The Rggular Monthly Meeting of the City Council met in the Council Rooms of the City Hall, with the Mayor Ed Simmerman presiding. Upon Roll Call the following Councilmen answered present: E. L. Vassar, N. E. "Coley" Smith, Max Luby, Emile Shorb, L. P. Eldredge and Leland Finley. The Bills for April were read and on motion by Councilman Vassar, seconded by Councilman Finley these Bills be allowed and warrants ordered drawn for the various amounts, all of which have been aoproved by the Finance Committee. McConnel of Portland, Oregon, met with the Mayor and Council and discussed the installation of electric rides for children in Caldwell Memorial Park. The rides to be installed on a seven week try out basis and to be sponsored by the Kiwanis Club. Moved by Councilman Shorb, seconded by Councilman Smith permission be granted to the Kiwanis Club to install the rides and the license be waived. Upon Roll Call it anDeared the motion was unanimously carried. Bids Local Imp. Dist N 48. Mayor Simmerman informed the Council this was the time set by notice for receiving bids for con- struction work in Local Imnrovement District Number 48. The following bids were opened and read: Machaelis Construction Company $49,3(18.17 J David G. Dorsey Construction Company 54.812.49 Watkins Construction Company 44,948.60 These bids were referred to the City Engineer to check extensions and report back to the Council. I l I II I I I Rezoning: Council Comments and remarks by Dr. John Stecker, Chairman,✓ianning Comumissicn. Rezoning of Block 27, Dorman -s Addition and South -west Half of Block 100, Goandu Addition was again brought up for discussion. Councilman Eldredge: R have been made to the Mayor and Council by the Board of including Adjustment, Special Zoning Committee and the Planning Commission regarding/the above property in "C" Commercial Zone. I am a member of the Board of Adjustment and a member of the Sppcial Zoning Committee. We have held a number of meetings and a great deal of time and study has been given to the re- zoning program and I feel the Council should accept these recommendations. It is within the power of the Council to over- ride the recommendations presented by these groups. Councilman Shorb: The Council requested the Boards to make reco.'nendations but I do not see any reason not to include this poperty in the re- zoning program, also, I feel the petitioners are reasonable in their requests. zoning. Councilman Smith: I feel it is very poor iolicy to have a zoning line down an alley. Councilman Vassar: I think it is our duly to listen to the petitioners when they come in a group as they have tonight. Thereupon iS was moved by Councilman Smith, seconded by Councilman Vassar, Block 27, Dorman's Addition and the South -west Half of Block 100, Coandu Addition be included in "C" Co�mercial Zone and the City Attorney be instructed to prepare the necessary papers to put this into effect. Upon Roll Call those voting in the affirmative were: Vassar, Smith, Luby, Shorb and Finley. Absent and not voting: None. Negative: Eldredge. There upon. .the Mayor declared the motion carried. Accepting bid of Watkins Construction eo, L. I. D. # 48 The City Engineer recommended the City accept the low bid of Watkins Construction Company for construction work for Local Improvement District Number 48. Moved by Councilman Luby, seconded by Councilman Eldredge the Chief of Police be authorized to call for bids on two new cars. Upon Roll Call it appeared the motion was unanimously carried. Pool & Card License Application for Pool and Card License was read from Roy's Snort Shop the fee accompanying the application. Moved by Councilman Luby, seconded by Councilman Eldredge this License be granted. Upon Roll Call it appeared the motion was unanimously carried. Mayor Simmerman autt s.z =d official to attend 11 Convention Moved by Councilman Vassar, seconded by Councilman Smith, Mayor Simmerman be designated as the official representative for Caldwell at the Idaho Municipal League Convention to be held at McCall, June 6 thru 18, 1960. ) 2—L- u-.- n.—,. t Letter Chamber of Commerce regardin;' anuexa -n of fcrty acreas lying northif the Wilder Highway,west of Ai The following letter to the Chamber of Commerce was read and ordered s on the Minutest May 6, 1960 Chamber of Commerce Box 772 Caldwell, Idaho Gentlemen: In accordance with the action of the City Council at the meeting on April 18, 1960, the City Attorney and I were to eet forth the requirements which must be met before the area lying north of the Wilder Highway andwast of the Airport Avenue can be annexed to the city. Before being annexed, the area must be platted according to the statutes in tracts of five acres or less. Sufficient right -of -ways must be dedicated to provide adequate access to the platted tracts. When the plat is properly executed and filed, it will serve as the instrument which will dedicate these right -of -ways for the nublic's use. Utility easement should be provided for tracts which cannot be served Prom the right -of -ways. After the general street plan has been formulated and before the plat is actually made, a sketch should be presented to the Planning Commission and the City Council in order to get prior approval, as the changing of a plat once it is made would be expensive. v After the area has been annexed, the policies governing the opening of streets and extension of utilities would apply. These are briefly as follows: Streets will be graded and graveled to an all weather condition when they are needed. Before streets are opened, m+tY drain ditch, waste ditch, or irrigation ditch must be tiled by the property owners. All extensions of the domestic sewer will be at the expense of the property. A sewer interceptor is atailabe in the southeast corner of the property, Field work has not been taken to determine the distance to the west which this interceptor would serve. In the event that there is a part of the area which cannot be served by a sewer and septic tanks are required, the liquid waste cannot reach any irrigation or drain ditch. In other words, sentic tank over- flows must be placed in drain fields or cesspools. The water mains will be laid in the area by the city as needed. Fire protection will be provided as the water mains are laid. It appears that the most logical development would start some- where near the southeast corner of the property. Development from this corner wo-:ld be an advantage from the standpoint of expense to both the property and the city. Rural Fire District The City Attorney was instructed to nrepare an agreement with the Rural Fire District. Mayor Simmerman discussed the following projectst New jail, dog pound, two-way control,shop and street lighting. Reports were readfrom the Police and Building departments and ordered filed. There being no further business to come before the Council it -as moved by Councilman Smith, seconded by Councilman Vassar that Council recess to meet May 16, 1960.
