The Meeting was called to'order by Pasley.
The Roll of the City Council was called with the following members

The Mayor,stated. that -he would like to present to the City Council
several items that were not,printed..on the Agenda that- he would
like to 'have permission to add to..tTe Agenda for this M oeting.
The first one was a request the Western Trailex.Worl.;.s, the
second, was consideration of a fence set back, at...the Van Buren
School, the third' was a review of the City Code; Title 4, Chanter
6 relating, to . nonresid�ent .merchants.; and, the .- fourth was to .approve
the Bylaws for the Airport Commission.

(AUDIENCE PARTICIPATION)
The Mayor then stated that this was the time for the audience
to bring any matters that they cared to before the City Council
for their consideration or discussion. The Mayor recognized
Mrs: Jo"M Fullbright Who asked why some were having to pay $25.00
as a fine for having irrigation water ruching down the streets
while others have had to pay~ only $10:00 for same offertise.
The Mayor informed her that this was the Judge I s determination as
the City of Caldwell had no control over this. The City did issue
the citation, but she Magistrate.Court was run by Canyon County.
OLD BUSINESS
(BILL NO. 13 ORDINANCE REGARDING TRUCK PARKING)
The Mayor requested that the City Clerk read Bill No.. 13 in _F -all
as follows:
AN ORDINANCE AMENDING TITLE 11, CHAPTER 9, SECTION 8
OF THE CITY CODE OF THE CITY OF CALDWELL, DELETING
CERTAIN LANGUAGE THEREIN; DETERMINING THAT THE PARKING
OF TRUCKS AND COMMERCIAL VEHICLES SHOULD BE COkTROLLED
WITHIN THE CITY LIMITS OF THE CITY OF CAL - DWELL, IDAHO,

PROVIDING CERTAIN DEFINITIONS THEREFOR, TOGETHER WITH
RESTRICTIVE PROVISIONS IN THE CITY CODE OF THE CITY OF
CALDWELL, IDAHO, AS FOLLOWS:
BE IT ORDAINED By the Mayor and Council of the City of
Caldwell, Idaho:
That Title 11, Chapter 9, Section 8 of the City Code of
the City of Caldwell, Idaho, is hereby amended to read as
follows:

PARKING OF TRUCKS AND COMMERCIAL VEHICLES PROHIBITED
The parking of trucks and commercial vehicles within the
city limits of the City of Caldwell, Idaho, shall be regulated
as hereinafter provided.
(A) DEFINITION OF TERMS: For purposes of this chapter
certain words and terms used herein are defined as
follows:
GROSS WEIGHT: The weight of a vehicle without load plus the
weight of any load thereon.
TRUCK: Every motor vehicle or combination, of vehicles
designed, used or maintained for the transportation of
property of a gross weight of sixteen thousand (16,000)
pounds or more
It shall be unlawful for any person to.park or leave
standing a truck or commercial vehicle on any street, alley
or other public right -of -way within any residential zone
within the Citv or upon anv through street within the Citv
for a period of more than two hours
Provided, however, that a truck or commercial vehicle ma
remain Parked or standing in excess of the aforementioned two
hour time, for the purpose of delivering: or picking up
materials or merchandise provided such truck or commercial
vehicle does not create a traffic or other hazard
(C) T he provisions of this Chapter imposing time
on truck or commercial vehicle parking shall not relieve
any person from the duty to observe other and more restrictive
provisions prohibiting or limiting the stopping,_ standing ot
parking of vehicles in specified places or at specified times
The Mayor then asked the Chief.of Police to comment regarding this
proposed ordinance. Chief Astleford stated that he had been asked
by the Mayor to check with neighboring cities to see if they had
some kind of an ordinance regarding the prohibiting of trucks
parking in the residential areas of town. Nampa does have an
ordinance prohibiting the parking of the heavy trucks in the
residential areas. The Chief further said that he felt the streets
in Caldwell were not constructed to handle.these:_trucks. He felt
that this ordinance was definitely needed as the residential streets
were not wide enough to have them parked there. It would
certainly present a traffic hazard. The Chief stated that he
understood their need fora place to park their trucks, but still
felt that was their problem. He further proposed that bheordinance
read that it would be unlawful for any person to park or leave
standing a truck or commercial yehicl:e upon any street, alley, or
other public right -of -way within any residential zone within the
city for ..a, period of more than, two .hours. Then, if the driver was
delivering.merchandise, he could park long enough to accomplish
this.

Much discussion: followed regarding this truck parking ordinance.
The Mayor did comment that there was a significant number of
signatures on the petitions handed, to him voicing their complaint
against the proposed ordinance. The Mayor then asked if there was
anyone from the audience who tiaould like to speak in re axds
to this ordinance. Several people were recogniFed by the Mayor
and expressed their negative feeli -ngs toward this ordinannce. They
objected to having to park their trucks where there was no
security, and where t'.ey couldn't jump them in the cold weat -.er.
Among those heard were Robert H6us.e, Bob Weygamdt, Ken Oltmar,
Mr. Ryder, Judy E1lsberry, Ray Kueneman, and Dea=n. Abrahams and
Leonard Day. Mr. Day felt the need of the ordinance even though
he had been 'a trucker himself. The City Att'orriey - felt that some
of the language in the proposed ordinance should be clanged and
suggested further study of the bill before approving it.
MOVED by McCluskey, SECONDED by Williams that Bill No. 13 be
tabled for further stu.cdy and discussion.

Councilman. Raymond reported that there was 190 signatures o;n the
petitions presented to the City Council by those opposed to the
ordinance.
(BILL NO. 16 - ORDINANCE NO. 1424.- ADDRESS ORDINANCE)
The Mayor asked the Ci[.y Clerk to read Bill No. 16 for the third
reading . in full as follows:
AN ORDINANCE REQUIRING THAT ALL OCCUPIED BUILDINGS, BOTH
BUSINESS AND RESIDENTIAL, WITHIN THE CITY LIMITS OF THE
CITY OF CALDWELL, IDAHO, HAVE CONSPICUOUS ADDRESS STREET
NUMBERS AFFIXED TO SAID BUILDINGS TO ENABLE PASSERSBY TO
IDENTIFY THE STREET ADDRESS OF SAID BUILDINGS; REPEALING ALL
ORDINANCE, RESOLUTIONS, OR ORDERS OR PARTS THEREOF IN CONFLICT
HEREWITH.
BE IT ORDAINED by the Mayor and Council of the City of
Caldwell, Idaho:
WHEREAS, the City Council of the City of.Caldwell, Idaho,
has ascertained that requiring street numbers to be a.: =fixed
to all occupied buildin�,s will be of benefit to the general
welfare of the Ci. - .y of Caldwell, the following ordinance is
created:
5- 1--10: POSTING OF ADDRESS NUMBERS ON ALL OCCUPIED BUILDINGS:
All buildings within: the city limits of the City of Cald
which are occupied :.or residential or business purposes shall
have address nnumbers posted i-z a conspicuous place cn the

be visible to passersby, and it shall be the duty of the

(PUBLIC AUCTION.OF CITY LOTS AT FREEPORT AND KIMBALL)
The Mayor explained that last year an appraisal was made of some
City at Freeport and Kimball. This was five lots and
was appraised at $3,500 for Residential, $5,000 for AB Residential,
$10,000 for Commercial. In December, the City passed an ordinance
of intent to sell. The Mayor had a request to put this property
up for sale at this City Council Meeting tonight. The Mayor stated
that the person who had requested the property sale be included
on the Agenda was not in the audience. He then asked if there was
anyone from the audience interested in bidding on these lots with
the minimum bid of $10,000.
There was no bids, so the Mayor stated that the Meeting would continue
as outlined.
(REQUEST FROM WESTERN TRAILER WORKS)
The Mayor said that there was a request from Western Trailer Works
to temporarily establish a paint shop in their burned out building.
This paint shop would not comply with City Code as overhead
sprinklers was one of the requirements. This would be impossible
to do in the building at this time due to the fire damage. It
was the intention of the Western Trailer Works to start a new
building shortly after receiving their insurance settlement. They
estimated that it would take approximately one hundred and fifty
days to construct the new building. They were in complete
agreement that it will meet or exceed the 'Uniform Building Code,
the National Fire Code, and the Life Safety Code. In the meantime,
they -have orders for five hundred and five trailers which they can't
fill unless the City Council agrees that they can set up a paint
shop in the old building without the sprinkler system. They
employed seventy -three employees. If they can do this, they can
then fill the order for the five hundred and five trailers. If
the City Council feels that they cannot grant their request, they
would have no alternative but to close down, their business which
would put seventy -three employees out of work. It was the Mayor's
recommendation that they be allowed to operate temporarily so
they can continue work until the new building was constructed.
Councilman Raymond inquired as to whether the City Council had the
authority to grant a variance such as this. The Mayor replied that
this was not a. variance, but permission for them to operate without
the sprinkler system.
John Pilote was recognized and 'again emphasized that this would be
only a temporary situation as.their building would be under
construction as soon as possible.

the Western Trailer Works to establish a temporary paint shop in
their present building without meeting the City Code qualifications
of having an overhead sprinkler system.

(REQUEST TO BUILD FENCE AT VAN BUREN SCHOOL)
The Mayor presented the next item which was a request by the Van
Buren School to erect a fence on City right -of -way. It would be
set back five feet from the curb which would provide room for a
sidewalk if one should ever go through there. The City right -of-
way extends fifteen feet. He was asking the Council to give
them permission for them to build a fence on City right -of -way five
feet back from the curb to provide room for a. sidewalk.

(BYLAWS FOR THE AIRPORT COMMISSION)
The Mayor explained that sometime ago` t he Byla-vvs , for tlae Airpo
Commission were presented to the City Council, but no action was
Commission until the Airport Commission had . adopted them. . The Airport
Commission now approved these Bylaw's and -asked tae City Clerk
to present them- to the City Go for'their acceptance.

The Mayor said that this was the time set 'aside a Public
Hearing on a va of a portion of Cedar Street bet
Colorado and Montana. Sirce there was no one in the au6J'-ence
who was opposed to the vacation of a portion of Cedar Street,
the Mayor declared Llne public hearing closed.

(BILL NO. 23; ORDINANCE 1431; ZONING-AND ANNEXATION OF CEDAR PARK
SUBDIVISION)
The Mayor declared the meeting open for a public hearing on the
zoning and annexation of Cedar Park Subdivision. Mr. Lewis, the
City Engineer, explained that this was ten acres south-of the
L.D.S. Church. It was recommended that this be zoned A-Residential.
The Mayor asked if there was any comments from the audience
regarding this zoning and annexation. Since there was none, the
Mayor declared the public hearing closed and asked the City Clerk
to read Bill No. 23 by title only as follows:,.
AN ORDINANCE DETERMINE THAT CERTAIN LANDS HAVE BEEN ANNEXED
TO THE CITY OF CALDWELL, STATE OF IDAHO, AND DECLARING SAID
LANDS, BY PROPER LEGAL DESCRIPTION THEREOF, AS DESCRIBED IN

This Plat =Jaas presented by John Hotae and he explained to the City
Council that everything was completed as required.

the final plat for Cedar Park Subdivision.

(FINAL PLAT OF CALDWELL INTERSTATE 41 SUBDIVISION)
The Mayor called on the City Engineer to di scuss this plan. Mr.
Lewis stated that he had thought the road next. to the plat ;could
be completed. He felt that this should. be a stipulation if the
plat was approved. _He also explained' that Mr. Osburn.agreed to be
part of the plat, but he` did "not agree to the improvements. The
Mayor felt that the City Council should hold up on this approval
until all of the stipulations T Iere firm.
MOVED by McCluskey, SECONDED by Raymond that the approval of the
final plat of Caldwell Interstate #1 Subdivision be tabled until
the problem areas were taken care of.

The City Council suggested that the City Engineer inform those
presenting plats to be at the City Council Meeting when it will
be considered.
(PRELIMINARY PLAT OF COUNTRY MEADOWS SUBDIVISION)
Mr. Lewis, the City Engineer, explained that this plat was located
south of Wilson School. This preliminary plat was presented by
Mr. Hibbard. Mr. Lewis stated that the Planning Commission had
reviewed the..preliminary plat. Mr. Hibbard intends to sewer it
and they have complied with all of the regulations. It was the
Planning Commission's recommendation that the City Council approve
the preliminary plat.

approve the preliminary plat of Country Meadows Subdivision.

(RESULTS OF BIDS FOR L.I.D. 77°-1 - RESOLUTION NO. 31 -77)
The Mayor asked the City Engineer to report on the bid opening for
L.I.D. 77 -1.
Mr. Lewis reported that on April 25, 1977, at 2:00 o'clock P.M.
the bids were opened for.the construction of L.I.D, 77--1. The
following were the - results:
Boise Paving and Asphalt $ 79,432.30
Jerry Hess - 81,472.90
Nay and Wheeler 88,607.40
Quinn - Robbins 95,198.90
Nelson -Deppe _ 98,838.20
Asphalt Paving 129,..033.50
All bids were checked for correctness of extensions and additions.
It was the recommendation of the City Engineer that the City
Council accept .the. low_b.id and .award to Boise Pava.ng_ and Asphalt.
Mr. Lewis stated that he had communicated with Mr. Gillette who
reported that the subcontractors were going to be C. K. Moore of
Eagle for removal of the trees; his concrete subcontractor was
going to be C & C Concrete Co. of Nampa; and it was the intention
of Mr. Gillette to do his own excavating and pipe work.
Councilman McCluskey was recognized and stated that he had requested
that a representative of the firm be present at the City Council
Meeting so the members of the City Council would havean
opportunity to ask any questions they might have. This was due to
the fact.that.the City.was not satisfied with the job they had done
previously. Mr. Gillette informed the City Council that they were
aware of the unsatisfactory work done in L.I.D. 76 -1 and hoped
that the City would be better satisfied with the new L.I.D.
Councilman McCluskey. then.read Resolution No. 31 -77 in full as
follows:
WHEREAS, City Council,, City of Caldwell, by Ordinance duly
enacted has initiated proceedings in D.I.D..77 -1; and
WHEREAS, Invitation for bids for construction work required
in said ordinance authorizing L.I.D. 77 -1 has: been duly.•published;
and
WHEREAS, bids for said construction have been received; and

WHEREAS, Boise Paving and Asphalt Co. submitted the lowest
and best bid:
NOW, THEREFORE, 3 IT RESOLVED.Tbat the bid of Boise Paving
and Asphalt Co. be, and the same is, hereby accepted ar <ci the
Mayor and Clerk be autlzor.zed and directed to enter into contract
with Boise Paving and Asphalt Co. pursuant to terms and conditions
of invitation for- -bid in L.I.D. 77 -1 in the amount of $79,432.30.

The Mayor requested the City Clerk to read Bill No. 22 by title

AN ORDINANCE PROVIDING FOR THE SALE AND ISSUANCE OF BONDS
FOR LOCAL IMPROVEMENT DISTRICT N0, 76 -1 FOR THE CITY OF CALDWELL
IDAHO; PROVIDING FOR THE PAYMENT AND COLLECTION OF SPECIAL
ASSESSMENTS LEVIED IN SAID LOCAL IMPROVEMENT DISTRICT; PROVIDING
FOR THE HANDLING OF FUNDS RECEIVED FROM SPECIAL ASSESSMENTS AND
THE CREATION -- AND ENFORCEMENT OF LIENS IN CONNECTION WITiT THE
SALE AND ISSUANCE OF BONDS; PRESCRIBING DETAILS CONCERNING
THE FOREGOING; PROVIDING FOR A REASSESSMENT OF ASSESSMENTS AND

(CITY COUNCIL ACCEPTS ASSESSMENT ROLL L.I.D. 77 -1)
The Mayor stated that this was the meeting set for t1,.e acceptance
of the Assessment Roll for L.I.D. 77 -1 and for setting the date
and time "or- a• public hearing on the assessment roll.
MOVED by McCloskey, SECONDED by Bauman to accept the Assessment
Roll "for L.I.D. 77 -1 in the amount of $30,176.10. The balance of
the contract price shall be paid from the Street Fund budget

and further set the public hearing for May 20th,at 4:00.P.m.
in the Council Chambers.

The Mayor asked the City Council members if they were planning to
go to the A.I.C.Convention in Boise..'There was a reduction in
-cost if the reservations were sent in before May..13t.1j,. Several
of the City Council members indicated their intention- :t:o,`attend.
It was then MOVED by Williams, SECONDED by McCluskey that the
Mayor be designated as their official voting delegate—

(BEER LICENSE APPFOVAL - TRIMBLE OIL DBA TRUE VALUE OIL)
The Mayor presented an application • from Trimble Oil Company doing
business as the True Value Oil fora,,beer license., -The application
was complete, the Police Chief had written his statement of
approval, and the fee was paid to the City Clerk's office.
MOVED-by McCluskey, SECONDED by Bauman that approval be given
for the beer license application submitted by Trimble Oil Company.

(DECISION ON WATER METER AT LINCOLN SCHOOL)
There was a recommendation presented by the City Engineer as
follows: The Lincoln School has been ruled by
George Dufur as a separate building behind the existing Lincoln
School. It is connected with a breezeway. The kindergarten
building is served by both water and sewer. It was the City
Engineer's recommendation that even though this is a,:,separate
building the City Council grant permission that the kindergarten
be served on the same meter with the Lincoln School water service.
MOVED by Bauman, SECONDED by Banks that the recommendation of the
City Engineer be accepted.

Raymond, and Banks. Those voting no: none. Absent and not

(FINAL PLAT OF T & T #2 SUBIDIVISION)
The City Engineer explained that this plat was considered by the
Planning Commission and recommended that it be approved subject
to the approval of Pioneer Irrigation District on an irrigation
system. The City Engineer stated that he received a letter from
the Pioneer Irrigation District saying that they would not approve
the irrigation system due to the fact that they were not planning
to irrigate every lot. Since then, Mr. Trumbull has agreed to

install and deliver - .,, , 7atex to each individual lot. Pioneer
Irrigation District has not stated where the delivery points - would
be, but -,when this was 4 1efined the plan - , , , - ould be developed to
include every - lot. It-was the City Engineer's recomm that
the City Council accept the final plat-of T & T Subdivisio #2
with the stipulation that the plan be presented to him for approval.

of T & T #2 Subdivision subject to the'recoTmendations-made by
the City Engineer.

Councilman Raymond reported that he had attended the Tdaho L
Association banqiiet in Boise. Eie stated that Frank.Pay*,i.e
won the Trustee of the Year award.

Payne a letter of commendation.
