8:00 P. M.
The Council met on call of the Mayor, with the 1flayor, Emery L. Vassar, presiding.
On Roll Call the following Councilmen answered present: Oakee,Boynton, Mumford,
JHglltngsworth and kontgomery. absent : None.
The Ma yOr informed the Council the meeting was called to take up unfinished
business, and to consider the 1936 -1937 budget.
Mr. Cohmte of the University of Idaho, appeared before the Council and explained
weed control and requested the City to furnish half of the chemicals used. The matter
was left on the table..

I. &.letter was read from R. W. Whelchel requesting the Council to cancel taxes on
Lots 13 to 16, Block a Dormans addition.
Whereupon, the following preamble and Resolution was presented by Councilman

j, WHEREAS, Mr. R.W. Whelch -1 has presented to the Mayor and Council a petition for
the cancellation of sprinkling taxes levied and assessed against lots 13 to 16, inclusive
EI of Block 8, Dorman's addition to the City of Caldwell, according to the official plat ther
of now on file and of record in the office of the recorder of Canyon County, Idaho, for
the years 1928, 1929, 1930, 1931 and 1932 in the sum of $7.30 for each of said y,•ara, and
$6.60 for each of the years 1933, 1934, and 1935, making a total of assessments, without
penalties and interest, in the sum of 664.20, and
WEE RF,AS, It is made to appear tothe Mayor and Council that the said petitioner,
R. W. Whalchel, had purchased the property at tax sale from Canyon vounty, Idaho, for scat
i and c 0 t}nty taxes, and that by reason thereof the local improvement assessment taxes
against the said property are no longer a lien thereon under the rule of law that now ob-
tained in the State of Idaho that property purchased of a county for general state and
ii . county taxes at tax sale frees the property of all local improvement district taxes and
sales, and all special assessments against the property,
NON, THEREFORE, BE IT iiESOLVED That the said sprinkling tax against the said

property for the above mentioned years in the above principal amounts for the several years
plus interest and penalties, be, and the same are, hereby cancelled, and the Treasurer of
the City of Caldwell, as the collector of all special improvement and special taxes of the
City of Caldwell, be, and he is, hereby authorized and directed to cancel upon his books
the assessments, plus interest and penalties for each of the above years on the above

described property, and to issue in suitable form any certificate or certificctes or in-
strument in writing necessary to show that the said assessments and taxes have been cancel -

ad in conformity herewith; and moved the adoption of said preamble and resolution, which C
motion was seconded by Councilmen Mumford.

A yea and nay vote was had thereon, with the following results:
Yes: Councilmen Edgar L. Oakes, F. D. Mumford, W.S.Boynton, W. R. Hollingsworth,
G. W. Montgomery and G. M, Fenrich.
No: Nona.
Absent and not voting: None.
Whereuron the Mayor declared the motion carried, and the preamble and resolution
duly adopted.
The City Clerk read a letter from the City treasurer as follows:
May 4, 1936.
To The Honorable Mayor and City Council
Caldwell, Idaho.
Dear Sirs:
I hereby ask for authority to transfer funds from those funds that
have a surplus and unexpended balance, into other funds, so that registered
warrants may be called and redeemed. As per Sec. 1715 Chapter 49 Idaho
Code Annotated 1832.

Thereupon the following preamble and resolution was presented to the Mayor and

WHFREAS, the following mentioned funds of the City of Caldwell, Idaho, have a
surplus and unexpended balance in the following amounts to -wit:

Now therefore, be it resolved, that the Treasurer of the City of Caldwell, Idaho
be and he is hereby authorized and directed to transfer on the books of the said City of

Caldwell, from the above mentioned funds to the funds harrinafter stated, to -wit:

Montgomery moved the adoption of said resolution, duly seconded by Oakes.
On roll cell a yea and nay vote was had.
Yea! Oakes,Mumford, Boynton, Hollingsworth, Montgomery and Fenrich.
Nay None.
Thereupon the Mayor declared the above resolution and preamble adopted.
There being no further business to come before the City Council, it was, on
