As per adjournment of April 25th. , The pity Council met in the Council Room of the
City Hall, with the Mayor, Fred L. Lilly, presiding,
On Roll Call, the following Councilmen answered present: M. S. Sandmeyer, A. G.
Keister, 0. E. Bales, Joe Dickens and 0. M. Johnston. Absent E. L. Vassar.

The Clerk read Resolution No.-� by Sandmeyer as follows:
A - 79OLUTION AUTHORIZING THE TREASURER OF THE CITY OF CALDWELL, IDAHO, TO TRANSFER
CERTAII: SUNS OF MONffiY FROM CERTAIN FUNDS OF THE CITY OF CALDWELL, IDAHO, TO THE ROAD
FUND OF SAID CITY.

WHEREAS, There is an unexpended bakance in certain funds of the City of Caldwell,
Idaho, as follows, to- wit:in the General Fund the sum of $ 5,897.22: in the Waterworks
Fund the sum of 13,067.16; in the Cemetery Fund the sum of $ 2,600.58; in the Library
Fund the sum of 2,712.32; in the Park Fund the sumof j 4,064.01; in the Street Lighting
Fund the sum of 4 ,429.96 and in the Emergency Fund the sum of $ 2,712.34; and
WHEREAS, The unexpended balances in said funds exceeds the amount required for
current expenses; and
WHEREAS, there are certain outstanding warrants issued against the Road Fund of
said City in excess of the amount of money in said fund from which to pay said warrants;anc
WHEREAS, It has been determined that it is for the best interest of said City
that the excess in said funds be transferred to said Road Fund for the payment of said
outstanding warrants; now, therefore,
BE IT RESOLVED, By the Mayor and Council of the City of Caldwell, Idaho.
Section 1. The Treasurer of the City of Caldwell, Idaho. is hereby authorized and
directed to trandfier to the Road Fund of said City from the unexpended balances in said
funds the amount which exceeds the sum required for current expenses, as follows, to -wit:
from the General Fund the sum of .$ 1,200.00; from the Waterworks Fund the sum of $. 4,500.00
from the Cemetery Fund the sum of $ 500,00; from the Library Fund the sum of $ 500.00;.fros
the Park Fund the sum of $ 1,000.00; from the Street Lighting Fund the of $ 700.00 and
from the Emergency Fund the sum of $ 2,712.74, making a total of $ 11,112.34.

A RESOLUTION IN OO14PLIANOE WITH THE PROVISIONS OF CHAPTER 256,LAWS OF 1921, of the
State of Idaho, AS AMENDED BY CHAPTER45. LAWS OF 1925,OF THE STATE OF IDAHO, AS AMENDED BY
CHAPTER &%$ 154 LAWS OF 1927, OF THE STATE OF IDAHO, AS SOUNDED BY CHAPTER 193,LAWS OF
1929, OF THE STAVE OF IDAHO, AS MENDED BY CHAPTER 72, LAWS OF 1931, OF THE STATE OF IDAHO
RELATING TO DEPOSITS OF MUNICIPAL FUNDS.
BE IT RESOLVED By the Mayor and Coundil of the City of Caldwell, Idaho:
Section 1. That the First National Bank of Caldwell, Idaho and the Caldwell State
Bank be and they hereby are redesignated as depositories of the funds belonging to the -013
of:Caldwell, and that the City Treasurer of the City of Caldwell, is hereby authorized .

to keep on deposit in the First National Bank of Caldwell, Idaho, not to exceed the sum

Bank of Caldwell, Idaho, not to exceed the sum of 3 d of the funds coming

into the bands of the Treasurer by virtue of his office, provided, however, that at all
times such depositories shall keep on deposit with the County Auditor of Canyon County,
Idaho, for the benefit of said City and for the protection of said City funds, securities
sufficient to protect the deposits carried by such depositories from time to time.
Section 2. That the securities offered by said depositories and in the possession
of or under the custody and control of said County Auditor of Canyon County, Idaho,
having been investigated by the finance committee of the City Council of the City of
Caldwell, and found. sufficient, is hereby declared to be sufficient securities fox the
funds now on deposit -in said depositories, as oontemplated by the provisions of the Public
Depository Law, as defined In Chapter 256 of the Laws of 1921, of 'the State of Idaho, as
amended by Chapter 4K-of the Laws of 1925 of the State of Idaho, as amended by Chapter 154

of the Laws of 1827, of the State of Idaho, as amended by Chapter 193, of the Laws of 1929
of the State of Idaho, as amended by Chanter 72 of the Laws of 1931, of the State of Idaho

Section 3, That the City Clerk of the City of Caldwell is hereby authorized and
directed to give notice in writing to the Treasurer of the City of Caldwell, of the maxi—
mum sum which the Treasurer shell keep deposited in the depositories herein designated,
as required in Section 16 of Chapter 256 of the Laws of 1921, of the State of Idaho, as
emended by Section 4 of Chanter 45 of the Laves of 1425, of the State of Idaho, as amended
by Chapter 154, of the Laws of 1927, of the State of Idaho.
Section 4. That -the City Treasurer of the City of Caldwell is Hereby directed to
require said depositories to deposit additional securities from time to time, so that at
all times there shall be in the possession of the City Treasurer or under his custody or
control, securities deposited by such depositories sufficient at all times to secure the
deposits of said City as required by law.
.' ( Section 5. That the, City Treasurer of the City of Caldwell, is hereby authorized
and directed to deposit with the County Auditor of Canyon County, such securities as may
from time to time come into his possession or under his custody or control as security
for the deposit of funds of said City of Caldwell-.

On Poll Call the following Councilmen acted in favor of the Resolution: M. S. Sand
meyer, A. G. Keister, C. E. Bales, Joe Dickens and C. M. Johnston. Those opposed, None.
Absent and not voting, E. L. Vassar.
The Mayor then declared the Resolution No. 10 passed by the necessary three—fourths�

The Clerk read a. Petition made by Fred Mobus for a Permit tt construct a Service
Station.as follows:

I, Fred Mobus, the undersigned, hereby annlsr to the Honorable Mayor and Council.
of the City of Caldwell, Idaho, for Permission to construct and erect a service station
outside the fire limits, and in support of said aonlication, submit the following facts:

The proposed station will'be'locsted on Lots Fifteen to twenty -four ( 15to24) inclu-
sive on Block Sixty -six ( 66 ) Devers addition to City of Cs.ldwell, Idaho.
D ESCRIPTION OF S TRUCTURE
Said service station will oecu »y a space 10 x 24 feet ( 10 x 211) across one end of
a frame structure which is 24 X 32 feet in size.. Said part to be used for station will be
of frame structure with concrete floor.
OWNER
The owner,of the premises on which said service station is proposed to be built
and the person who will be the owner of said structure when co.epleted, is the applicant,
Fred Mobus. BUSINESS
The business to be conducted in said place of business sill be that of automobile
service station including the retail of gasoline and oils.
WHEREOF, I hereby respectfully petition your Honorable Body to permit the
sale of Eascline and oils from said establishment as herein specified.
