The Council met pursuant to call and acknowledgment of notioe in the following form:
CALL AND ACKNOWLEDG1 OF NOTICE
We, the undersigned Mayor and Members of the City Council of the City of Caldwell, Idaho, do each
hereby acknowledge notice of a special meeting of the said City Council to he held at the Council Chambers
in the City Hall in the City of Caldwell Idaho, at the hour of 6:00 o'clock P. 14. on the 14th, day of May
1958, for the transaction of all business in connection with the following subject: Council to act as an
Adjustment Board on garbage charges, which object was presented to each of the undersigned in writing.

The Mayor informed the Council the meeting was called to hear protest on garbage charges.
Each protestant was interviewed privately. it
After forty protestants were inte viewed it was unanimously agreed by the Council to continue
hearing May 16, 1958, at 7:90 P. M.
Thereupon Councilman Shorb read a number of letters from citizens protesting garbage charges.
These letters were referred to Inspector Geo Sweet.
Councilman Eldredge: Hardship cases where conce._ -sions are made should be informed the garbage
� service is available to them without charge.

The following "Questions and Answers on the Caldwell Sanitary Service 'ystem" was presented by
Inspector Geo Sweet:
The following is for the purpose of providing answers to some of the questions you as
a customer may have regarding the City's Sanitary Service System as provided for in Ordnance
No. 919 and /or rules and regulatiens:
Q. Who must use the Sanitary Service System?
A. Every owner and occupant of premises within the prescribed limits of the City of
Caldwell except that in sparsely populated areas of the City where the collection
of garbage and refuse on the schedules set Forth would be impraticable, the City
Council may issue a special permit altering the time and extent of collection.
Q. Who is authorized to collect, transport and dispose of refuse?
A. Only those who are licensed or have a contract therefor as an authorized represent -
ative the City.
Q. What materials are not acceptable for collection?
A. Litt or earth debris from construction or lawn renovation, rocks, stones, automobile
bodies and parts, dead animals, building materials such as masonry, plaster, scrap lumber,
and wood shavings, are not acceptable for collection, and such items shall be collected
and disposed of by the building contractor, owner, or occupant of the premises.
Q. Can refuse he accumulated?
A. No.
Q. Can compost piles be maintained?
A. They may be maintained for fertilization purposes. .later used for fertilization
purposes.only may be transported, kent and used, provided ttiat it does not constitute
a nuisance or violate andy ordinance, or any rule or regulation of the Fire Leoartment.
Q. Can rubbish or garbage be disposed of by burning, incinerating or burying?
A. No, except that any person, firm, or corporation may use an incinerator in the in-
terior of a building bet - the hour of 7300 A. M. and 7:00 P. M., provided such in-
cinerator meets the requirements of the Building Code. Such burning does not include
the burning of garbage. Burning of rubbish (not of garbage) is allowed in exterior -inc,
between the hours of 9:00 A. 14. end 5:00 P. M. providing that such incinerators shall
be built of noncombustible material and shall have a minimum ten foot stack covered by
one -inch wire mish screen.
Out -door fireplaces, barbecue pits, or grills may be used in preparing food, or
for recreational purposes.
Q. What about open burning?
A. When not practicable for hauling, burning of rubbish may be done in vacant lots
by the owner upon obtaining a permit from the Fire Department for such burning.
Q. Can rubbish, garbage or refuse be discarded- in or upon the streets, alleys, side-
walks or vacant grounds or in or anon canals, irri; ditches, drainaoe ditches or
other water courses?
A. No. Suen action constitutes a misdemeanor.
Q. What is the proper container for garbage?
A. A metal or other approved type o." container must be used, shall be waterti; and
not easily corrodible, rodent and flyproof, shall be equipped with handles and a close
fitting lid. It shall be not less than twenty (20) pallson capacity, nor more than
thirty -two (72) gallons capacity, and limited tb one hundred (100) pounds in weight.
The container shall be hot - dinned after fabrication to assure non- leaing cans, or a can
that is guaranteed by the manufacturer and so labeled to be leakproof regardless of the
manufacturing processes.
Q. What is the proper container for other than garbage?
A. Rubbish consisting only of cardboard, or wooden boxes, brush, leaves, weeds, and
cuttings from trees, lawns, shrubs, and gardens may be kept separately without deposing
in the garbage container providing that bulk materials, such as leaves shall be in a
can, box, sack, or receptacle for ease of loading and that brush, etc., shall be tied
in bundles not exceed four (4) feet in len„th.
Q. Does the garbage have to be separated from other refuse?
A. No. Garbage must be placed in the proper container and other types of refuse may be
placed in the same can. All garb,.ge must, before deposit in such can, be wrapped im
paper or other material so as to prevent the escape of liquids therefrom.
Q. Is there an additional charge for extra containers o` rubbish?
A. No. It is required, however, that the containers be such that they may be easily
handled for the purpose of loading.
Q. Where are garbage or refuse cans to be placed for collection?
A. All garbage or refuse cans shall be placed in a place accessible to the collector
provided that in the cane of isolated dwellings or places of business or where reason-
able access cannot be had by a truck, the cans may be kept in such places as may be
agreed u-on by the owner and collector, or at such place as may be designated by the
Inspector. Provided further, that where there is no alley entrance, such cans shall be
placed on the street curb on collection day.
Q. Is there a carry -out service?
A. Yes, the service is provided by making the necessary arrangements with the collector
at a nominal extra charge. This charge will be included on the•City billing.
Q. How are the Sanitary billings to be made?
A. They will be billed by the City and such fees shall be carried on the water and sewer
bill, and the same shall be paid with the water and sewer bills.
Q. When does the Sanitary Service system become effective?

A. The Service became effective on May 1, 19 8, Your first statement for sanitary
service is a percentage of the total wont'' -ly charge corresponding to the period
of time from May 1, 1958 to the date appearing upon your statement. Statements
for June will be or the total monthly charge.
Q. Ylhat is the collection period?
A. Service is to be provided at least twice each week for the five (5) months
period, May 15, through October 15, and at least once each week for the remaining
months of the year, or as provided by the rules and regulations of the City Council.
Q, When does service begin and when is it discontinued?
A. Service begins when the water meter is turned on and is discontinued when the
the water meter is turned off except where siecific arrangements are made prior to
a prolonged 'absence when the water meter is left on and providing further that there
is no garbage, rubbish or trash for disposal during that time. There e7 to
this would be in those cases where there a no water meters. This does not apply
unless absence is in excess of 30 days,
Q. What are the fees?
A. a. Single family units. -31.25
b. Duples served thru one water meter 42.00
c. Apartments. - $1.25 first unit; 75¢ each additional unit that is equipped
with kitchen facilities.
d. Rooming houses.-$1.25 first unit; 25¢ each rented sleeping room,
e. All other charges to be negotiated and would include such classifications as
follows: Businesses, Nursing hones, Motels, Churches, Schools, Trailer courts.
Provided further, that where the enforcement of these provisions would works financial
hardship or where the amount of refuse and garbage is of such small amounts as to not
warrant the collection o" the full charges, the Mayor and Council may issue a special
permit altering those provisions.
Q. Whom should you call regarding burning?
A. The Fire Department- Telephone, 9 -2421
Q. Whom should yoj call regarding billings?
A. The City Hall - Telephone 9 -3232
Q: Whomshould you call regarding the enforcement of the provisions of the ordinance
And to register complaints pertaining to collections?
A. The Sanitary Inspector at the Police Department- Telephone 9 -4651
Q. Whom should you call regarding the days and time for collections?
A. The Sanitary Collector at the Caldwell Sanitary Service- Telephone 9 -3471.
A "Prelininary Draft" of the - arbige entrant was studied.
The following comments were ade by Council Eembers: -
Councilman Eldredge: Anyone living within the City Linits should have the right to have garbage
collected, but those living in scarcely settled districts should notify the City. If City is to collect for
carry -outs, City Inspector should negotiate with the customer. The City should not be ligble for damages.
ContraCtcrshould be carefully checked in regards to carry -outs. Any charge over 50¢ should be checked by
Inspector. If City is to collect for pick -ups 20% should be retained by the City.
Councilman Vassari Garbage collection and charges should be set -up in a uniform manner and 20%
of everything the City co elects should be retained by the City.
Councilman Shorb: Contractor should have leak proof trucks and be instructed to replace lids on
trucks.

Attention: Design Department - E. V. Peterson or Howard Mattson
Dear Sir:
The plans for the one -way couplet on Cleveland Boulevard and Blaine Street have been
reviewed by my office and I have the following comments to maize.
The plans provide for the removal of 8 -inch by 57 feet of irrigation line and that this
is to be replaced with 12 -inch pipe. The above replacement is from Station 1'0 +69 to
Station 19 +25 on Blaine Street. As ahown on the plans a 12 -inch line would be connected to
a 10 -inch line. The size of the existing pipe is 10 -inch instead of 8 -inch as shown.
This reduction will cause trouble and require maintenance in digging up the pipe to release
plugs which are caused by material lodging inthe reduced secti - :n. A box should be placed at
this reduction or the ioe size should be reduced such that it is the sa7a as the line below.
Your standards may •regcdre that you cannot use less than 12 -inch pipe. If you are unable to,
A '.:ox will be required at this point.
The City will, as shown on the � remove and replace 376 feet of 1, -inch galvanized
iron -,ipe, on Blaine Street from Tenth Avenue to Eleventh Avenue.
On Bla ne Street at Station 45+32 to Station 46+00, the same thing occurs as is mentioned
above. The plans call for the removal of 6 -inch by 68 feet of irrigation pipe and to be

replaced with 12 -inch ripe. Again the size should either remain the size of the
'I existing or a box should be placed where the reduction is made. At Station 767#45
on Blaine Street, the clans show that an 18 -inch by 86 nine siphon shall be con -
stn cted. A fence line is shown at thearproximate Station 67 +36 which is near
the property line, sh',ch property line 1111 be the center of a proposed connection
which the City has agreed to construct between Blaine and Cleveland Boulevard,
The street width which the City proposes to construct is life feet. Therefore, this it I
siphon should be locatedat least 24 feet West of the fence line or at Station 67 +12.

� Since the plans were made, the City has constructed curb and gutter on Oak Street
i and on Maple Street, Mich construction endedat Cleveland Biulevard. At the time the
streets were being constructed, I gave Johnson and Underkofler the grades which we
proposed to use at the property line on the Southerly side of Cleveland Boulevard.
f After these grades were given, I had to lower them to provide drainage to the West.
Theexisting grades on the ends of the curb on Oak Streetwereas follows:
f North side of Oak Street - 96.10 at top of curb.
South side of Oak Street - 96.60 at top of curb.

it The grades on the curb at the end of Maple =tree+ areas follows:

North side of Maple Street - 97.70 at top of curb
South sib of Maple Street - 97.50 at top of curb.
The lip of the gutter which was used �s a control for the grades in the plans for our
� standard curb and guttersections is 0.25 feet below curb top. The Dity datum is U.S.C.O.S.,
and I believe this was used by Johnson and Underkofler in the preparation of the plans.
ii As stat4dabove, the ends of the existing curb are at the 'outh property lone of Cleveland I I
Boulevard. The Aans show that the radii at Oak Street and Maple Street extend Westerly
on these streets beyond the property line of Cleveland Boulevard; therefore, some of the
EI existing curb will have to be removed and replaced.
All of the irrigation changes proposed on the flans must be made when water is out of
li the ditches. This is approximately from October 10 to Avri; 10.
ii It is my understanding that the Designing Department is contemplating making some changes
in thedrainage at some of the intersections on Blaihe Street. The plans call for'inverted
siphons to convey drainage water across intersections. from the City's stand point, these
are more desirable than valleys.
As a policy, we have been staying awayfrom the construction of valleys across inter-
sections and have tried to put in inverted siphons wherever possible. I realize that
li these require maintneance and are not as positive for drainage as are valleys; however, i
the convenience to the traveling public is much more desirable if valleys are not used.

i I also understand that there was some concern regarding the removal of all curb returns
and:erlacing them with new curb and gutter. Many of these are neces itated by the removal
of what we term as "baby ramps" and also by the moving of siphon boxes from the area of
crosswalks. I am not particularly concerned whether all of the curb returns are removed
and replaced as the plans show; however, I think you will find that most of thorn will have
to be reconstructed in accordance with the plans hether it is shown on the plans prior to
bidding or whether it is done by change order later. Again may I say that the drainage as
designed is much more preferred over the construction of concrete valleys.

proval of the City Attorney.
