COUNCIL CHAMBERS

The regular monthly meeting of the City Council met in the Council Chambers of the City ball, with
Mayor N. B. ° Coley" Smith presiding.
Upon Roll Call, the following Councilmen answered presents E. L. Vassar, Max Laby, James W. 'Bill
Keys, V. Jay Martin, Charles W. Carpenter, and C. A. Davenport. Absent$ none.
Bide opened for construction under, L.I D #55
Mayor Smith announced that the first order of business would be the opening of bide for construc-
tion work under Local Improvement District No. 55 and further stated that theta had been a misunderstanding
in the specifications amd should any bidder who had not included a certified check with their bid, be the
successful bidder, be would be required to furnish the check before the bid could be awarded.
The following bids were then opened for the consideration of the Council

Upon request of the City Engineer, any further action was hold in obeyance while the extensions
of each bid was being chocked.
Bids opened for Curb and Gutter along Poynter A and Armory
Mayor Smith then calf for the bid opening for curb and Hatter along city property on Poynter
Avenue and at the Armory. City Engineer Melvin G. Lewis explained that these specifications provided for th
excavation work to be done by the City.

Assessments for removal of weeds, rubbish, and grass during 1963 filed
Mayor Smith reported to the Council that on Mob. 1, 1964 the Clark had filed the assessments for
removal of weeds, rubbish, and grass by the City during 1963 with the County Assessor and County Clerk,
Recorder and Auditor as provided for in the City Code and as authorized by the provisions of 50 -1147 of the
Idaho Code.
Report of Sanitation Department
A monthly report of the Sanitation Department for the month of April was presented to the Council
by Mayor Smith.
Appointment of Volunteer Fireman approved

It was moved by Councilmen Carpenter, seconded by Councilman Martin that the appointment of Bill
as a Volunteer on the Caldwell Fire Department be approved as recommanded. A vote was taken and the

shich was read for the first time and the Council proceeded to consideration of Bill No. 8. It was moved by
.ouncilmen- Davenport, seconded by Councilman Vassar that the rules requiring the reading of a Bill on three
separate days be suspended and that Bill No. 8 be read the second time by title and the third time in full,
section by section. The Mayor directed the Clerk to call the roll on the above motion with the following
result- Those voting in the affirmative were- Vassar, Luby, Keys, Martin, Carpenter, and Davenport.
Negative voteat none. Absent and not voting' none. The Mayor declared the motion had passed by the
necessary three - fourths majority and directed the Clerk to read Bill No. 8 the second time by title and the
third time in full, section by section. the Clerk read the Bill as directed. It was moved by Councilman
Davenport, seconded by Councilman Vassar that Bill No. 8 pans. The Mayor directed the Clark to can the
roll on the above motion which resulted as follows= Those voting in the affirmative were- Vassar, Laby,
Keys, Martin, Carpenter, and Davenport. Negative votes= none. Absent and not voting- none. Thereupon,
the Mayor declared Bill No. 8 had passed and the for in open session of the Council duly signed and
approved the Bill and the Clerk duly signed and attested the same which became Ordinance Be. 1026.
The Mayor directed the Clerk to make proper entry of the same and to Cauca Ordinance No. 1028 to
he published in the News - Tribune, the official newspaper of the City of Caldwell Idaho.
Bids awarded - L.I.D. #55 construction work and the curb & gutter along Paynter e
City Engineer Mel Lewis reported that the extensions and totals of the bids opened for constracti
work in Local Improvement District No. 55 and for the curb and gutter along Paynter Avenue were found to ba
correct and that he could see no reason why the bide couldn't be awarded to the low bidder in each instance.
It was moved by Councilman Vassar, seconded by Councilman Keys that the contract work in Local
Improvement District No. 55 and for the curb anti gutter along Poynter Avenue be awarded per the low bids to
J. M. Hess Construction of Route No. 5 in Nmapa, Idaho. A vote was takan and the motion unanimously carried.
Exception to bonding provision for Door -to -Door S License granted
Mayor Smith informed the Council that a spraying contractor, Mr. Roger Corn who was present, had
a problem in Complying with the bonding portion of the Door -to -Door Salesman license section of the Code in
that local boys in his crew were under 18 years of age and were not, because of their ages, able to provide
individual bonds in the amount specified for each worker; that Mr. Corn felt it was very penalising for the
boys not to be able to work in his crews this ewer and had requested that they be permitted to work wrier
the Company blanket bond. The firm name was "Speedex Pest Control" a the MWor stag that there bad been
no trouble with the firm in the past.
It was moved by Councilman Vassar, seconded by Councilman Carpenter that an exception be made in
this instance and that the Firm bond be accepted for the boys under 18 years of age with the total amount of
coverage to be determined by accumulating the individual amounts of $1,000.00 for each boy licensed under
such exception. A vote was taken and the motion unanimousl carried.
pplications for reduced fee on Door -to -Door Salesman licenses denied
Applications for reduced fee on Door -to -Door Salesman licenses were presented for the mnsideraticn
f the Council with each of the applicants desiring to obtain a license for soliciting magazine subscriptions
or the "National Circulating Company" located at 1270 6th Ave. in New York, N.Y. Those requesting the re-
uced fee were as follows- Chester L. Holmberg, Stockton, California; Jack Duane Morris, Yakima, Washington;
ichard O. Elzie, Crownsville, Md.; Daniel L. Anglin, Alexandra, Virginias Larry "sea, San Jon, Now Mexico
nner R. Stoitenberg, Bettendorf, Iowa; Kathleen Bosanco, Cloverdale, California; and Robert Carl Schsinoat,
ston, Nebraska.
It was moved by Councilman Vassar, seconded by Councilman Davenport that the applications for re-
coed fees by the aforementioned applicants be not approved. A vote was taken and the motion unanimously
delegate designated for the Idaho Munici al League Convention
An announcement of the coming Idaho municipal League convention in McCall, Idaho on June 18, 19,

and 20 was made and that the City, as a member city, should designate an authorized representative to be
recognized as the voting delegate at the convention.
It was moved by Councilman Vassar, seconded by Councilman Martin that Mayor N. E. "Coley" Smith
be designated as the voting delegate to represent the City at the coming Idaho Municipal League animal
business meeting. A vote was taken and the motion unanimously carried.
Request for City of the pear" entries announced - Idaho Municipal League
Announcement of plane for selecting the Idaho City for the year and that the Ladies Auxiliary and
Board of Directors of the Idaho Municipal League were accepting nominations for participants was made by
Mayor Smith.
Be informed the Council that Villiages and Cities who were interested in competing for this title
were urged to begin now in preparing a scrap book and said that entries would be accepted at the registrat-
ion dent at the convention. Material submitting necessary information required bad been received and a
"City of the pear" plaque would be presented to the winner of the contest.
Major medical insurance program for employees reviewed
A matter of unfinished business relative to a review of the major medical insurance program for
employees was referred to (see page 85 of November 4, 1963 meeting). Mayor Smith stated that all of the
personal investigating that he had done with other toms that had really studied the program seemed to in-
dicate that it would be a waste of times also, be had informed those insurance people who had contacted him
that they could review the City' plan it they wanted to and could submit a proposal but that he didn
think it looked very reasonable now for the City to go into a complete review of the major medical insurance
program. Be then asked the Council for a statement of their position regarding this matter of unfinished
business.
After some brief discussion, it was moved by Councilman Martin, seconded by Councilman Davenport
that the City's major medical program for employees not be reviewed at thin time. A vote was taken and the
motion unanimously carried. . -
Flu shots at City wanes discussed and not approved
Mayor Smith referred to the matter of Fire Department employees having received flu shots in the
past with the City paying the cost and stated that he had been Contacted by one of the Local Drug Firms
wanting to make an order for next year for all City employees. The Mayor expressed the opinion that if they
Were going to be made available to some employees at City expense, it seemed reasonable that they be made
available to all employees.
Councilman Martin expressed the assumption that the reason for giving the shots to the Firemen was
due to the possibility of exposure in fighting fires.
In further discussion, mention was made of exposures in other departments, loss of working time to
the City while employees were ill, the problem of maintaining services during illness of employees, as well
as other types of exposure such as tetanus for employees at the sewage treatment plant for which these
employees were now required to obtain inoculations at their own expense.
It was agreed that inoculations would not be furnished employees at City expense and Mayor Smith
stated that he would so inform Mr. paddock, Fire Chief.
Announcement of offer to negotiate with School Board on trading of land
Mayor Smith informed the Council that, in line with some of their former discussion, he had
written a letter to the school Board suggesting that there might be room for negotiations in the trading of
Land from Madison Street for a well site over on the Wilson School ground but that there had been no action
m it. Be asked the Council to be thinking about it,

Councilman Vassar inquires for information on the present status of the trade of property with the
ilks Lodge and Mayor Smith explained that Mr. Dean Miller had been in to see him on this date, that there
ribht be an additional request to come before the Council at a later meeting but that there was nothing
burher to be taken up at this meeting regarding this particular property.
, pplications for Bartender Permits approved
Applications for Bartender Permits were presented for the consideration of the Council from Sylvia
row, Marl" Starr, and Wilma L. Fleetwood. Each application had been approved by the Chief of police and
he required Fee of $2.50 had been paid to the City Clerk. It was moved by Councilman Martin, seconded by
auncilman Davenport that the applications be approved and that permits be issued. A vote was taken and the

motion unanimously carried.
Information requested for registrations at Idaho Municipal League Convention
A poll of the Councilmen was made at this time in order to determine those who were planning to
attend the Idaho Municipal League convention in McCall on June 18, 19, and 20. Councilman Vassar, Davenport,
Carpenter, and Martin indicated that they thought they would be able to attend. Reservation forme were re-
sted as soon as possible and it was suggested that they be returned to the Clerk not later than the 14th.
Possible Code amendments and legislation suggested
Mayor with suggested, for future consideration of the Council, the possibility of amending the
City dog ordinance to provide for a progressively lamer fine on each violation for a dog running at large
rather than as now provided in that there is a set fine of $5.00 on each violation, and, also for possible
legislation aimed at controlling observe and abusive telephone calls to residents of the City. The eaggesti
were briefly discussed but no formal action taken at this time.
Monthly police department report presented
Mayor Smith then presented the monthly report of the Police Department to the Council for their
information and review.
Authorization given to proceed with formation of Auxiliary Police Unit
Police Chief Charles Aetleford presented the proposed organizational plan for an Auxiliary Police
Unit for his department. He stated that it was something which he felt had been needed for Boma time and
mentioned various community activities for which his department could use the additional personnel which the
unit would provide. The organizational plan was reviewed by Chief Astleford afterwhich he stated that he had
looked into the insurance aspect of the unit and according to the State Insurance Lund, he didn't believe
there would be enough monetary value to go into it; however, he had checked with the Nampa Police Department
who had an insurance policy with the Hartford Insurance Company which sounded like a very good program at a
coat of $14.00 per man per year with the Auxiliary officer being covered enroute to a drill meeting, while he
was at the drill meeting, while he was on duty, and enroute back home. In conclusion, Mr. Astleford stated
that he was asking the M ayor and Council for authority to proceed with the formation of the unit.
City Attorney 0igray referred to the organisational plan for the unit and pointed out that under
the drafted plan, the Mayor and Council would have no control over who the officers of the Auxiliary were or
of the personnel as it would be a matter of decision by the Chief of Police and Mr. aigray stated that he was
merely asking if this was the wishes of the Mayor and Council.
Chief Astlaford explained that this was in accordance with the Auxiliary organizations in ether
surrounding Cities and it was then agreed by the Mayor and Council that this part of the plan was acceptable
to them.
It was moved by Councilman Vassar, seconded by Councilman Davenport that the Chief of Police be
authorized to proceed with the organisation of the Auxiliary in accordance with the plan presented. A vote
was taken and the motion unanimously carried.
Statement for damages - Leland W. Shell
A statement for damages from Deland W. Shall of 2320 So. Illinois in Caldwell under date of May 1,
1964 was presented for the consideration of the Council. The statement was for one flowering Almond destroys
because of negligence on the part of Irrigation workman on April 23, 19649 on Walnut St. between Iowa and
Illinois according to the statement and it was in an amount of $5.00.
In explanation by City Kngineer Mel Lewis, he stated that the irrigation box lid had apparently
slid over onto the shrub when it was removed from the box; however, the irrigation box and the shrub was all
on right -of -way and he couldn't state as to the liability.
It was moved by Councilman Vassar, seconded by Councilman Keys that the claim be denied and that it
be referred to the City's Insurance Underwriters for determination. A vote was taken and the motion unanim-
ously carried.
Bids opened for purchase of Delivery Van for Water Department
City %inear Mel Lewis explained the specifications used for the purchase of a Delivery Van for
the Water Department and stated that An alternate bid had been asked for so that, if it was deemed advisable
by the Council, the 1953 OMC 3/4 ton pickup listed as a trade -in could be retained and transferred to the
Oolf Department where there was a need for another pick -up. The following bids ware then opened$

hereby acknowledge notice of a R ecessed Meeting of the said City C ouncil, to be held in the Council Chambers
in the City Ball in the City of Caldwell, Idaho, at the hour of 8900 P.M., on the 18th day of May, 1 964, for

Mr. Jack Howard addressed the Mayor and Council and stated that he was building a duplex and that
the house would be over the 24" irrigation line, that he wondered if he could put the footings for the
roundation on each aide of the line and then change it (the irrigation line) this fall.
Councilman Keys stated that he had looked at the situation with Mr. Howes and that the main line
rould cross under the corner of the house and about ten feet back from the corner] that in recognising the
'act that the pipe and water was property of the City and also recognising that there was quite a liability
nvOlved in building over the line, he had suggested to Mr. Howard that he discuss the problem with the
ouncil. Councilman Keys further stated that Mr. Howard was willing to sign any legal release to the City
nd that he would seems any and all liability should the line develop a leak causing damage to the property
r the house as well as place a deposit with the City for the cost of changing the line this fall.
In answer to the question, City Engineer Mel Lewis stated that he thought this was in the line of
