the City of Caldwell has
been interested in this type of Ordinance for some time. A lot
of excellent information has been secured lately and the Mayor
felt it was something essential to pursue. The Cities of Boise
and Pocatello have been contacted and information requested for
then as to how they have handled this issue. The Mayor further_
said that he thought a thorough background investigation was
important. As soon as information was received back from the
City Attorney, copies Will be submitted to the Council and the
proposed ordinance will be pursued.
Councilwoman Mallea questioned as to whether there was a legal
problem in licensing a srecific industry and she would ask that
the Mayor request some input from the City Attorney on this
particular item.

(PUBLIC HEARING ON VACATION OF RICE DETTw :'E. N T,AFT AND PLYMOUTH)
The Mayor requested that Ron Redmond, the City Engineer, explain
the vacation. Mr. Redmond reminded the City Council that the
City sold a piece of property just a few sleeks ago to Mr. Gans.
it was found out previously that some of their buildings and
their septic tank field were on City property. Mr. Gans asked
that the City sell them the piece of property that they had
previously been led to believe was already theirs. The City did
do this after a ;.public hearing some five or six weeks ago. There
was, however, Rice Road which split the nieces of property sold
to them and also occupied a portion of the property that they
initially owned. In order to try to resolve the problem and get
the Gans on their property and clear up a problem, it behooves
the City to vacate a portion of Rice Road - that line between
what would be the Notus Black Canyon Canal and West Plymouth,

feasibility of the city over using that for road right of way was

Casebolt stated that she lived across the street on Plymouth from

because it was a continuing sore spot to her across the street.
The old house burned down in October of 1980 and it was never
cleaned up. The snow brake ,town the roof of the old shed across
from the for which shL was glad for, but they have done nothinq,
about it. Her concern was whothor that' were go to try to put
a trailer park in front of her house. if they to, she would
surely contest it- This was her motive in being her - to see
what their object was in having the right of way or whatevar it

The Mayor asked if anyone had any knowledge as to the intent.

Councilman Raymond stated that as he recalled there was not that
much land involved to add expansion for residences. it was Just
to clarify the property line for the residents already there.
Councilmnan Cowles stated that be requestetf that they clean them
property up at the time it was sold to them. birs. Casebolt
further said that they were planning to sell their home and it
would helo to sell if they would clean up the property across
from them. Councilman Cowles informed Mrs. Casebolt that to
clean the property up was one of the conditions of the sale and
they were very much aware of the request. He would guarantee
that it would be d one.
firs. Casebolt said that she had be there for thirteen years and
had, inquired as to wnat could be done with the condition of the
Gans' property before. She felt that to speak here tonight a
goon time to make the City aware of the p roble7 . The Mayor
stated that Mrs. Casebolt hat a va I i 5 po i nt of concern, and the
City would pursue it a do whatever they can.

the mayor. Mrs. nreshears said that she lived up on the hill
from the property under discussion. One question she would like

and explained just where the vacation under consideration was.

Mrs. Casebolt further asked why the Posti stated that
Plymnouth was not West Plymouth, but the City of Caldwell says
that it was West Plymouth. She w,,is informed that the Post Office
was advised to use whatever address the City gives the street.

MOVED by Raymond, SECONDED by Mallea that Bill. No. 10 be passed
and entitled Ordinance No. 1672.

(RECOMMENDATION FROM PLArdNING' AND ZONING COMMISSION ON PLAN AND ZONE
CHA NGE ON SOUTH FLORIDA)
Mfrs. Robison was recognized by the 'Mayor and pointed out the area
on a map for the benefit of the City Council. The Planning and
Zoning Commission held public hearings on plan zone and special
use permits for a mobile home mark that the developer of
designated property would like to put in. The Commission granted
the special use permit conditioned upon final approval of the
plan and zone changes. The Public Hearing to be scheduled would
be on whether or not the plan and zone should be changed to
accommodate high density residential which was required for
mobile hone parks. A complete copy of the minutes from the
Planning and Zoning Commission will be distributed to the Council.

The Mayor then set the date for the Public Hearing as June 19th,
1984, at the Regular City Council Meeting.
(TREE PROGRAM - ROSS PETERSON)
The .Mayor called on Ross Peterson to give a short report with
regard to the tree program,
Mr. Peterson Stated that he distributed to each member of the
City Council a report on the recent. Seminar he attended). 0n•e o
his main concerns was to pursue seeing that more trees were
planted in the City of Caldwell. Other cities in the
northwestern States are using volunteer people such as Scouts,
students, and etc. to plant trees. The City could raise trees
reasonably cheap, very little maintenance on the nursery, the
cost of the trees not being very much. A goal should be set to
plant so many trees a year depending on the interest shown.
Tine Mayor said that he .could like to have Mr. Peterson start a
True Program in the City of Caldwell.. Some publicity ;could be
necessary to accomplish the program. The Mayor further stated

that he would like to have Mr Peterson r ive this nro,
program some thought and proceeds towards s tarting a tree Diantin":
project in the City. Council agreed gait t.nis project,
Mr. Peterson further stated that he would' like to start r opia cinc,-
the elm trees in the Park with a more desirable type of tree.
This could be done in a fifteen to t% year program. Ti I a
City Engineer suggested an aerial -,nap so they could plan just ho

Councilwoman Nallea infor.nod ".1r. Peterson that monies were put in

how many trees he wou 16 need Councilwoman mallea said that

needed for next year, it could be budgeted. She would ask that
he make some kin G of an estimate before the budget was
completed.
Mr. Peterson also informed the City Council that the City of
Boise was selling their elm wood and had been doing so for three
years . They have a lot 0ere they Vep the wood and people come
there to cut it up and buy it. Vn-e City of Boise figure that L`ne

Peterson said that he would like to start doing His. The Mayor
agreed that this was also a good idea. The City of Caliwali's
Code now states that it can't I ca burned unless it is Banc'
etc., and he though.t this was not necessary.

Councilwoman - , allea reported that Ees Summers called and asked
for a meeting concerning thc furnishings for the new City Hall.

include in the tentative budget. The Council Room was not

nned as yet and chairs for that area had to be decided on.

the Pinance Officer and she would like to start working on the
budget on the 4th of June at 8:00 A.M. All members of the
Council were asked to take part.
