MOVED by McCluskey, SECONDED by Olesen to dispense with the
reading of the minutes until the Regular City Council Meeting
of May 18, 1976.
(PUBLIC HEARING - LOCAL IMPROVEMENT DISTRICT NO. 76--1)

The Mayor explained that this was a Public Hearing duly called
and advertised concerning Local Improvement District 76 -1.
The Mayor called on Don Horan, the Finance Director, to make
some opening remarks.
Mr. Horan explained to the audience that neither the Mayor nor
the City Council bring a Local Improvement District into an
existence. It was the citizens request to the City Council to
make improvements on the property that brought the Local
Improvement District into existence. At the last City Council
Meeting a Resolution of Intention was passed. Consequently,
any signer of a petition cannot remove his name from that
petition after the Resolution of Intention was passed. In the
event that the City uses interim financing, the maximum charge
for the finished Local Improvement District will be seven
percent. The Local Improvement District was being set up to
be billed semiannually and also pays bend holders semiannually.
It was.the hope of the City to sell the bonds locally. This
project was not a total property owner cost. The City would
be participating in approximately $124,500.00. The total cost
of the improvements as outlined would be approximately
$492,000.00 and this would be for the entire service area, The
City will make arrangements for partial payments on annual
assessments, but Mr. Horan stressed that he felt it was their
responsibility to come to the City to make the arrangements if
they cannot meet the payments on an annual or semiannual basis.
The payments are not equal payments and this was a misconception
the public very often had. He then gave some examples of what
payments could be, both the initial payment and on to the tenth
year. He also pointed out that nowhere under any circumstances
can the public buy this type of improvements with this kind of
interest rate.
The Mayor then recognized Elsie Parkhurst and John Dobson who
both protested the Local Improvement District No. 76 -1 due to
the fact that they were financially unable to make the payments.
The Mayor then read letters of protest from G & S Industrial
Area, Mrs. Edith King, Mrs. Raymond King, William E. Brown,
Philomena Tegge, and also a letter from Elsie Parkhurst. All
of these protests were issued due to the cost of 'the improvement.
The Mayor asked if there was anymore comments from members of
the audience. He also pointed out again to the audience that
the City of Caldwell was bearing 50% of the cost of the paving
of the streets and 100% of the cost of the intersections.
Councilwoman Williams stated that none of the protests at the

Meeting would change the percentage.
The City Attorney stated that the assessed evaluation of the
property involved in this Local Improvement District was
$2,422,522.00.
MOVED by Olesen, SECONDED by McCluskey that the City Council
deny the written and verbal protests for Local Improvement
District No. 76 -1.
MOTION CARRIED
The City Attorney explained that Mr. Horan, Finance Director,
suggested that in order to establish a numerical filing system
that the number of this Local Improvement District be
designated as 76 -1 instead of No. 71. The Sewer Local
Improvement Districts that will be forthcoming will be started
with 1 -76. This will make it easier to distinguish between the
Street and the Sewer Districts.
It was necessary, stated the City Attorney, for several motions
to be made at this time to amend the Resolution passed at the
last Regular City Council Meeting.
MOVED by McCluskey, SECONDED by Olesen that the City Council,
City of Caldwell, amend Resolution No. 14--76 by deleting all
reference to Local Improvement District No. 71 and substitute
therefore Local Improvement District No. 76 -1.
The Mayor called for a roll call vote. Those voting yes:
McCluskey, Olesen, Williams, and Bauman. Those voting no;
none. Absent and not voting: Raymond and Banks.
MOTION CARRIED
MOVED by McCluskey, SECONDED by Olesen that said Resolution
No. 14 -76, as amended, shall be ratified and approved by the
City Council; and further that the City Attorney is hereby
directed to prepare an Ordinance creating Improvement District
pursuant to Title 50, Chapter 17, Idaho Code, and present said
Ordinance creating Improvement District to the City Council,
City of Caldwell, at its next regularly scheduled meeting.
The Mayor called for a roll call vote. Those voting yes:
McCluskey, Olesen, Williams, and Bauman. Those voting no:
none. Absent and not voting: Raymond and Banks.

MOVED by McCluskey, SECONDED by Olesen that the City Clerk be
directed to report the following findings in the minutes of the
meeting of May 11, 1976, to -wit:
That at the time set for public hearing, the City Council
has examined the Petition for Local Improvement District No.
76 -1 and determined the value of property included in proposed
Local Improvement District No. 76 -1, the purposes of the
creation of the district and all other matters pertinent to
the organization of the district and finds that the Petition
is proper, that the Local Improvement District will be for the
best interest of the property affected and the municipality
and that there is a reasonable that the obligations
of such Local Improvement District No. 76 -1 will be paid.

McCluskey, Olesen, Williams, and Bauman. Those voting no: none.

MOTION CARRIED
Councilman Olesen stated that he wished to emphasize to
the public again that the City Council has no other alternative
than to establish this District as it was requested by the
property owners. The City Council encouraged those who might
have some financial problems to get in touch with the Finance
Director for assistance in establishing a program for payment.
These payments would not begin until August, 1977.
There being no further business, the meeting was adjourned at
8:30 P.M.
