he didn't think it would be worth the effort it would take.
Councilman Vassar inquired as to whether or not there would be any advantage to paying it under
protest and the City Attorney said not unless the City wished to contest it or file a suit to recover it.
He stated that he could see no real advantage in paying it under protest in that he didn't think there was
going to be a determination of it and if there were, even though the City hadn't paid under protest, they
could gat a refund if they were entitled to it. Councilman Vassar stated than that he would go on the City
Attorneys judgement. There being no further business to come before the Council, it was moved by Councilman Luby,
seconded by Councilman Krause that the Council recess to meet April 30, 1962 in the Council Chambers at
5: 00 P. M.
A vote was taken and the motion unanimously carried.

Upon Roll Call the following Councilmen answered present: E. L. Vassar, Emile Shorb, Max Luby,
and Charles E. Krause. Absent were Councilmen V. day Martin and Smith.
Councilman Vassar sponsored the following Resolution and moved its adoption. The motion was
seconded by Councilman Shorb. A vote was taken on the motion and was uaanimously carried.

RESOLUTION APPROVING THE PLANS AND SPECIFICATIONS FOR THE CONSTRUCTION OF IMPROVEMENTS IN LOCAL IMPROVEMENT
ISTRICT N0. 5o OF THE CITY OF CALDWELL, IDAHO, AUTHORIZING THE INVITATION FOR BIDS AND SETTING A DATE FOR
-. OPENING BIDS.
WHEREAS, the Mayor and Council of the City of Caldwell, Idaho, have heretofore duly and regularly,
as required by _law, created Local Improvement District No. 50 of the City of Caldwell, Idaho, for the purpose
of constructing in said district, improvements consisting of suitable curbs and gutters and street and alley
Heys and for the purpose of surfacing, grading and oiling the streets therein; and
WHEREAS, the City Engineer of the City of Caldwell has prepared and filed with the City Clerk of
..aid City, plans and specifications for the construction of said improvements in said Local Improvement

District No. 50 of the City of Caldwell, Idaho, which said plans and specifications have been presented to
the Mayor and City Council and approved; and
WHEREAS, it is desirable to invite bide for the construction of said improvements.
NDbd, THEREFCRE, be it resolved and ordered by the Mayor and Council of the City of Caldwell, Idah
Section 1. That the plans and specifications heretofore prepared by the City Engineer and filed
with the City Clerk of the City of Caldwell, for the construction of certain improvements authorised in sai
Local Improvement District No. 50 of the City of Caldwell, Idaho, for the purpose of constructing in said
district improvements consisting of suitable curbs and gutters and street and alley valleys and for the
purpose of surfacing, grading and oiling the streets therein, be and the same are hereby approved.
Section 2. That the City Clerk is hereby ordered to prepare and let invitations for bide and
publish the same in the News Tribune, official newspaper of the City of Caldwell, on May 5, May 12, and
May 19, 1962 calling for the opening of said bids at the City Hall on May 21 , 19621 at the hour Of 8000
o'clock P.M. in accordance with Section 50 -2936 of the Idaho Code.
There being no further business to come before the Council, it was moved by Councilman Vassar,
seconded by Councilman Luby that the Council adjourn.
A vote was taken and the motion unanimously carried.
The meeting adjourned at 5130 P. M.

The regular monthly meeting of the City Council met in the Council Chambers of the City Hall, with
Hayar Simmar:an presiding.
Upon roll call the following Councilmen answered present: E. L. Vassar, Emile Shorb, Max Luby,
:harles E. Krause, N. E. "Coley" Smith. Absent, V. Jay Martin.
:ourtesy Benches - Mr. Dan Baker of Boise
Mayor Simmerman introduced to the Council, Mr. Dan Baker of Boise, and stated that he would like to
talk to the Council about "Courtesy Benches" which he makes and distributes around town.
Mr. Baker addressed the Council and said that he didn't bring a7W written proposals with him but
emld like to inform the Council that he had a little Company in Boise called Courtesy Benches and that he
tykes and installs these benches around Boise for the comfort and convenience of the general public. He
)resented a booklet of pictures, ate., to the Council, as an illustration of some of the benches and adver-
tising on them.
Mr. Baker then stated that he would like to see if he could get an agreement to make and install
Dome of the benches here in Caldwell; the seats and backs are made of Redwood and the ends of re- inforced
/oncrete. The bench weighs approximately 300 pounds and are seven feet long and approximately eighteen inches
ride. He said that they had had very good acceptance in Boise from the public and he believed they were a
0ompliment to the City; that they had nothing objectionable on them in the way of advertisement. He said
;here was some national advertising and that, of course, it was the advertising that made the benches
0ossible.
He said that in Bodes, it was necessary to have an Ordinance passed, in order that the benches
0ould be placed and that he has a letter of recommendation from the Mayor of Boise; that he maintains the
mnehes, keeps them clean, and should they become defaced, faded, etc., that he takes them in and restores
ahem and paints them= also, that he maintains 103 - 100 Thousand Dollars worth of liability on the benches.
