COT CFL41BERS, MAY 4th, , 1936,
8:00 P. M.
The Regular Monthly Meeting of the City Council met in the Council Room of the
City Hall with the Mayor Emery L. Vassar, presiding.
On.Roll Call the following Councilmen answered present: Edgar L. Oakes, F. D.
Mumford, W. S. Boynton, G. M. ?enrich, G. W. Montgomery and W. R. Hollingsworth. Absent:
The Minutes of April 4th, 13th and 20th., were read and approved as read.
MessrsBob Dawson, Fred Newman, L. L. Hurst, Richard Pederson and Fred Lewis ap-
peared before the Council regarding the oiling of So. 13th Street. The matter was referre
to the City Engineer.
The Sanitary Inspector reported that there were several properties that were not
connected with the sewer. The Mayor instructed Mr. Maxey, Sanitary Inspector to see that
these properties were connected with the sewer.
The Clerk read the following letter from the City Treasurer:
To The Honorable Mayor and City council,

Caldwell, Idaho.
I hereby ask for authority to borrow from the Cemetery Investment Fund, the
sum of ($2,850.00) Twenty - eighty Hundred and Fifty Dollars, for the purpose of
paying off the final payment on the Fire Truck, so as to be able to take advan-
tag the 5% discount as per the Contract with The American LaFrance and Foa-
Co,
Giving the Cemetery Investment Fund a note for this amount which can be p
payed back after the yearly appropriation is made.

Moved by Oakes, seconded by Montgomery that this request be granted. Motion

Thereupon, the following preambel and resolution was presented by Councilmen
Oakes:
WHEREAS, The City of Caldwell, under date of August 21, 1935, purchased one,
500 gallon Buster Tank Fire Equipment for the City of Caldwell of the American- LaFrance
and Foamite Corporation through the Northwest Machinery Company, and upon the said Pon -
tract of Purchase $3,000.00 less 5 per cent was 'lue April 30, 1036, and
MMEAS, There are sufficient funds in the cemetery fund of the City of Caldwell
Canyon County, Idaho, and
.MH :AS, By the use of such funds and investing said funds in said 500 gallon
Buster Tank, the City of Caldwell can save 5 per cent on $3,000.00
NOW, THEREFORE, BE IT RESOLVED That the treasurer of the City of Caldwell be
and he is, hereby authorized and directed advance to the said American- LaFrance and Foamit
Corporation through the Northwest Machinery Company the said sum of $3,000.00 less 5 per
cent from the said cemetery investment fund, to -wit: The sum of 02,850.00, and to invest
the same in the said fire apparatus contract, taking proper assignment thereof to the cem-
etery investment fund from the American -Le France and Foemite Corporation through the Nort
-
west Machinery Company. And the Mayor of the City of Caldwell, Canyon County, Idaho, be,

and he is, hereby, authorized and directed, for the purpose of keeping the books of ac-

count straight in the various funds of the City of Caldwell, as taken �care of in the office
of the tseasurerts office, to wxecute on behalf`of the city of Caldwell a good and suf-
ficient note or memorandum to be due and payable into said fund from the general fund of
the City of Caldwell on or before 90 days after slate, which said note or memorandum shall
bear interest at the rate of six (6) per cent par annum, and shalt be duly attested by the
City Clerk of the City of Caldwell,

And moved the adoption thereof.
Councilman Montgomery,
seconded the motion.
A yea
and nay vote was had thereon, with the following results:
Yes: Councilmen, Oakes, Boynton,
Mumford, Fenrich, Hollingsworth and Montgomery.
No: None.
Absent and not voting: None.
Whereupon, the Mayor declared the
motion duly carried and the preamble and re-
solution duly adopted.
The Clerk read three kffidavits of
Publication.
The Bills for April were read and
on motion by Montgomery, seconded by Fenrich
that
these bills be allowed and Warrants be
ordered drawn for the
'larious amounts all of
which
had been approved by the Chairman of
the a`inance Committee.
Motion carried.

There being no further business to come before the council, it was moved by
seconded by Oakes, that Council adjourn. Motion carried.

The Council met on call of the Mayor, with the tayor, Emery L. Vassar, presiding,
On Roll Call the following Councilmen answered present; Oakes,Boynton, Mumford,
JHollingsworth and Montgomery. Absent : None.
The Mayer informed the Council the meeting was called to take up unfinished
business, and to consider the 1936 -1937 budget.
Mr. Cohste of the University of Idaho, appeared before the Council and explained
weed control and requested the City to furnish half of the chemicals used, The matter
was left on the table..
A.letter was lead from R. M. Whelchel requesting the Council to cancel taxes on
Lots 13 to 16, Block 8 Dormans Addition.
Whereupon, the following preamble and Resolution was presented by Councilman
Boynton;
Resolution.
AREAS, Mr. R.W. Whelch 1 has presented to the Mayor and Council a petition for
the cancellation of sprinkling taxes levied and assessed against lots 13 to 16, Inclusive
of Block S. Dorman's addition to the City of Caldwell, according to the official plat Cher
of now on file and of record In the office of the recorder of Canyon County, Idaho, for
the years 1926, 1929, 1930, 1931 and 1932 in the sum of 87.30 for each of said years, and
$6,60 for each of the years 1933, 1934, and 1935, making a total of assessments, without
penalties and interest, in the sum of $64.20, and
WHEREAS, It is made to appear tothe Mayor and Council that the said petitioner,
R. W. Whelchel, had purchased the property at tax sale from Canyon bounty, Idaho, for stet
and county taxes, and that by reason thereof the local Improvement assessment taxes
against the said property are no longer a lien thereon under the rule of law that now ob-
tained in the State of Idaho that property purchased of a county for general state and
county taxes at tax sale frees the property of all local improvement district taxes and
sales, and all special assessments against the property,
NON, TIEREFORE, BE IT RESOLVED That the said sprinkling tax against the said
property for the above mentioned years in the above principal amounts for the several years
plus interest and penalties, be, and the same are, hereby cancelled, and the Treasurer of
the City of Caldi as the collector of all special improvement and special taxes of the
City of Caldwell, be, and he is,.hereby authorized and directed to cancel upon his books
the assessments, plus interest and penalties for each of the above years on the above
described property, and to issue in suitable form any certificate or certificates or in-
strument in writing necessary to show that the said assessments and taxes have been cancel]
ad in conformity herewith; and moved the adoption of said preamble and resolution, which
motion was seconded by Councilman Mumford. {
